BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 17 Section 1. That sections 1901.01, 1901.02, 1901.021, 19 1901.08, and 1905.01 of the Revised Code be amended to read as 20 follows: 21 Sec. 1901.01. THE MUNICIPAL COURT ESTABLISHED BY THIS 60 DIVISION IS A CONTINUATION OF THE MUNICIPAL COURT PREVIOUSLY 61 ESTABLISHED IN BATAVIA BY THIS SECTION BEFORE THE ENACTMENT OF 62 THIS DIVISION. Sec. 1901.02. (A) The municipal courts established by 71 section 1901.01 of the Revised Code have jurisdiction within the 72 corporate limits of their respective municipal corporations, OR, 73 FOR THE CLERMONT COUNTY MUNICIPAL COURT, WITHIN THE MUNICIPAL 74 CORPORATION OR UNINCORPORATED TERRITORY IN WHICH IT IS 75 ESTABLISHED, and are courts of record. Each of the courts shall 76 be styled ".................................. municipal court," 77 inserting the name of the municipal corporation, except the 78 following courts, which shall be styled as set forth below: 79 (1) The municipal court established in Chesapeake that 81 shall be styled and known as the "Lawrence county municipal 82 court"; 83 (2) The municipal court established in Cincinnati that 85 shall be styled and known as the "Hamilton county municipal 86 court"; 87 (3) The municipal court established in Ravenna that shall 89 3 be styled and known as the "Portage county municipal court"; 90 (4) The municipal court established in Athens that shall 92 be styled and known as the "Athens county municipal court"; 93 (5) The municipal court established in Columbus that established in Urbana that shall 120 be styled and known as the "Champaign county municipal court"; 121 (14) The municipal court established in Jackson that shall 123 be styled and known as the "Jackson county municipal court"; 124 (15) The municipal court established in Springfield that 126 shall be styled and known as the "Clark county municipal court"; 127 (16) The municipal court established in Kenton that shall 129 be styled and known as the "Hardin county municipal court"; 130 (17) The municipal court established WITHIN CLERMONT 132 COUNTY in Batavia OR IN ANY OTHER MUNICIPAL CORPORATION OR 133 UNINCORPORATED TERRITORY WITHIN CLERMONT COUNTY THAT IS SELECTED 134 BY THE LEGISLATIVE AUTHORITY OF THAT COURT that shall be styled 136 and known as the "Clermont county municipal court"; (18) The municipal court established in Wilmington that, 138 4 beginning July 1, 1992, shall be styled and known as the "Clinton 139 county municipal court"; 140 (19) The municipal court established in Port Clinton that 142 shall be styled and known as "the Ottawa county municipal court." 143 (B) In addition to the jurisdiction set forth in division 145 (A) of this section, the municipal courts established by section 146 1901.01 of the Revised Code have jurisdiction as follows: 147 The Akron municipal court has jurisdiction within Bath, 149 Northampton, Richfield, and Springfield townships, and within the 150 municipal corporations of Fairlawn, Lakemore, and Mogadore, in 151 Summit county. 152 The Alliance municipal court has jurisdiction within 154 Lexington, Marlboro, Paris, and Washington townships in Stark 155 county. 156 The Ashland municipal court has jurisdiction within Ashland 158 county. 159 The Ashtabula municipal court has jurisdiction within 161 Ashtabula, Plymouth, and Saybrook townships in Ashtabula county. 162 The Athens county municipal court has jurisdiction within 164 Athens county. 165 The Auglaize county municipal court has jurisdiction within 167 Auglaize county. 168 The Avon Lake municipal court has jurisdiction within the 170 municipal corporations of Avon and Sheffield in Lorain county. 171 The Barberton municipal court has jurisdiction within 173 Coventry, Franklin, and Green townships, within all of Copley 174 township except within the municipal corporation of Fairlawn, and 175 within the municipal corporations of Clinton and Norton, in 176 Summit county. 177 The Bedford municipal court has jurisdiction within the 179 municipal corporations of Bedford Heights, Oakwood, Glenwillow, 180 Solon, Bentleyville, Chagrin Falls, Moreland Hills, Orange, 181 Warrensville Heights, North Randall, and Woodmere, and within 182 Warrensville and Chagrin Falls townships, in Cuyahoga county. 183 5 The Bellefontaine municipal court has jurisdiction within 185 Logan county. 186 The Bellevue municipal court has jurisdiction within Lyme 188 and Sherman townships in Huron county and within York township in 189 Sandusky county. 190 The Berea municipal court has jurisdiction within the 192 municipal corporations of Strongsville, Middleburgh Heights, 193 Brook Park, Westview, and Olmsted Falls, and within Olmsted 194 township, in Cuyahoga county. 