                           A   B I L L                                          

             To amend sections 305.06, 305.09, and 315.11 of the   12           

                Revised Code to permit a board of county           13           

                commissioners to hold its regular sessions at a    14           

                location in the county other than at its office    15           

                in the county seat and to allow the board to       16           

                provide the county engineer with  an office at a   17           

                location outside the county seat.                  18           




BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:        20           

      Section 1.  That sections 305.06, 305.09, and 315.11 of the  22           

Revised Code be amended to read as follows:                        23           

      Sec. 305.06.  (A)  The board of county commissioners shall   32           

conduct at least fifty regular sessions each year, at the usual    34           

office of the board at the county seat OR AT ANOTHER LOCATION AS   35           

PROVIDED IN DIVISION (B) OF THIS SECTION.  Each of these sessions  36           

shall be conducted at a specific time fixed in advance.  At each   38           

meeting the board shall transact such business as required by      39           

law.                                                                            

      (B)  THE BOARD OF COUNTY COMMISSIONERS MAY PROVIDE BY        41           

RESOLUTION FOR THE HOLDING OF REGULAR SESSIONS OF THE BOARD AT A   42           

LOCATION IN THE COUNTY OTHER THAN THE USUAL OFFICE OF THE BOARD    43           

AT THE COUNTY SEAT.  THE ADOPTION OF THE RESOLUTION AND THE        44           

LOCATION WHERE THE SESSIONS WILL BE HELD SHALL BE ENTERED ON THE   45           

JOURNAL OF THE BOARD.  THE BOARD SHALL GIVE REASONABLE PUBLIC                   

NOTICE OF ITS ACTION TAKEN PURSUANT TO THIS DIVISION, IN           46           

ACCORDANCE WITH DIVISION (F) OF SECTION 121.22 OF THE REVISED      47           

CODE.

      Sec. 305.09.  All the proceedings of the board of county     56           

commissioners shall be public, at the usual office of the board    57           

at the county seat, or at another location, as provided in         58           

DIVISION (B) OF SECTION 305.06 OR division (B) of section 305.07   59           

of the Revised Code, and, as far as possible, shall be in          60           

conformity with the rules of parliamentary law.                    61           

      Sec. 315.11.  (A)  The county engineer shall keep his THE    70           

ENGINEER'S office at the county seat, OR AT ANOTHER LOCATION AS    72           

PROVIDED IN DIVISION (B) OF THIS SECTION, in such rooms as are     73           

provided by the board of county commissioners, and which shall be  75           

furnished with all necessary cases and other suitable articles at               

the expense of the county.  Such office shall also be furnished    76           

with all tools, instruments, books, blanks, and stationery         77           

necessary for the proper discharge of the official duties of such  78           

engineer.  The cost and expense of such equipment shall be         79           

allowed and paid from the general fund of the county upon the      80           

approval of the board.  The engineer and each assistant and                     

deputy of such engineer shall be allowed his reasonable and        81           

necessary expenses, incurred in the performance of his official    83           

duties.                                                                         

      (B)  THE BOARD OF COUNTY COMMISSIONERS MAY PROVIDE BY        85           

RESOLUTION FOR ESTABLISHMENT OF THE PRIMARY OFFICE OF THE COUNTY   86           

ENGINEER AT A LOCATION OUTSIDE THE COUNTY SEAT.  THE ADOPTION OF   87           

THE RESOLUTION AND THE LOCATION OF THE ENGINEER'S PRIMARY OFFICE   88           

SHALL BE ENTERED ON THE JOURNAL OF THE BOARD.  THE BOARD SHALL     89           

GIVE REASONABLE PUBLIC NOTICE OF ITS ACTION TAKEN PURSUANT TO                   

THIS DIVISION.                                                     90           

      Section 2.  That existing sections 305.06, 305.09, and       92           

315.11 of the Revised Code are hereby repealed.                    93
