JOHNSON-WATTS-CARNES-NEIN-WHITE-BLESSING-DRAKE-DIX 15 17 A B I L L To amend sections 4507.23 and 4507.24 of the Revised 19 Code to exempt veterans who have a 20 service-connected disability rated at 100% by the 21 Veterans' Administration from payment of any 22 application or service fees when obtaining a 23 driver's license or motorized bicycle license, or 24 fee for laminating such a license. 25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 27 Section 1. That sections 4507.23 and 4507.24 of the 29 Revised Code be amended to read as follows: 30 Sec. 4507.23. (A)EachEXCEPT AS PROVIDED IN DIVISION (H) 38 OF THIS SECTION, EACH application for a temporary instruction 40 permit and examination shall be accompanied by a fee of four 41 dollars. (B)EachEXCEPT AS PROVIDED IN DIVISION (H) OF THIS 44 SECTION, EACH application for a driver's license made by a person 45 who previously held such a license and whose license has expired 46 not more than two years prior to the date of application, and who 47 is required under this chapter to give an actual demonstration of 48 2 the person's ability to drive, shall be accompanied by a fee of 50 three dollars in addition to any other fees. (C) Except as provided indivisionDIVISIONS (E) AND (H) 53 of this section, each application for a driver's license, or 54 motorcycle operator's endorsement, or renewal of a driver's 55 license shall be accompanied by a fee of six dollars.Each56 EXCEPT AS PROVIDED IN DIVISION (H) OF THIS SECTION, EACH 57 application for a duplicate driver's license shall be accompanied 58 by a fee of two dollars and fifty cents. The duplicate driver's 59 licenses issued under this section shall be distributed by the 60 deputy registrar in accordance with rules adopted by the 61 registrar of motor vehicles. 62 (D)EachEXCEPT AS PROVIDED IN DIVISION (H) OF THIS 64 SECTION, EACH application for a motorized bicycle license or 65 duplicate thereof shall be accompanied by a fee of two dollars 66 and fifty cents. 67 (E)EachEXCEPT AS PROVIDED IN DIVISION (H) OF THIS 69 SECTION, EACH application for a driver's license or renewal of a 71 driver's license that will be issued to a person who is less than 72 twenty-one years of age shall be accompanied by whichever of the 73 following fees is applicable: (1) If the person is sixteen years of age or older, but 75 less than seventeen years of age, a fee of seven dollars and 76 twenty-five cents; 77 (2) If the person is seventeen years of age or older, but 79 less than eighteen years of age, a fee of six dollars; 80 (3) If the person is eighteen years of age or older, but 82 less than nineteen years of age, a fee of four dollars and 83 seventy-five cents; 84 (4) If the person is nineteen years of age or older, but 86 less than twenty years of age, a fee of three dollars and fifty 87 cents; 88 (5) If the person is twenty years of age or older, but 90 less than twenty-one years of age, a fee of two dollars and 91 3 twenty-five cents. 92 (F) Neither the registrar nor any deputy registrar shall 94 charge a fee in excess of one dollar and fifty cents for 95 laminating a driver's license or motorized bicycle license as 96 required by sections 4507.13 and 4511.521 of the Revised Code. A 97 deputy registrar laminating a driver's license or motorized 98 bicycle license shall retain the entire amount of the fee charged 99 for lamination, less the actual cost to the registrar of the 100 laminating materials used for that lamination, as specified in 101 the contract executed by the bureau for the laminating materials 102 and laminating equipment. The deputy registrar shall forward the 103 amount of the cost of the laminating materials to the registrar 104 for deposit as provided in this section. 