195 The Bowling Green municipal court has jurisdiction within 197 the municipal corporations of Bairdstown, Bloomdale, Bradner, 198 Custar, Cygnet, Grand Rapids, Haskins, Hoytville, Jerry City, 199 Milton Center, North Baltimore, Pemberville, Portage, Rising Sun, 200 Tontogany, Wayne, and Weston, and within Bloom, Center, Freedom, 201 Grand 213 The Canton municipal court has jurisdiction within Canton, 215 Lake, Nimishillen, Osnaburg, Pike, Plain, and Sandy townships in 216 Stark county. 217 The Celina municipal court has jurisdiction within Mercer 219 county. 220 The Champaign county municipal court has jurisdiction 222 within Champaign county. 223 The Chardon municipal court has jurisdiction within Geauga 225 county. 226 The Chillicothe municipal court has jurisdiction within 228 Ross county. 229 6 The Circleville municipal court has jurisdiction within 231 Pickaway county. 232 The Clark county municipal court has jurisdiction within 234 Clark county. 235 The Clermont county municipal court has jurisdiction within 237 Clermont county. 238 The Cleveland municipal court has jurisdiction within the 240 municipal corporation of Bratenahl in Cuyahoga county. 241 Beginning July 1, 1992, the Clinton county municipal court 243 has jurisdiction within Clinton county. 244 The Coshocton municipal court has jurisdiction within 246 Coshocton county. 247 The Crawford county municipal court has jurisdiction within 249 Crawford county. 250 The Cuyahoga Falls municipal court has jurisdiction within 252 Boston, Hudson, Northfield Center, Sagamore Hills, and Twinsburg 253 townships, and within the municipal corporations of Boston 254 Heights, Hudson, Munroe Falls, Northfield, Peninsula, 255 Reminderville, Silver Lake, Stow, Tallmadge, Twinsburg, and 256 Macedonia, in Summit county. 257 The Defiance municipal court has jurisdiction within 259 Defiance county. 260 The Delaware municipal court has jurisdiction within 262 Delaware county. 263 The East Liverpool municipal court has jurisdiction within 265 Liverpool and St. Clair townships in Columbiana county. 266 The Eaton municipal court has jurisdiction within Preble 268 county. 269 The Elyria municipal court has jurisdiction within the 271 municipal corporations of Grafton, LaGrange, and North 272 Ridgeville, and within Elyria, Carlisle, Eaton, Columbia, 273 Grafton, and LaGrange townships, in Lorain county. 274 The Fairborn municipal court has jurisdiction within the 276 municipal corporation of Beavercreek and within Bath and 277 7 Beavercreek townships in Greene county. 278 The Findlay municipal court has jurisdiction within all of 280 Hancock county except within Washington township. 281 The Fostoria municipal court has jurisdiction within Loudon 283 and Jackson townships in Seneca county, within Washington 284 township in Hancock county, and within Perry township in Wood 285 county. 286 The Franklin municipal court has jurisdiction within 288 Franklin township in Warren county. 289 The Franklin county municipal court has jurisdiction within 291 Franklin county. 292 The Fremont municipal court has jurisdiction within 294 Ballville and Sandusky townships in Sandusky county. 295 The Gallipolis municipal court has jurisdiction within 297 Gallia county. 298 The Garfield Heights municipal court has jurisdiction 300 within the municipal corporations of Maple Heights, Walton Hills, 301 Valley View, Cuyahoga Heights, Newburgh Heights, Independence, 302 and Brecksville in Cuyahoga county. 303 The Girard municipal court has jurisdiction within Liberty, 305 Vienna, and Hubbard townships in Trumbull county. 306 The Hamilton municipal court has jurisdiction within Ross 308 and St. Clair townships in Butler county. 309 The Hamilton county municipal court has jurisdiction within 311 Hamilton county. 312 The Hardin county municipal court has jurisdiction within 314 Hardin county. 315 The Hillsboro municipal court has jurisdiction within all 317 of Highland county except within Madison township. 318 The Hocking county municipal court has jurisdiction within 320 Hocking county. 321 The Huron municipal court has jurisdiction within all of 323 Huron township in Erie county except within the municipal 324 corporation of Sandusky. 325 8 The Ironton municipal court has jurisdiction within Aid, 327 Decatur, Elizabeth, Hamilton, Lawrence, Upper, and Washington 328 townships in Lawrence county. 329 The Jackson county municipal court has jurisdiction within 331 Jackson county. 332 The Kettering municipal court has jurisdiction within the 334 municipal corporations of Centerville and Moraine, and within 335 Washington township, in Montgomery county. 336 The Lancaster municipal court has jurisdiction within 338 Fairfield county. 339 The Lawrence county municipal court has jurisdiction within 341 the townships of Fayette, Mason, Perry, Rome, Symmes, Union, and 342 Windsor in Lawrence county. 