             To amend sections 4507.23 and 4507.24 of the Revised  18           

                Code to exempt veterans who have a                 19           

                service-connected disability rated at 100% by the  20           

                Veterans' Administration from payment  of any      21           

                application or service fees when obtaining a       22           

                driver's license or motorized bicycle license, or  23           

                fee for laminating such a license.                 24           




BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:        26           

      Section 1.  That sections 4507.23 and 4507.24 of the         28           

Revised Code be amended to read as follows:                        29           

      Sec. 4507.23.  (A)  Each EXCEPT AS PROVIDED IN DIVISION (H)  37           

OF THIS SECTION, EACH application for a temporary instruction      39           

permit and examination shall be accompanied by a fee of four       40           

dollars.                                                                        

      (B)  Each EXCEPT AS PROVIDED IN DIVISION (H) OF THIS         43           

SECTION, EACH application for a driver's license made by a person  44           

who previously held such a license and whose license has expired   45           

not more than two years prior to the date of application, and who  46           

is required under this chapter to give an actual demonstration of  47           

the person's ability to drive, shall be accompanied by a fee of    49

three dollars in addition to any other fees.                                    

      (C)  Except as provided in division DIVISIONS (E) AND (H)    52           

of this section, each application for a driver's license, or       53           

motorcycle operator's endorsement, or renewal of a driver's        54           

license shall be accompanied by a fee of six dollars.  Each        55           

EXCEPT AS PROVIDED IN DIVISION (H) OF THIS SECTION, EACH           56           

application for a duplicate driver's license shall be accompanied  57           

by a fee of two dollars and fifty cents.  The duplicate driver's   58           

licenses issued under this section shall be distributed by the     59           

deputy registrar in accordance with rules adopted by the           60           

registrar of motor vehicles.                                       61           

      (D)  Each EXCEPT AS PROVIDED IN DIVISION (H) OF THIS         63           

SECTION, EACH application for a motorized bicycle license or       64           

duplicate thereof shall be accompanied by a fee of two dollars     65           

and fifty cents.                                                   66           

      (E)  Each EXCEPT AS PROVIDED IN DIVISION (H) OF THIS         68           

SECTION, EACH application for a driver's license or renewal of a   70           

driver's license that will be issued to a person who is less than  71           

twenty-one years of age shall be accompanied by whichever of the   72           

following fees is applicable:                                                   

      (1)  If the person is sixteen years of age or older, but     74           

less than seventeen years of age, a fee of seven dollars and       75           

twenty-five cents;                                                 76           

      (2)  If the person is seventeen years of age or older, but   78           

less than eighteen years of age, a fee of six dollars;             79           

      (3)  If the person is eighteen years of age or older, but    81           

less than nineteen years of age, a fee of four dollars and         82           

seventy-five cents;                                                83           

      (4)  If the person is nineteen years of age or older, but    85           

less than twenty years of age, a fee of three dollars and fifty    86           

cents;                                                             87           

      (5)  If the person is twenty years of age or older, but      89           

less than twenty-one years of age, a fee of two dollars and        90           

twenty-five cents.                                                 91

      (F)  Neither the registrar nor any deputy registrar shall    93           

charge a fee in excess of one dollar and fifty cents for           94           

laminating a driver's license or motorized bicycle license as      95           

required by sections 4507.13 and 4511.521 of the Revised Code.  A  96           

deputy registrar laminating a driver's license or motorized        97           

bicycle license shall retain the entire amount of the fee charged  98           

for lamination, less the actual cost to the registrar of the       99           

laminating materials used for that lamination, as specified in     100          

the contract executed by the bureau for the laminating materials   101          

and laminating equipment.  The deputy registrar shall forward the  102          

amount of the cost of the laminating materials to the registrar    103          

for deposit as provided in this section.                           104          

      (G)  At the time and in the manner provided by section       106          

4503.10 of the Revised Code, the deputy registrar shall transmit   107          

the fees collected under divisions (A), (B), (C), (D), and (E),    108          

and those portions of the fees specified in and collected under    109          

division (F) of this section to the registrar.  The registrar      110          

shall pay two dollars and fifty cents of each fee collected under  111          

divisions (A), (B), (C), (D), and (E)(1) to (4) of this section,   113          

and the entire fee collected under division (E)(5) of this         114          

section, into the state highway safety fund established in         115          

section 4501.06 of the Revised Code, and such fees shall be used   116          

for the sole purpose of supporting driver licensing activities.                 

