No. 7 5 1997-1998 6 SENATOR KEARNS 8 10 A B I L L To authorize the conveyance of state-owned land in 11 Greene County known as the Ohio Veterans' 12 Children's Home to Greene County and to repeal Section 139 of Am. Sub. H.B. 117 of the 121st 13 General Assembly, which created Fund 4Z0, the 14 Veterans' Plaza Fund, and provided that $1,000,000 of the proceeds of the sale of the 15 Ohio Veterans' Children's Home be deposited into that fund. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 17 Section 1. (A) The Governor is hereby authorized to 19 execute a deed in the name of the state conveying to Greene 20 County and its successors and assigns all of the state's right, 21 title, and interest in property located in Greene County, 22 consisting of approximately 368 acres and facilities thereon, known as the Ohio Veterans' Children's Home. The Director of 23 Administrative Services shall prepare a legal description of this 24 real estate. The Superintendent of the Home shall review the 25 legal description for its accuracy. When the Superintendent is 26 satisfied as to the accuracy, the Director shall deliver the legal description to the Auditor of State for preparation of the 27 deed. (B) The conveyance shall be subject to any lease that the 29 Director of Administrative Services may negotiate with the 30 Association of Ex-Pupils of the Ohio Veterans' Children's Home, 31 pursuant to division (E) of Section 166 of Am. Sub. H.B. 117 of 32 2 the 121st General Assembly. (C) The consideration for the conveyance of the real 34 estate described in division (A) of this section is the mutual 35 benefit accruing to the state and to Greene County by having a 36 single entity public property owner that would develop programs 37 to provide youth services on a portion of the property, manage 38 the development of the property, cooperate with social service agencies in identifying uses and developing a comprehensive 39 approach to serving the citizens of the county and the state, and 40 work with the Association of Ex-Pupils of the Ohio Veterans' 41 Children's Home to protect and expand its interests related to 42 certain facilities on the grounds. (D) Within one year after the effective date of this 44 section, the Auditor of State, with the assistance of the 45 Attorney General, shall prepare a deed to the real estate 46 described under division (A) of this section. The deed shall state the consideration and shall state that the conveyance is 47 subject to a lease of properties as specified in division (E) of 48 Section 166 of Am. Sub. H.B. 117 of the 121st General Assembly to 49 the Association of Ex-Pupils of the Ohio Veterans' Children's 50 Home. The deed shall be executed by the Governor in the name of 51 the state, countersigned by the Secretary of State, sealed with the Great Seal of the State, presented in the Office of the 52 Auditor of State for recording, and delivered to the grantee. 53 The grantee shall present the deed for recording in the Office of 54 the Greene County Recorder. (E) This section expires two years after its effective 56 date. Section 2. That Section 139 of Am. Sub. H.B. 117 of the 58 121st General Assembly is hereby repealed. 59