343 The Lebanon municipal court has jurisdiction within 345 Turtlecreek township in Warren county. 346 The Licking county municipal court has jurisdiction within 348 Licking county. 349 The Lima municipal court has jurisdiction within Allen 351 county. 352 The Lorain municipal court has jurisdiction within the 354 municipal corporation of Sheffield Lake, and within Sheffield 355 township, in Lorain county. 356 The Lyndhurst municipal court has jurisdiction within the 358 municipal corporations of Mayfield Heights, Gates Mills, 359 Mayfield, Highland Heights, and Richmond Heights in Cuyahoga 360 county. 361 The Madison county municipal court has jurisdiction within 363 Madison county. 364 The Mansfield municipal court has jurisdiction within 366 Madison, Springfield, Sandusky, Franklin, Weller, Mifflin, Troy, 367 Washington, Monroe, Perry, Jefferson, and Worthington townships, 368 and within sections 35-36-31 and 32 of Butler township, in 369 Richland county. 370 The Marietta municipal court has jurisdiction within 372 9 Washington county. 373 The Marion municipal court has jurisdiction within Marion 375 county. 376 The Marysville municipal court has jurisdiction within 378 Union county. 379 The Mason municipal court has jurisdiction within Deerfield 381 township in Warren county. 382 The Massillon municipal court has jurisdiction within 384 Bethlehem, Perry, Sugar Creek, Tuscarawas, Lawrence, and Jackson 385 townships in Stark county. 386 The Maumee municipal court has jurisdiction within the 388 municipal corporations of Waterville and Whitehouse, within 389 Waterville and Providence townships, and within those portions of 390 Springfield, Monclova, and Swanton townships lying south of the 391 northerly boundary line of the Ohio turnpike, in Lucas county. 392 The Medina municipal court has jurisdiction within the 394 municipal corporations of Briarwood Beach, Brunswick, 395 Chippewa-on-the-Lake, and Spencer and within the townships of 396 Brunswick Hills, Chatham, Granger, Hinckley, Lafayette, 397 Litchfield, Liverpool, Medina, Montville, Spencer, and York 398 townships, in Medina county. 399 The Mentor municipal court has jurisdiction within the 401 municipal corporation of Mentor-on-the-Lake in Lake county. 402 The Miami county municipal court has jurisdiction within 404 Miami county and within the part of the municipal corporation of 405 Bradford that is located in Darke county. 406 The Miamisburg municipal court has jurisdiction within the 408 municipal corporations of Germantown and West Carrollton, and 409 within German and Miami townships in Montgomery county. 410 The Middletown municipal court has jurisdiction within 412 Madison township, and within all of Lemon township, except within 413 the municipal corporation of Monroe, in Butler county. 414 The Mount Vernon municipal court has jurisdiction within 416 Knox county. 417 10 The Napoleon municipal court has jurisdiction within Henry 419 county. 420 The New Philadelphia municipal court has jurisdiction 422 within the municipal corporation of Dover, and within Auburn, 423 Bucks, Fairfield, Goshen, Jefferson, Warren, York, Dover, 424 Franklin, Lawrence, Sandy, Sugarcreek, and Wayne townships in 425 Tuscarawas county. 426 The Newton Falls municipal court has jurisdiction within 428 Bristol, Bloomfield, Lordstown, Newton, Braceville, Southington, 429 Farmington, and Mesopotamia townships in Trumbull county. 430 The Niles municipal court has jurisdiction within the 432 municipal corporation of McDonald, and within Weathersfield 433 township in Trumbull county. 434 The Norwalk municipal court has jurisdiction within all of 436 Huron county except within the municipal corporation of Bellevue 437 and except within Lyme and Sherman townships. 438 The Oberlin municipal court has jurisdiction within the 440 municipal corporations of Amherst, Kipton, Rochester, South 441 Amherst, and Wellington, and within Henrietta, Russia, Camden, 442 Pittsfield, Brighton, Wellington, Penfield, Rochester, and 443 Huntington townships, and within all of Amherst township except 444 within the municipal corporation of Lorain, in Lorain county. 445 The Oregon municipal court has jurisdiction within the 447 municipal corporation of Harbor View, and within Jerusalem 448 township, in Lucas county, and north within Maumee Bay and Lake 449 Erie to the boundary line between Ohio and Michigan between the 450 easterly boundary of the court and the easterly boundary of the 451 Toledo municipal court. 452 The Ottawa county municipal court has jurisdiction within 454 Ottawa county. 455 The Painesville municipal court has jurisdiction within 457 Painesville, Perry, Leroy, Concord, and Madison townships in Lake 458 county. 