No. 144 5 1997-1998 6 REPRESENTATIVES METZGER-HARRIS-MALLORY-LUCAS-NETZLEY-MOTTLEY- 8 ROMAN-GRENDELL-BRITTON-CATES-TERWILLEGER-BENDER 9 _________________________________________________________________ 11 A B I L L To amend sections 4507.23 and 4507.24 of the Revised 13 Code to exempt veterans who have a 14 service-connected disability rated at 100% by the 15 Veterans' Administration from payment of any 16 application or service fees when obtaining a 17 driver's license or motorized bicycle license, or 18 fee for laminating such a license. 19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 21 Section 1. That sections 4507.23 and 4507.24 of the 23 Revised Code be amended to read as follows: 24 Sec. 4507.23. (A)EachEXCEPT AS PROVIDED IN DIVISION (H) 32 OF THIS SECTION, EACH application for a temporary instruction 34 permit and examination shall be accompanied by a fee of four 35 dollars. (B)EachEXCEPT AS PROVIDED IN DIVISION (H) OF THIS 37 SECTION, EACH application for a driver's license made by a person 39 who previously held such a license and whose license has expired 40 not more than two years prior to the date of application, and who 41 is required under this chapter to give an actual demonstration of 42 the person's ability to drive shall be accompanied by a fee of 44 three dollars in addition to any other fees. (C) Except as provided in division (E) AND (H) of this 46 section, each application for a driver's license, or motorcycle 47 operator's endorsement, or renewal of a driver's license shall be 48 accompanied by a fee of six dollars.EachEXCEPT AS PROVIDED IN 49 2 DIVISION (H) OF THIS SECTION, EACH application for a duplicate 51 driver's license shall be accompanied by a fee of two dollars and 52 fifty cents. The duplicate driver's licenses issued under this 53 section shall be distributed by the deputy registrar in 54 accordance with rules adopted by the registrar of motor vehicles. 55 (D)EachEXCEPT AS PROVIDED IN DIVISION (H) OF THIS 57 SECTION, EACH application for a motorized bicycle license or 58 duplicate thereof shall be accompanied by a fee of two dollars 59 and fifty cents. 60 (E)EachEXCEPT AS PROVIDED IN DIVISION (H) OF THIS 62 SECTION, EACH application for a driver's license or renewal of a 64 driver's license that will be issued to a person who is less than 65 twenty-one years of age shall be accompanied by whichever of the 66 following fees is applicable: (1) If the person is sixteen years of age or older, but 68 less than seventeen years of age, a fee of seven dollars and 69 twenty-five cents; 70 (2) If the person is seventeen years of age or older, but 72 less than eighteen years of age, a fee of six dollars; 73 (3) If the person is eighteen years of age or older, but 75 less than nineteen years of age, a fee of four dollars and 76 seventy-five cents; 77 (4) If the person is nineteen years of age or older, but 79 less than twenty years of age, a fee of three dollars and fifty 80 cents; 81 (5) If the person is twenty years of age or older, but 83 less than twenty-one years of age, a fee of two dollars and 84 twenty-five cents. 85 (F) Neither the registrar nor any deputy registrar shall 87 charge a fee in excess of one dollar and fifty cents for 88 laminating a driver's license or motorized bicycle license as 89 required by sections 4507.13 and 4511.521 of the Revised Code. A 90 deputy registrar laminating a driver's license or motorized 91 bicycle license shall retain the entire amount of the fee charged 92 3 for lamination, less the actual cost to the registrar of the 93 laminating materials used for that lamination, as specified in 94 the contract executed by the bureau for the laminating materials 95 and laminating equipment. The deputy registrar shall forward the 96 amount of the cost of the laminating materials to the registrar 97 for deposit as provided in this section. 