To amend section 5512.07 and to enact section 12
5533.38 of the Revised Code to increase by two 13
the membership of the Transportation Review 14
Advisory Council and to designate State Route 125 16
within Clermont County the "Edward J. Parish 17
Highway." 18
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 20
Section 1. That section 5512.07 be amended and section 22
5533.38 of the Revised Code be enacted to read as follows: 24
Sec. 5512.07. (A) There is hereby created the 33
transportation review advisory council. No member of the general 34
assembly shall be a member of the council. The council shall 35
consist of seven NINE members, one of whom is the director of 36
transportation. Four SIX members shall be appointed by the 37
governor with the advice and consent of the senate. One member 39
shall be appointed by the speaker of the house of representatives
and one member shall be appointed by the president of the senate. 41
In making their appointments, the governor, the speaker of the 42
house of representatives, and the president of the senate shall 43
consult with each other so that of the total number of six EIGHT 44
appointed members, at least two are affiliated with the major 45
political party not represented by the governor. IN MAKING THE 46
GOVERNOR'S APPOINTMENTS, THE GOVERNOR SHALL APPOINT PERSONS WHO 47
RESIDE IN DIFFERENT GEOGRAPHIC AREAS OF THE STATE. Within ninety 48
days after the effective date of this section JUNE 30, 1997, the 49

governor, speaker, and president shall make the initial 51
appointments to the council.
Appointed members shall have no conflict of interest with 53
the position and shall be capable of performing the duties of the 54
council with impartiality. For purposes of this section, 55
conflicts of interest may include, but are not limited to, 56
employment by or on behalf of, affiliation with, or public
advocacy of a new highway capacity project under consideration 57
for possible approval by the council. 58
The EACH OF THE members the governor appoints shall have 60
the following qualifications: 61
(1) Two members shall have at least five years' experience 63
in an executive or decision-making role EITHER in the AREA OF 64
transportation sector. 65
(2) One member shall have at least five years' experience 67
in a leadership and fiduciary role with either a OR IN THAT OF 68
business or an economic development organization. 69
(3) One SUCH member shall be selected from a list of five 71
names provided by the Ohio public expenditure council. 72
(B) Of the governor's initial appointments made to the 75
council, one shall be for a term ending one year after the 76
effective date of this section JUNE 30, 1997, one shall be for a 77
term ending two years after the effective date of this section 78
JUNE 30, 1997, one shall be for a term ending four years after 80
the effective date of this section JUNE 30, 1997, and one shall 81
be for a term ending five years after the effective date of this 82
section JUNE 30, 1997. WITHIN NINETY DAYS AFTER THE EFFECTIVE 84
DATE OF THIS AMENDMENT, THE GOVERNOR SHALL MAKE TWO APPOINTMENTS 85
TO THE COUNCIL. OF THESE APPOINTMENTS, ONE SHALL BE FOR A TERM 86
ENDING JUNE 30, 2001, AND ONE SHALL BE FOR A TERM ENDING JUNE 30, 87
2002. The speaker's and president's initial appointments made to 88
the council shall be for a term ending three years after the 89
effective date of this section JUNE 30, 1997. Thereafter, all 90
terms of office, INCLUDING THE TERMS FOR THOSE PERSONS WHO ARE 91

APPOINTED TO SUCCEED THE PERSONS WHOSE APPOINTMENTS ARE MADE 92
WITHIN NINETY DAYS AFTER THE EFFECTIVE DATE OF THIS AMENDMENT, 93
shall be for five years, with each term ending on the same day of 94
the same month as did the term that it succeeds. Each member 95
shall hold office from the date of appointment until the end of 96
the term for which the member was appointed. Members may be 97
reappointed. Vacancies shall be filled in the manner provided 98
for original appointments. Any member appointed to fill another 99
member's unexpired term shall hold office for the remainder of
that unexpired term. A member shall continue in office 100
subsequent to the expiration of the member's term until the 102
member's successor takes office.
(C) The director of transportation is the chairperson of 105
the council.
Sec. 5533.38. THE ROAD KNOWN AS STATE ROUTE NUMBER ONE 108
HUNDRED TWENTY-FIVE, RUNNING IN AN EASTERLY AND WESTERLY 109
DIRECTION THROUGH CLERMONT COUNTY ONLY, SHALL BE KNOWN AS THE 110
"EDWARD J. PARISH HIGHWAY." 111
THE DIRECTOR OF TRANSPORTATION MAY ERECT SUITABLE MARKERS 113
ALONG THE HIGHWAY INDICATING ITS NAME. 114
Section 2. That existing section 5512.07 of the Revised 116
Code is hereby repealed. 117