105 (G) At the time and in the manner provided by section 107 4503.10 of the Revised Code, the deputy registrar shall transmit 108 the fees collected under divisions (A), (B), (C), (D), and (E), 109 and those portions of the fees specified in and collected under 110 division (F) of this section to the registrar. The registrar 111 shall pay two dollars and fifty cents of each fee collected under 112 divisions (A), (B), (C), (D), and (E)(1) to (4) of this section, 114 and the entire fee collected under division (E)(5) of this 115 section, into the state highway safety fund established in 116 section 4501.06 of the Revised Code, and such fees shall be used 117 for the sole purpose of supporting driver licensing activities. The remaining fees collected by the registrar under this section 118 shall be paid into the state bureau of motor vehicles fund 119 established in section 4501.25 of the Revised Code. 120 (H) A DISABLED VETERAN WHO HAS A SERVICE-CONNECTED 123 DISABILITY RATED AT ONE HUNDRED PER CENT BY THE VETERANS' 124 ADMINISTRATION MAY APPLY TO THE REGISTRAR OR A DEPUTY REGISTRAR 125 FOR THE ISSUANCE TO THAT VETERAN, WITHOUT THE PAYMENT OF ANY FEE 126 PRESCRIBED IN THIS SECTION, OF ANY OF THE FOLLOWING ITEMS: 127 (1) A TEMPORARY INSTRUCTION PERMIT AND EXAMINATION; 129 (2) A NEW, RENEWAL, OR DUPLICATE DRIVER'S OR COMMERCIAL 132 4 DRIVER'S LICENSE; (3) A MOTORCYCLE OPERATOR'S ENDORSEMENT; 134 (4) A MOTORIZED BICYCLE LICENSE OR DUPLICATE THEREOF; 136 (5) LAMINATION OF A DRIVER'S LICENSE OR MOTORIZED BICYCLE 138 LICENSE AS PROVIDED IN DIVISION (F) OF THIS SECTION, IF THE 139 CIRCUMSTANCES SPECIFIED IN DIVISION (H)(5) OF THIS SECTION ARE 141 MET. IF THE DRIVER'S LICENSE OR MOTORIZED BICYCLE LICENSE OF A 143 DISABLED VETERAN DESCRIBED IN DIVISION (H) OF THIS SECTION IS 145 LAMINATED BY A DEPUTY REGISTRAR WHO IS ACTING AS A DEPUTY REGISTRAR PURSUANT TO A CONTRACT WITH THE REGISTRAR THAT IS IN 146 EFFECT ON THE EFFECTIVE DATE OF THIS AMENDMENT, THE DISABLED 147 VETERAN SHALL BE REQUIRED TO PAY THE DEPUTY REGISTRAR THE 148 LAMINATION FEE PROVIDED IN DIVISION (F) OF THIS SECTION. IF THE 149 DRIVER'S LICENSE OR MOTORIZED BICYCLE LICENSE OF SUCH A DISABLED 150 VETERAN IS LAMINATED BY A DEPUTY REGISTRAR WHO IS ACTING AS A 151 DEPUTY REGISTRAR PURSUANT TO A CONTRACT WITH THE REGISTRAR THAT 152 IS EXECUTED AFTER THE EFFECTIVE DATE OF THIS AMENDMENT, THE 154 DISABLED VETERAN IS NOT REQUIRED TO PAY THE DEPUTY REGISTRAR THE LAMINATION FEE PROVIDED IN DIVISION (F) OF THIS SECTION. 