             To authorize the conveyance of state-owned real       11           

                estate in Stark County to Leonard Cooper.          12           




BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:        14           

      Section 1.  The Governor is hereby authorized to execute a   16           

deed in the name of the state conveying to Leonard Cooper, and     17           

his successors and assigns, all of the state's right, title, and   18           

interest in the following described real estate, together with     19           

any buildings, structures, and other improvements located on the   20           

real estate:                                                                    

      Parcel #1                                                    22           

      Known as and being Lot Number Six Thousand Fifty-three       24           

(#6,053) in the City of Canton, Stark County, Ohio, as the same    25           

appears upon the corrected schedule of the renumbering of lots in  26           

said City.                                                         27           

      Parcel #2                                                    29           

      Situate in the City of Canton, County of Stark, and State    31           

of Ohio:  Known as and being part of Lot No. Six Thousand          32           

Forty-eight (#6,048) in the City of Canton, Stark County, Ohio,    33           

described as follows:  Beginning at the Northeast corner of said   34           

lot and running thence southwardly with the East line of said lot  35           

and being also the west line of a 20 foot alley sixty-nine (69)    36           

feet to the corner of a part of said lot heretofore conveyed to    37           

Sarah Bucher; thence westwardly in a straight line to a point in   38           

the East line of Cleveland Avenue 35 feet northwardly from the     39           

southwest corner of said lot #6,048; thence Northwardly with the   40           

East line of Cleveland Avenue 40 feet to the Northwest corner of   41

said lot and thence Northeastwardly to the Northeast corner of     42           

said lot and place of beginning, together with and subject to a    43           

driveway eight (8) feet in width, one-half of which is upon the    44           

above described part of said lot, and the other half upon the      45           

part of said lot adjoining the above described part of the south   46           

said driveway beginning at the east line of said lot and running   47           

westwardly with the south line of the part of said lot above       48           

described 151.5 feet and which said driveway shall be maintained   49           

for the joint use of the owner of the above described part of      50           

said lot and the owner of the part adjoining the same as           51           

aforesaid and their heirs and assigns forever; the grantee to      52           

succeed to and assume all the rights and obligations concerning    53           

said conveyance to Sarah M. Bucher recorded in Volume 377, page    54           

352 of the Deed Records of said County.                            55           

      Parcel #3                                                    57           

      Situate in the City of Canton, County of Stark, and State    59           

of Ohio and known as and being part of Lot No. 6,048 in said       60           

City.                                                                           

      Beginning at the Southwest corner of said Lot on North       62           

Cleveland Avenue and facing 11th Street, N.W., and running thence  63           

East with the South line of said Lot to the Southeast corner       64           

thereof; thence Northerly with the East line of said Lot 87 feet;  65           

thence Westerly in a straight line to a point in the West line of  66           

said Lot 35 feet North of the Southwest corner thereof, and        67           

thence Southerly with said West line 35 feet to the place of       68           

beginning together with all improvements situate thereon;          69           

together with and subject to a driveway eight feet in width,       70           

one-half of which is upon the above described part of said Lot,    71           

and the other half upon the part of said Lot on the North side of  72           

the above described part; said driveway beginning at the North     73           

East corner of the above described part of said Lot and running    74           

thence Westerly with the North line thereof 151 5/10 feet, the     75           

West 64 feet of which may be constructed of crushed stone or       76           

paved with brick, each of the owners thereof to bear one-half of   77

the expenses thereof, and which driveway 151 5/10 feet in length   78           

shall be maintained for the joint use of the owners thereof        79           

respectively of the parts of said lot abutting thereon and their   80           

heirs and assigns forever.                                         81           

      Excepting therefrom the following described real estate,     83           

to-wit:                                                            84           

      Situate in the City of Canton, County of Stark, and State    86           

of Ohio, and known as and being part of Lot No. 6,048 in said      87           

City, described as follows:                                        88           

      Beginning at the Southeast corner of said Lot; thence        90           

Northwardly along the East line of said lot a distance of 15 feet  91           

to an iron stake; thence Westwardly parallel to the South line of  92           

said Lot a distance of 49.80 feet more or less to an iron stake    93           

at the point of intersection of this course with the West line of  94           

property of Irvin D. and Hazel P. Streb (part Lot No. 1,547)       95           

extended Northwardly; thence Southwardly a distance of 13.91 feet  96           

more or less to an iron stake at the Northwest corner of said      97           

Streb property; thence Eastwardly along the South line of Lot No.  98           

6,048 a distance of 55.4 feet more or less to the place of         99           

beginning and containing 731 square feet of land, more or less.    100          

      The aforedescribed parcels being the same lands as           102          

described in Deeds to the State of Ohio, of Record in Deed Volume  103          

2757, Pages 193 and 195, Recorder's Office, Stark County, Ohio.    104          

      Section 2.  Consideration for the conveyance of the real     106          

estate described in Section 1 of this act is a purchase price of   107          

two hundred thousand dollars and no cents ($200,000).              108          

      Section 3.  The proceeds of the conveyance of the real       110          

estate described in Section 1 of this act shall be deposited into  112          

the Building Consolidation Fund, which is hereby created in the    113          

state treasury.  At the request of the Administrator of the Ohio   115          

Bureau of Employment Services, the Treasurer of State shall        116          

transfer funds from the Building Consolidation Fund to the OBES    118          

Building Enhancement Fund, which is hereby created in the state                 

treasury.  The proceeds of the conveyance, less any amount         120

deducted pursuant to this section for the costs of the sale,       121          

shall be used to enhance other facilities owned by the Ohio        122          

Bureau of Employment Services in which the United States                        

Department of Labor has full equity.  If any amount of the         124          

proceeds cannot be used for this purpose, the Administrator shall  125          

return that usable portion of the proceeds, less any amount        126          

deducted pursuant to this section for the costs of the sale, to    127          

the United States Department of Labor.  An amount may be deducted  128          

from the proceeds to cover the costs of the sale.  The amount of   129          

the proceeds that is deducted for that purpose shall be credited   130          

to the Unemployment Compensation Special Administrative Fund       132          

created under section 4141.11 of the Revised Code.                 133          

      Section 4.  Upon payment of the purchase price by Leonard    135          

Cooper, the Auditor of State, with the assistance of the Attorney  137          

General, shall prepare a deed to the real estate described in      138          

Section 1 of this act.  The deed shall state the consideration.    140          

The deed shall be executed by the Governor in the name of the                   

state, countersigned by the Secretary of State, sealed with the    141          

Great Seal of the State, presented in the Office of the Auditor    142          

of State for recording, and delivered to Leonard Cooper.  Leonard  143          

Cooper shall present the deed for recording in the Office of the   144          

Stark County Recorder.                                                          

      Section 5.  Leonard Cooper shall pay the costs of the        146          

conveyance.                                                                     

      Section 6.  This act shall expire one year after its         149          

effective date.
