To amend section 1925.08 of the Revised Code to 15
permit institutions of higher education to file 16
more than twenty-four claims in the small claims 17
division of any municipal or county court within 18
any calendar year. 19
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 21
Section 1. That section 1925.08 of the Revised Code be 23
amended to read as follows: 24
Sec. 1925.08. (A) Except as provided in division (B) of 33
this section, not more than twenty-four claims may be filed in 34
the small claims division of any municipal or county court by a 35
single person within any calendar year. 36
(B) Division (A) of this section does not apply to any of 39
the following:
(1) Any authorized employee of a political subdivision or 41
any authorized officer or employee of the state who files actions 42
in the small claims division of any municipal or county court to 43
recover taxes; 44
(2) A county department of human services.; 46
(3) A supplier, consumer, or other person who files 48
actions in the Small Claims Division SMALL CLAIMS DIVISION of a 49
municipal or county court to secure payment for a dishonored 50
check;

(4) AN INSTITUTION OF HIGHER EDUCATION. 52
(C) As used in this section: 54
(1) "Person" has the same meaning as in division (C) of 56
section 1.59 of the Revised Code and ALSO includes governmental 57
entities. 58
(2) "Political subdivision" and "employee" of a political 60
subdivision have the same meanings as in section 2744.01 of the 61
Revised Code. 62
(3) "State" has the same meaning as in section 109.36 of 64
the Revised Code. 65
(4) "Officer or employee of the state" means any person 67
who is serving in an elected or appointed office or position with 68
the state or is employed by the state. "Officer or employee of 69
the state" does not include any person elected, appointed, or 70
employed by any political subdivision. 71
(5) "Consumer," "consumer transaction," and "supplier" 73
have the same meanings as in section 1345.01 of the Revised Code. 74
(6) "INSTITUTION OF HIGHER EDUCATION" MEANS ANY OF THE 76
FOLLOWING:
(a) A STATE UNIVERSITY AS DEFINED IN SECTION 3345.011 OF 78
THE REVISED CODE, INCLUDING, BUT NOT LIMITED TO, THE STATE 79
UNIVERSITIES LISTED IN THAT SECTION; 80
(b) THE MEDICAL COLLEGE OF OHIO AT TOLEDO; 82
(c) THE NORTHEASTERN OHIO UNIVERSITIES COLLEGE OF 84
MEDICINE; 85
(d) MUNICIPAL UNIVERSITIES, COLLEGES, OR OTHER EDUCATIONAL 87
INSTITUTIONS, COMMUNITY COLLEGES, UNIVERSITY BRANCHES, TECHNICAL 88
COLLEGES, AND STATE COMMUNITY COLLEGES ESTABLISHED OR OPERATING 89
PURSUANT TO CHAPTER 3349., 3354., 3355., 3357., OR 3358. OF THE 90
REVISED CODE;
(e) ANY INSTITUTION OF HIGHER EDUCATION WITH A CERTIFICATE 92
OF REGISTRATION FROM THE STATE BOARD OF PROPRIETARY SCHOOL 93
REGISTRATION.
Section 2. That existing section 1925.08 of the Revised 95

Code is hereby repealed. 96