98 (G) At the time and in the manner provided by section 100 4503.10 of the Revised Code, the deputy registrar shall transmit 101 the fees collected under divisions (A), (B), (C), (D), and (E), 102 and those portions of the fees specified in and collected under 103 division (F) of this section to the registrar. The registrar 104 shall pay two dollars and fifty cents of each fee collected under 105 divisions (A), (B), (C), (D), and (E)(1) to (4) of this section, 107 and the entire fee collected under division (E)(5) of this 108 section, into the state highway safety fund established in 109 section 4501.06 of the Revised Code, and such fees shall be used 110 for the sole purpose of supporting driver licensing activities. The remaining fees collected by the registrar under this section 111 shall be paid into the state bureau of motor vehicles fund 112 established in section 4501.25 of the Revised Code. 113 (H) A DISABLED VETERAN WHO HAS A SERVICE-CONNECTED 116 DISABILITY RATED AT ONE HUNDRED PER CENT BY THE VETERANS' 117 ADMINISTRATION MAY APPLY TO THE REGISTRAR OR A DEPUTY REGISTRAR 118 FOR THE ISSUANCE TO THAT VETERAN, WITHOUT THE PAYMENT OF ANY FEE 119 PRESCRIBED IN THIS SECTION, OF ANY OF THE FOLLOWING ITEMS: 120 (1) A TEMPORARY INSTRUCTION PERMIT AND EXAMINATION; 122 (2) A NEW, RENEWAL, OR DUPLICATE DRIVER'S OR COMMERCIAL 125 DRIVER'S LICENSE; (3) A MOTORCYCLE OPERATOR'S ENDORSEMENT; 127 (4) A MOTORIZED BICYCLE LICENSE OR DUPLICATE THEREOF; 129 (5) LAMINATION OF A DRIVER'S LICENSE OR MOTORIZED BICYCLE 131 LICENSE AS PROVIDED IN DIVISION (F) OF THIS SECTION. 132 AN APPLICATION MADE UNDER DIVISION (H) OF THIS SECTION 133 SHALL BE ACCOMPANIED BY SUCH DOCUMENTARY EVIDENCE OF DISABILITY 134 4 AS THE REGISTRAR MAY REQUIRE BY RULE. 135 Sec. 4507.24. (A)EachEXCEPT AS PROVIDED IN DIVISION (B) 144 OF THIS SECTION, EACH deputy registrar may collect a fee not to 146 exceed the following: (1) Three dollars and twenty-five cents for each 148 application for renewal of a driver's license received byhimTHE 149 DEPUTY REGISTRAR, when the applicant is required to submit to a 150 screening ofhisTHE APPLICANT'S vision under section 4507.12 of 151 the Revised Code; 152 (2) Two dollars and twenty-five cents for each application 154 for a driver's license, or motorized bicycle license, or for 155 renewal of such a license, received byhimTHE DEPUTY REGISTRAR, 156 when the applicant is not required to submit to a screening of 158hisTHE APPLICANT'S vision under section 4507.12 of the Revised 160 Code. (B) The fees prescribed by division (A) of this section 162 shall be in addition to the fee for a temporary instruction 163 permit and examination, a driver's license, a motorized bicycle 164 license, or duplicates thereof, and shall compensate the deputy 165 registrar forhisTHE DEPUTY REGISTRAR'S services, for office and 167 rental expense, and for costs as provided in division (C) of this 168 section, as are necessary for the proper discharge ofhisTHE 169 DEPUTY REGISTRAR'S duties under sections 4507.01 to 4507.39 of 171 the Revised Code. A DISABLED VETERAN WHO HAS A SERVICE-CONNECTED DISABILITY 174 RATED AT ONE HUNDRED PER CENT BY THE VETERANS' ADMINISTRATION 175 SHALL NOT BE REQUIRED TO PAY EITHER OF THE FEES PRESCRIBED IN 176 DIVISION (A) OF THIS SECTION IF THE DISABLED VETERAN SUBMITS WITH 177 THE DISABLED VETERAN'S APPLICATION FOR A DRIVER'S LICENSE OR 178 MOTORIZED BICYCLE LICENSE OR A RENEWAL OF EITHER OF THESE 179 LICENSES SUCH DOCUMENTARY EVIDENCE OF DISABILITY AS THE REGISTRAR 180 MAY REQUIRE BY RULE. 181 (C) Each deputy registrar shall transmit to the registrar 183 of motor vehicles, at such time and in such manner as the 184 5 registrar shall require by rule, an amount of each fee collected 185 under division (A)(1) of this section as shall be determined by 186 the registrar. The registrar shall pay all SUCH moneys so 187 receivedby himinto the state bureau of motor vehicles fund 188 created in section 4501.25 of the Revised Code. 190 Section 2. That existing sections 4507.23 and 4507.24 of 191 the Revised Code are hereby repealed. 192
