No. 192 5 1997-1998 6 REPRESENTATIVES CAREY-PRINGLE-VESPER-HAINES-PRENTISS-GARCIA-SAWYER- 8 HOTTINGER-PADGETT-LOGAN-BENDER-OLMAN-BOYD 9 11 A B I L L To enact section 3737.17 of the Revised Code to 13 create the Small Government Fire Department 14 Services Revolving Loan Program to help certain 15 municipal corporations and townships meet 16 specified fire fighting and emergency medical 17 needs and to make an appropriation. 18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 20 Section 1. That section 3737.17 of the Revised Code be 22 enacted to read as follows: 23 Sec. 3737.17. THE STATE FIRE MARSHAL SHALL ADMINISTER A 25 SMALL GOVERNMENT FIRE DEPARTMENT SERVICES REVOLVING LOAN PROGRAM 26 UNDER WHICH THE FIRE MARSHAL MAKES LOANS TO QUALIFYING TOWNSHIPS 27 AND MUNICIPAL CORPORATIONS FOR THE FOLLOWING PURPOSES: 28 (A) TO EXPEDITE PURCHASES OF MAJOR EQUIPMENT FOR FIRE 31 FIGHTING, AMBULANCE, EMERGENCY MEDICAL, OR RESCUE SERVICES; 32 (B) TO EXPEDITE PROJECTS FOR THE CONSTRUCTION OR 35 RENOVATION OF FIRE DEPARTMENT BUILDINGS. 36 A LOAN FOR EITHER PURPOSE UNDER THE SMALL GOVERNMENT FIRE 38 DEPARTMENT SERVICES REVOLVING LOAN PROGRAM IS NOT TO CARRY 39 INTEREST, AND IS TO BE REPAID WITHIN A TERM OF NOT LONGER THAN 40 TWENTY YEARS. A QUALIFYING TOWNSHIP OR MUNICIPAL CORPORATION IS 41 NOT ELIGIBLE TO RECEIVE A LOAN FOR A PROJECT OR PURCHASE UNDER 42 THE PROGRAM UNLESS THE QUALIFYING TOWNSHIP OR MUNICIPAL 43 CORPORATION CONTRIBUTES TO THE PROJECT OR PURCHASE AN AMOUNT 44 EQUAL TO AT LEAST FIVE PER CENT OF THE LOAN AMOUNT. 45 2 A TOWNSHIP QUALIFIES FOR A LOAN UNDER THE SMALL GOVERNMENT 47 FIRE DEPARTMENT SERVICES REVOLVING LOAN PROGRAM IF IT HAS A 48 POPULATION OF NOT MORE THAN FIVE THOUSAND OR, REGARDLESS OF ITS 49 POPULATION, IS LOCATED IN A COUNTY HAVING A POPULATION OF LESS 50 THAN ONE HUNDRED THOUSAND. A MUNICIPAL CORPORATION QUALIFIES FOR 52 A LOAN UNDER THE PROGRAM IF IT HAS A POPULATION OF NOT MORE THAN 53 SEVEN THOUSAND FIVE HUNDRED. A QUALIFYING TOWNSHIP OR MUNICIPAL CORPORATION MAY APPLY TO 56 THE FIRE MARSHAL FOR A LOAN UNDER THE SMALL GOVERNMENT FIRE DEPARTMENT SERVICES REVOLVING LOAN PROGRAM. IN ITS APPLICATION, 57 THE TOWNSHIP OR MUNICIPAL CORPORATION SHALL EXPLAIN HOW IT 58 QUALIFIES FOR THE LOAN, DESCRIBE THE PROJECT OR PURCHASE FOR 59 WHICH IT IS REQUESTING A LOAN, STATE THE AMOUNT OF THE LOAN IT 60 REQUESTS, AND STATE THE AMOUNT IT IS PREPARED TO CONTRIBUTE TO 61 THE PROJECT OR PURCHASE. THE QUALIFYING TOWNSHIP OR MUNICIPAL 62 CORPORATION SHALL PROVIDE ADDITIONAL INFORMATION TO SUPPORT ITS 63 APPLICATION FOR A LOAN UNDER THE PROGRAM AS REQUESTED BY THE FIRE 65 MARSHAL. THE FIRE MARSHAL, IN ACCORDANCE WITH CHAPTER 119. OF THE 69 REVISED CODE, SHALL ADOPT RULES FOR THE ADMINISTRATION OF THE 71 SMALL GOVERNMENT FIRE DEPARTMENT SERVICES REVOLVING LOAN PROGRAM. 72 Section 2. All items in this section are hereby 74 appropriated as designated out of moneys in the state treasury to 75 the credit of the General Revenue Fund. For all appropriations 76 made in this act, those in the first column are for fiscal year 77 1998 and those in the second column are for fiscal year 1999. 78 The appropriations made in this act are in addition to any other 79 appropriations made for the 1997-1999 biennium. 