The remaining fees collected by the registrar under this section   117          

shall be paid into the state bureau of motor vehicles fund         118          

established in section 4501.25 of the Revised Code.                119          

      (H)  A DISABLED VETERAN WHO HAS A SERVICE-CONNECTED          122          

DISABILITY RATED AT ONE HUNDRED PER CENT BY THE VETERANS'          123          

ADMINISTRATION MAY APPLY TO THE REGISTRAR OR A DEPUTY REGISTRAR    124          

FOR THE ISSUANCE TO THAT VETERAN, WITHOUT THE PAYMENT OF ANY FEE   125          

PRESCRIBED IN THIS SECTION, OF ANY OF THE FOLLOWING ITEMS:         126          

      (1)  A TEMPORARY INSTRUCTION PERMIT AND EXAMINATION;         128          

      (2)  A NEW, RENEWAL, OR DUPLICATE DRIVER'S OR COMMERCIAL     131          

DRIVER'S LICENSE;

      (3)  A MOTORCYCLE OPERATOR'S ENDORSEMENT;                    133          

      (4)  A MOTORIZED BICYCLE LICENSE OR DUPLICATE THEREOF;       135          

      (5)  LAMINATION OF A DRIVER'S LICENSE OR MOTORIZED BICYCLE   137          

LICENSE AS PROVIDED IN DIVISION (F) OF THIS SECTION, IF THE        138          

CIRCUMSTANCES SPECIFIED IN DIVISION (H)(5) OF THIS SECTION ARE     140          

MET.                                                                            

      IF THE DRIVER'S LICENSE OR MOTORIZED BICYCLE LICENSE OF A    142          

DISABLED VETERAN DESCRIBED IN DIVISION (H) OF THIS SECTION IS      144          

LAMINATED BY A DEPUTY REGISTRAR WHO IS ACTING AS A DEPUTY                       

REGISTRAR PURSUANT TO A CONTRACT WITH THE REGISTRAR THAT IS IN     145          

EFFECT ON THE EFFECTIVE DATE OF THIS AMENDMENT, THE DISABLED       146          

VETERAN SHALL BE REQUIRED TO PAY THE DEPUTY REGISTRAR THE          147          

LAMINATION FEE PROVIDED IN DIVISION (F) OF THIS SECTION.  IF THE   148          

DRIVER'S LICENSE OR MOTORIZED BICYCLE LICENSE OF SUCH A DISABLED   149          

VETERAN IS LAMINATED BY A DEPUTY REGISTRAR WHO IS ACTING AS A      150          

DEPUTY REGISTRAR PURSUANT TO A CONTRACT WITH THE REGISTRAR THAT    151          

IS EXECUTED AFTER THE EFFECTIVE DATE OF THIS AMENDMENT, THE        153          

DISABLED VETERAN IS NOT REQUIRED TO PAY THE DEPUTY REGISTRAR THE                

LAMINATION FEE PROVIDED IN DIVISION (F) OF THIS SECTION.           156          

      A DISABLED VETERAN WHOSE DRIVER'S LICENSE OR MOTORIZED       158          

BICYCLE LICENSE IS LAMINATED BY THE REGISTRAR IS NOT REQUIRED TO   159          

PAY THE REGISTRAR ANY LAMINATION FEE.                              160          

      AN APPLICATION MADE UNDER DIVISION (H) OF THIS SECTION       162          

SHALL BE ACCOMPANIED BY SUCH DOCUMENTARY EVIDENCE OF DISABILITY    163          

AS THE REGISTRAR MAY REQUIRE BY RULE.                              164          

      Sec. 4507.24.  (A)  Each EXCEPT AS PROVIDED IN DIVISION (B)  173          

OF THIS SECTION, EACH deputy registrar may collect a fee not to    175          

exceed the following:                                                           

