To amend section 1925.08 of the Revised Code to 14
permit state universities to file more than 15
twenty-four claims in the small claims division 16
of any municipal or county court within any 17
calendar year. 18
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 20
Section 1. That section 1925.08 of the Revised Code be 22
amended to read as follows: 23
Sec. 1925.08. (A) Except as provided in division (B) of 32
this section, not more than twenty-four claims may be filed in 33
the small claims division of any municipal or county court by a 34
single person within any calendar year. 35
(B) Division (A) of this section does not apply to any of 38
the following:
(1) Any authorized employee of a political subdivision or 40
any authorized officer or employee of the state who files actions 41
in the small claims division of any municipal or county court to 42
recover taxes; 43
(2) A county department of human services.; 45
(3) A supplier, consumer, or other person who files 47
actions in the Small Claims Division of a municipal or county 48
court to secure payment for a dishonored check; 49
(4) A STATE UNIVERSITY. 51
(C) As used in this section: 53

(1) "Person" has the same meaning as in division (C) of 55
section 1.59 of the Revised Code and includes governmental 56
entities. 57
(2) "Political subdivision" and "employee" of a political 59
subdivision have the same meanings as in section 2744.01 of the 60
Revised Code. 61
(3) "State" has the same meaning as in section 109.36 of 63
the Revised Code. 64
(4) "Officer or employee of the state" means any person 66
who is serving in an elected or appointed office or position with 67
the state or is employed by the state. "Officer or employee of 68
the state" does not include any person elected, appointed, or 69
employed by any political subdivision. 70
(5) "Consumer," "consumer transaction," and "supplier" 72
have the same meanings as in section 1345.01 of the Revised Code. 73
(6) "STATE UNIVERSITY" HAS THE SAME MEANING AS IN SECTION 75
3345.011 OF THE REVISED CODE. 76
Section 2. That existing section 1925.08 of the Revised 78
Code is hereby repealed. 79
Section 3. Section 1925.08 of the Revised Code is amended 81
by this act and also by Am. Sub. H.B. 438 of the 121st General 82
Assembly, effective July 1, 1997. The amendments of Am. Sub. 83
H.B. 438 are included in this act to confirm the intention to 84
retain them, but are not intended to be effective until July 1,
1997. 85
