No. 419 5 1997-1998 6 REPRESENTATIVES HOUSEHOLDER-TERWILLEGER-GARCIA-CAREY-OPFER- 8 SULZER-O'BRIEN-OGG-PADGETT-LEWIS-THOMPSON-BRADING-GRENDELL- 9 REID-HODGES-GARDNER-VESPER-SCHULER-MEAD-BUCHY-CATES-HARRIS- 10 METZGER-MOTTLEY-TIBERI-CALLENDER-BRITTON-WILSON- 11 TAVARES-PATTON-JOHNSON-BRADY-ROMAN 12 14 A B I L L To amend sections 305.06, 305.09, and 315.11 of the 16 Revised Code to permit a board of county 17 commissioners to hold any of its regular sessions 18 at a location in the county other than at its 19 office in the county seat and to allow the board 20 to provide the county engineer with an office at 22 a location outside the county seat. 23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 25 Section 1. That sections 305.06, 305.09, and 315.11 of the 27 Revised Code be amended to read as follows: 28 Sec. 305.06. (A) The board of county commissioners shall 37 conduct at least fifty regular sessions each year, at the usual 39 office of the board at the county seat OR AT ANOTHER LOCATION AS 40 PROVIDED IN DIVISION (B) OF THIS SECTION. Each of these sessions 41 shall be conducted at a specific time fixed in advance. At each 43 meeting the board shall transact such business as required by 44 law. (B) THE BOARD OF COUNTY COMMISSIONERS MAY PROVIDE BY 46 RESOLUTION FOR THE HOLDING OF ANY REGULAR SESSION OF THE BOARD AT 47 A LOCATION IN THE COUNTY OTHER THAN THE USUAL OFFICE OF THE BOARD 49 AT THE COUNTY SEAT. THE ADOPTION OF THE RESOLUTION AND THE 50 LOCATION WHERE THE SESSION WILL BE HELD SHALL BE ENTERED ON THE 51 2 JOURNAL OF THE BOARD. THE BOARD SHALL GIVE REASONABLE PUBLIC NOTICE OF ITS ACTION TAKEN PURSUANT TO THIS DIVISION, IN 52 ACCORDANCE WITH DIVISION (F) OF SECTION 121.22 OF THE REVISED 53 CODE. Sec. 305.09. All the proceedings of the board of county 62 commissioners shall be public, at the usual office of the board 63 at the county seat, or at another location, as provided in 64 DIVISION (B) OF SECTION 305.06 OR division (B) of section 305.07 65 of the Revised Code, and, as far as possible, shall be in 66 conformity with the rules of parliamentary law. 67 Sec. 315.11. (A) The county engineer shall keephisTHE 76 ENGINEER'S office at the county seat, OR AT ANOTHER LOCATION AS 78 PROVIDED IN DIVISION (B) OF THIS SECTION, in such rooms as are 79 provided by the board of county commissioners, and which shall be 81 furnished with all necessary cases and other suitable articles at the expense of the county. Such office shall also be furnished 82 with all tools, instruments, books, blanks, and stationery 83 necessary for the proper discharge of the official duties of such 84 engineer. The cost and expense of such equipment shall be 85 allowed and paid from the general fund of the county upon the 86 approval of the board. The engineer and each assistant and deputy of such engineer shall be allowedhisreasonable and 87 necessary expenses, incurred in the performance ofhisofficial 89 duties. (B) WITH THE CONSENT OF THE COUNTY ENGINEER, THE BOARD OF 91 COUNTY COMMISSIONERS MAY PROVIDE BY RESOLUTION FOR ESTABLISHMENT 93 OF THE PRIMARY OFFICE OF THE COUNTY ENGINEER AT A LOCATION OUTSIDE THE COUNTY SEAT. THE ADOPTION OF THE RESOLUTION AND THE 94 LOCATION OF THE ENGINEER'S PRIMARY OFFICE SHALL BE ENTERED ON THE 95 JOURNAL OF THE BOARD. THE BOARD SHALL GIVE REASONABLE PUBLIC 96 NOTICE OF ITS ACTION TAKEN PURSUANT TO THIS DIVISION. 97 Section 2. That existing sections 305.06, 305.09, and 99 315.11 of the Revised Code are hereby repealed. 100