      (1)  Three dollars and twenty-five cents for each            177          

application for renewal of a driver's license received by him THE  178          

DEPUTY REGISTRAR, when the applicant is required to submit to a    179          

screening of his THE APPLICANT'S vision under section 4507.12 of   180          

the Revised Code;                                                  181          

      (2)  Two dollars and twenty-five cents for each application  183

for a driver's license, or motorized bicycle license, or for       184          

renewal of such a license, received by him THE DEPUTY REGISTRAR,   185          

when the applicant is not required to submit to a screening of     187          

his THE APPLICANT'S vision under section 4507.12 of the Revised    189          

Code.                                                                           

      (B)  The fees prescribed by division (A) of this section     191          

shall be in addition to the fee for a temporary instruction        192          

permit and examination, a driver's license, a motorized bicycle    193          

license, or duplicates thereof, and shall compensate the deputy    194          

registrar for his THE DEPUTY REGISTRAR'S services, for office and  196          

rental expense, and for costs as provided in division (C) of this  197          

section, as are necessary for the proper discharge of his THE      198          

DEPUTY REGISTRAR'S duties under sections 4507.01 to 4507.39 of     200          

the Revised Code.                                                               

      A DISABLED VETERAN WHO HAS A SERVICE-CONNECTED DISABILITY    203          

RATED AT ONE HUNDRED PER CENT BY THE VETERANS' ADMINISTRATION IS   204          

REQUIRED TO PAY THE APPLICABLE FEE PRESCRIBED IN DIVISION (A) OF   205          

THIS SECTION IF THE DISABLED VETERAN SUBMITS AN APPLICATION FOR A  207          

DRIVER'S LICENSE OR MOTORIZED BICYCLE LICENSE OR A RENEWAL OF      208          

EITHER OF THESE LICENSES TO A DEPUTY REGISTRAR WHO IS ACTING AS A  210          

DEPUTY REGISTRAR PURSUANT TO A CONTRACT WITH THE REGISTRAR THAT    211          

IS IN EFFECT ON THE EFFECTIVE DATE OF THIS AMENDMENT.  THE                      

DISABLED VETERAN ALSO IS REQUIRED TO SUBMIT WITH THE DISABLED      212          

VETERAN'S APPLICATION SUCH DOCUMENTARY EVIDENCE OF DISABILITY AS   215          

THE REGISTRAR MAY REQUIRE BY RULE.                                 216          

      A DISABLED VETERAN WHO SUBMITS AN APPLICATION DESCRIBED IN   218          

THIS DIVISION IS NOT REQUIRED TO PAY EITHER OF THE FEES            219          

PRESCRIBED IN DIVISION (A) OF THIS SECTION IF THE DISABLED         220          

VETERAN SUBMITS THE APPLICATION TO A DEPUTY REGISTRAR WHO IS       221          

ACTING AS A DEPUTY REGISTRAR PURSUANT TO A CONTRACT WITH THE       222          

REGISTRAR THAT IS EXECUTED AFTER THE EFFECTIVE DATE OF THIS        223          

AMENDMENT.  THE DISABLED VETERAN STILL IS REQUIRED TO SUBMIT WITH  224          

THE DISABLED VETERAN'S APPLICATION SUCH DOCUMENTARY EVIDENCE OF                 

DISABILITY AS THE REGISTRAR MAY REQUIRE BY RULE.                   225

      A DISABLED VETERAN WHO SUBMITS AN APPLICATION DESCRIBED IN   227          

THIS DIVISION DIRECTLY TO THE REGISTRAR IS NOT REQUIRED TO PAY     228          

EITHER OF THE FEES PRESCRIBED IN DIVISION (A) OF THIS SECTION IF   229          

THE DISABLED VETERAN SUBMITS WITH THE DISABLED VETERAN'S           230          

APPLICATION SUCH DOCUMENTARY EVIDENCE OF DISABILITY AS THE         231          

REGISTRAR MAY REQUIRE BY RULE.                                     232          

      (C)  Each deputy registrar shall transmit to the registrar   234          

of motor vehicles, at such time and in such manner as the          235          

registrar shall require by rule, an amount of each fee collected   236          

under division (A)(1) of this section as shall be determined by    237          

the registrar.  The registrar shall pay all SUCH moneys so         238          

received by him into the state bureau of motor vehicles fund       239          

created in section 4501.25 of the Revised Code.                    241          

      Section 2.  That existing sections 4507.23 and 4507.24 of    243          

the Revised Code are hereby repealed.                              244
