No. 419 5 1997-1998 6 REPRESENTATIVES HOUSEHOLDER-TERWILLEGER-GARCIA-CAREY-OPFER- 8 SULZER-O'BRIEN 9 11 A B I L L To amend sections 305.06, 305.09, and 315.11 of the 13 Revised Code to permit a board of county 14 commissioners to hold any of its regular sessions 15 at a location in the county other than at its 16 office in the county seat and to allow the board 17 to provide the county engineer with an office at 19 a location outside the county seat. 20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 22 Section 1. That sections 305.06, 305.09, and 315.11 of the 24 Revised Code be amended to read as follows: 25 Sec. 305.06. (A) The board of county commissioners shall 34 conduct at least fifty regular sessions each year, at the usual 36 office of the board at the county seat OR AT ANOTHER LOCATION AS 37 PROVIDED IN DIVISION (B) OF THIS SECTION. Each of these sessions 38 shall be conducted at a specific time fixed in advance. At each 40 meeting the board shall transact such business as required by 41 law. (B) THE BOARD OF COUNTY COMMISSIONERS MAY PROVIDE BY 43 RESOLUTION FOR THE HOLDING OF ANY REGULAR SESSION OF THE BOARD AT 44 A LOCATION IN THE COUNTY OTHER THAN THE USUAL OFFICE OF THE BOARD 46 AT THE COUNTY SEAT. THE ADOPTION OF THE RESOLUTION AND THE 47 LOCATION WHERE THE SESSION WILL BE HELD SHALL BE ENTERED ON THE 48 JOURNAL OF THE BOARD. THE BOARD SHALL GIVE REASONABLE PUBLIC NOTICE OF ITS ACTION TAKEN PURSUANT TO THIS DIVISION, IN 49 ACCORDANCE WITH DIVISION (F) OF SECTION 121.22 OF THE REVISED 50 2 CODE. Sec. 305.09. All the proceedings of the board of county 59 commissioners shall be public, at the usual office of the board 60 at the county seat, or at another location, as provided in 61 DIVISION (B) OF SECTION 305.06 OR division (B) of section 305.07 62 of the Revised Code, and, as far as possible, shall be in 63 conformity with the rules of parliamentary law. 64 Sec. 315.11. (A) The county engineer shall keephisTHE 73 ENGINEER'S office at the county seat, OR AT ANOTHER LOCATION AS 75 PROVIDED IN DIVISION (B) OF THIS SECTION, in such rooms as are 76 provided by the board of county commissioners, and which shall be 78 furnished with all necessary cases and other suitable articles at the expense of the county. Such office shall also be furnished 79 with all tools, instruments, books, blanks, and stationery 80 necessary for the proper discharge of the official duties of such 81 engineer. The cost and expense of such equipment shall be 82 allowed and paid from the general fund of the county upon the 83 approval of the board. The engineer and each assistant and deputy of such engineer shall be allowedhisreasonable and 84 necessary expenses, incurred in the performance ofhisofficial 86 duties. (B) WITH THE CONSENT OF THE COUNTY ENGINEER, THE BOARD OF 88 COUNTY COMMISSIONERS MAY PROVIDE BY RESOLUTION FOR ESTABLISHMENT 90 OF THE PRIMARY OFFICE OF THE COUNTY ENGINEER AT A LOCATION OUTSIDE THE COUNTY SEAT. THE ADOPTION OF THE RESOLUTION AND THE 91 LOCATION OF THE ENGINEER'S PRIMARY OFFICE SHALL BE ENTERED ON THE 92 JOURNAL OF THE BOARD. THE BOARD SHALL GIVE REASONABLE PUBLIC 93 NOTICE OF ITS ACTION TAKEN PURSUANT TO THIS DIVISION. 94 Section 2. That existing sections 305.06, 305.09, and 96 315.11 of the Revised Code are hereby repealed. 97