80 COM DEPARTMENT OF COMMERCE 82 General Revenue Fund 84 GRF 800-404 Small Government Fire 88 Departments - Equipment $ 2,500,000 $ 0 90 GRF 800-406 Small Government Fire 91 3 Departments - Construction $ 2,500,000 $ 0 92 TOTAL GRF General Revenue Fund $ 5,000,000 $ 0 95 TOTAL ALL BUDGET FUND GROUPS $ 5,000,000 $ 0 97 Small Government Fire Departments 100 The foregoing appropriation items 800-404, Small Government 102 Fire Departments - Equipment, and 800-406, Small Government Fire 103 Departments - Construction, are subject to the following 104 conditions: 105 (1) The foregoing appropriation item 800-404, Small 107 Government Fire Departments - Equipment, shall be disbursed 108 through the Department of Commerce, State Fire Marshal, to make 109 loans under the Small Government Fire Department Services 110 Revolving Loan Program as provided in division (A) of section 111 3737.17 of the Revised Code. 112 (2) The foregoing appropriation item 800-406, Small 114 Government Fire Departments - Construction, shall be disbursed 115 through the Department of Commerce, State Fire Marshal, to make 116 loans under the Small Government Fire Department Services 117 Revolving Loan Program as provided in division (B) of section 118 3737.17 of the Revised Code. 119 (3) The Director of Budget and Management, upon receiving 121 a request from the State Fire Marshal, may transfer from 122 appropriation item 800-404, Small Government Fire Departments - 123 Equipment, to appropriation item 800-406, Small Government Fire 124 Departments - Construction, funds not required to make loans 125 under division (A) of section 3737.17 of the Revised Code, and 126 may transfer from appropriation item 800-406, Small Government 127 Fire Departments - Construction, to appropriation item 800-404, 128 Small Government Fire Departments - Equipment, funds not required 130 to make loans under division (B) of section 3737.17 of the 131 Revised Code. (4) If appropriation item 800-406, Small Government Fire 133 Departments - Construction, is rejected at a referendum, an 134 4 additional $2,500,000 is hereby appropriated to appropriation 135 item 800-404, Small Government Fire Departments - Equipment. 136 Within the limits set forth in this act, the Director of 138 Budget and Management shall establish accounts indicating the 139 source and amount of funds for each appropriation made in this 140 act and shall determine the form and manner in which 141 appropriation accounts shall be maintained. Expenditures from 142 appropriations contained in this act shall be accounted for as 143 though made by the main operating appropriations act or main 144 capital appropriations act, as the case may be, of the 122nd 145 General Assembly. 146 The appropriations made in this act are subject to all 148 provisions of the main operating appropriations act or main 149 capital appropriations act, as the case may be, of the 122nd 150 General Assembly that are generally applicable to General Revenue 152 Fund appropriations. Section 3. (A) Division (B) of section 3737.17 of the 154 Revised Code and appropriation item 800-406, Small Government 155 Fire Departments - Construction, and paragraphs (2) and (3) in 156 Section 2 of this act constitute an item subject to the 157 referendum. Therefore, under Ohio Constitution, Article II, 158 Section 1c and section 1.471 of the Revised Code the item takes 159 effect on the ninety-first day after this act is filed with the 160 Secretary of State. If, however, a referendum petition is filed 161 against the item, the item, unless rejected at the referendum, 162 takes effect at the earliest time permitted by law. 163 (B) Section 3737.17 of the Revised Code, except for 165 division (B) of the section; Section 2 of this act, except for 166 appropriation item 800-406, Small Government Fire Departments - 167 Construction, and paragraphs (2) and (3); and this section 168 constitute an item not subject to the referendum. Therefore, 169 under Ohio Constitution, Article II, Section 1d and section 1.471 171 of the Revised Code, the item goes into immediate effect when 172 this act becomes law.