157 A DISABLED VETERAN WHOSE DRIVER'S LICENSE OR MOTORIZED 159 BICYCLE LICENSE IS LAMINATED BY THE REGISTRAR IS NOT REQUIRED TO 160 PAY THE REGISTRAR ANY LAMINATION FEE. 161 AN APPLICATION MADE UNDER DIVISION (H) OF THIS SECTION 163 SHALL BE ACCOMPANIED BY SUCH DOCUMENTARY EVIDENCE OF DISABILITY 164 AS THE REGISTRAR MAY REQUIRE BY RULE. 165 Sec. 4507.24. (A)EachEXCEPT AS PROVIDED IN DIVISION (B) 174 OF THIS SECTION, EACH deputy registrar may collect a fee not to 176 exceed the following: (1) Three dollars and twenty-five cents for each 178 application for renewal of a driver's license received byhimTHE 179 DEPUTY REGISTRAR, when the applicant is required to submit to a 180 screening ofhisTHE APPLICANT'S vision under section 4507.12 of 181 the Revised Code; 182 5 (2) Two dollars and twenty-five cents for each application 184 for a driver's license, or motorized bicycle license, or for 185 renewal of such a license, received byhimTHE DEPUTY REGISTRAR, 186 when the applicant is not required to submit to a screening of 188hisTHE APPLICANT'S vision under section 4507.12 of the Revised 190 Code. (B) The fees prescribed by division (A) of this section 192 shall be in addition to the fee for a temporary instruction 193 permit and examination, a driver's license, a motorized bicycle 194 license, or duplicates thereof, and shall compensate the deputy 195 registrar forhisTHE DEPUTY REGISTRAR'S services, for office and 197 rental expense, and for costs as provided in division (C) of this 198 section, as are necessary for the proper discharge ofhisTHE 199 DEPUTY REGISTRAR'S duties under sections 4507.01 to 4507.39 of 201 the Revised Code. A DISABLED VETERAN WHO HAS A SERVICE-CONNECTED DISABILITY 204 RATED AT ONE HUNDRED PER CENT BY THE VETERANS' ADMINISTRATION IS 205 REQUIRED TO PAY THE APPLICABLE FEE PRESCRIBED IN DIVISION (A) OF 206 THIS SECTION IF THE DISABLED VETERAN SUBMITS AN APPLICATION FOR A 208 DRIVER'S LICENSE OR MOTORIZED BICYCLE LICENSE OR A RENEWAL OF 209 EITHER OF THESE LICENSES TO A DEPUTY REGISTRAR WHO IS ACTING AS A 211 DEPUTY REGISTRAR PURSUANT TO A CONTRACT WITH THE REGISTRAR THAT 212 IS IN EFFECT ON THE EFFECTIVE DATE OF THIS AMENDMENT. THE DISABLED VETERAN ALSO IS REQUIRED TO SUBMIT WITH THE DISABLED 213 VETERAN'S APPLICATION SUCH DOCUMENTARY EVIDENCE OF DISABILITY AS 216 THE REGISTRAR MAY REQUIRE BY RULE. 217 A DISABLED VETERAN WHO SUBMITS AN APPLICATION DESCRIBED IN 219 THIS DIVISION IS NOT REQUIRED TO PAY EITHER OF THE FEES 220 PRESCRIBED IN DIVISION (A) OF THIS SECTION IF THE DISABLED 221 VETERAN SUBMITS THE APPLICATION TO A DEPUTY REGISTRAR WHO IS 222 ACTING AS A DEPUTY REGISTRAR PURSUANT TO A CONTRACT WITH THE 223 REGISTRAR THAT IS EXECUTED AFTER THE EFFECTIVE DATE OF THIS 224 AMENDMENT. THE DISABLED VETERAN STILL IS REQUIRED TO SUBMIT WITH 225 THE DISABLED VETERAN'S APPLICATION SUCH DOCUMENTARY EVIDENCE OF 6 DISABILITY AS THE REGISTRAR MAY REQUIRE BY RULE. 226 A DISABLED VETERAN WHO SUBMITS AN APPLICATION DESCRIBED IN 228 THIS DIVISION DIRECTLY TO THE REGISTRAR IS NOT REQUIRED TO PAY 229 EITHER OF THE FEES PRESCRIBED IN DIVISION (A) OF THIS SECTION IF 230 THE DISABLED VETERAN SUBMITS WITH THE DISABLED VETERAN'S 231 APPLICATION SUCH DOCUMENTARY EVIDENCE OF DISABILITY AS THE 232 REGISTRAR MAY REQUIRE BY RULE. 233 (C) Each deputy registrar shall transmit to the registrar 235 of motor vehicles, at such time and in such manner as the 236 registrar shall require by rule, an amount of each fee collected 237 under division (A)(1) of this section as shall be determined by 238 the registrar. The registrar shall pay all SUCH moneys so 239 receivedby himinto the state bureau of motor vehicles fund 240 created in section 4501.25 of the Revised Code. 242 Section 2. That existing sections 4507.23 and 4507.24 of 244 the Revised Code are hereby repealed. 245
