No. 110 5 1997-1998 6 SENATORS BLESSING-GARDNER-LATTA-FINAN-WHITE- 8 REPRESENTATIVES LUEBBERS-TERWILLEGER-GARCIA-KRUPINSKI-SCHULER 9 11 A B I L L To enact sections 124.12, 325.25, and 505.05 of the 13 Revised Code to limit the range of salaries paid 14 to classified county employees who perform the 15 same duties and to authorize a county agency, 17 common pleas court, county court, or 18 county-operated municipal court, or a township 20 office or department, to recognize outstanding 21 employee performance. 22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 24 Section 1. That sections 124.12, 325.25, and 505.05 of the 26 Revised Code be enacted to read as follows: 28 Sec. 124.12. NO EMPLOYEE IN THE CLASSIFIED CIVIL SERVICE 30 OF A COUNTY SHALL RECEIVE A SALARY IN AN AMOUNT GREATER THAN ONE 31 HUNDERD TWENTY PER CENT OF THE AVERAGE SALARY OF ALL EMPLOYEES OF 32 THAT COUNTY WHO PERFORM THE SAME DUTIES. THE APPOINTING 33 AUTHORITY SHALL DETERMINE WHICH COUNTY EMPLOYEES PERFORM THE SAME 34 DUTIES. Sec. 325.25. UPON NOTIFYING THE BOARD OF COUNTY 36 COMMISSIONERS, ANY APPOINTING AUTHORITY OF A COUNTY OFFICE, 37 DEPARTMENT, COMMISSION, BOARD, OR BODY, OR OF A COMMON PLEAS 38 COURT, COUNTY COURT, OR COUNTY-OPERATED MUNICIPAL COURT AS 39 DEFINED IN SECTION 1901.03 OF THE REVISED CODE, MAY ESTABLISH A 40 PROGRAM TO RECOGNIZE OUTSTANDING EMPLOYEE PERFORMANCE. THE 41 PROGRAM MAY INCLUDE, BUT IS NOT LIMITED TO, CASH AWARDS, 42 ADDITIONAL PAID LEAVE, OR OTHER ADDITIONAL BENEFITS AS THE 43 2 APPOINTING AUTHORITY CONSIDERS APPROPRIATE, SO LONG AS THE COSTS 44 OF THE PROGRAM DO NOT EXCEED THE TOTAL AMOUNT OF COMPENSATION 45 FIXED BY THE BOARD OF COUNTY COMMISSIONERS FOR THE OFFICE, 46 DEPARTMENT, COMMISSION, BOARD, OR BODY OR FOR THE COMMON PLEAS 47 COURT, COUNTY COURT, OR COUNTY-OPERATED MUNICIPAL COURT. 48 Sec. 505.05. UPON NOTIFYING THE BOARD OF TOWNSHIP 50 TRUSTEES, ANY APPOINTING AUTHORITY OF A TOWNSHIP OFFICE OR 51 DEPARTMENT MAY ESTABLISH A PROGRAM TO RECOGNIZE OUTSTANDING 52 EMPLOYEE PERFORMANCE. THE PROGRAM MAY INCLUDE, BUT IS NOT 53 LIMITED TO, CASH AWARDS, ADDITIONAL PAID LEAVE, OR OTHER ADDITIONAL BENEFITS AS THE APPOINTING AUTHORITY CONSIDERS 54 APPROPRIATE, SO LONG AS THE COSTS OF THE PROGRAM DO NOT EXCEED 55 THE TOTAL AMOUNT OF COMPENSATION FIXED BY THE BOARD OF TOWNSHIP 56 TRUSTEES FOR THE OFFICE OR DEPARTMENT.