459 The Parma municipal court has jurisdiction within the 461 11 municipal corporations of Parma Heights, Brooklyn, Linndale, 462 North Royalton, Broadview Heights, Seven Hills, and Brooklyn 463 Heights in Cuyahoga county. 464 The Perrysburg municipal court has jurisdiction within the 466 municipal corporations of Luckey, Millbury, Northwood, Rossford, 467 and Walbridge, and within Perrysburg, Lake, and Troy townships, 468 in Wood county. 469 The Portage county municipal court has jurisdiction within 471 Portage county. 472 The Portsmouth municipal court has jurisdiction within 474 Scioto county. 475 The Rocky River municipal court has jurisdiction within the 477 municipal corporations of Bay Village, Westlake, Fairview Park, 478 and North Olmsted, and within Riveredge township, in Cuyahoga 479 county. 480 The Sandusky municipal court has jurisdiction within the 482 municipal corporations of Castalia and Bay View, and within 483 Perkins township, in Erie county. 484 The Shaker Heights municipal court has jurisdiction within 486 the municipal corporations of University Heights, Beachwood, 487 Pepper Pike, and Hunting Valley in Cuyahoga county. 488 The Shelby municipal court has jurisdiction within Sharon, 490 Jackson, Cass, Plymouth, and Blooming Grove townships, and within 491 all of Butler township except sections 35-36-31 and 32, in 492 Richland county. 493 The Sidney municipal court has jurisdiction within Shelby 495 county. 496 The Struthers municipal court has jurisdiction within the 498 municipal corporations of Lowellville, New Middleton, and Poland, 499 and within Poland and Springfield townships in Mahoning county. 500 The Sylvania municipal court has jurisdiction within the 502 municipal corporations of Berkey and Holland, and within 503 Sylvania, Richfield, Spencer, and Harding townships, and within 504 those portions of Swanton, Monclova, and Springfield townships 505 12 lying north of the northerly boundary line of the Ohio turnpike, 506 in Lucas county. 507 The Tiffin municipal court has jurisdiction within Adams, 509 Big Spring, Bloom, Clinton, Eden, Hopewell, Liberty, Pleasant, 510 Reed, Scipio, Seneca, Thompson, and Venice townships in Seneca 511 county. 512 The Toledo municipal court has jurisdiction within 514 Washington township, and within the municipal corporation of 515 Ottawa Hills, in Lucas county. 516 The Upper Sandusky municipal court has jurisdiction within 518 Wyandot county. 519 The Vandalia municipal court has jurisdiction within the 521 municipal corporations of Clayton, Englewood, and Union, and 522 within Butler, Harrison, and Randolph townships, in Montgomery 523 county. 524 The Van Wert municipal court has jurisdiction within Van 526 Wert county. 527 The Vermilion municipal court has jurisdiction within the 529 townships of Vermilion and Florence in Erie county and within all 530 of Brownhelm township except within the municipal corporation of 531 Lorain, in Lorain county. 532 The Wadsworth municipal court has jurisdiction within the 534 municipal corporations of Gloria Glens Park, Lodi, Seville, and 535 Westfield Center, and within Guilford, Harrisville, Homer, 536 Sharon, Wadsworth, and Westfield townships in Medina county. 537 The Warren municipal court has jurisdiction within Warren 539 and Champion townships, and within all of Howland township except 540 within the municipal corporation of Niles, in Trumbull county. 541 The Washington Court House municipal court has jurisdiction 543 within Fayette county. 544 The Wayne county municipal court has jurisdiction within 546 Wayne county. 547 The Willoughby municipal court has jurisdiction within the 549 municipal corporations of Eastlake, Wickliffe, Willowick, 550 13 Willoughby Hills, Kirtland, Kirtland Hills, Waite Hill, 551 Timberlake, and Lakeline, and within Kirtland township, in Lake 552 county. 553 Through June 30, 1992, the Wilmington municipal court has 555 jurisdiction within Clinton county. 556 The Xenia municipal court has jurisdiction within 558 Caesarcreek, Cedarville, Jefferson, Miami, New Jasper, Ross, 559 Silvercreek, Spring Valley, Sugarcreek, and Xenia townships in 560 Greene county. 561 (C) As used in this section: 563 (1) "Within a township" includes all land, including, but 565 not limited to, any part of any municipal corporation, that is 566 physically located within the territorial boundaries of that 567 township, whether or not that land or municipal corporation is 568 governmentally a part of the township. 569 (2) "Within a municipal corporation" includes all land 571 within the territorial boundaries of the municipal corporation 572 and any townships that are coextensive with the municipal 573 corporation. 574 Sec. 1901.021. (A) The judge or judges of any municipal 583 court ESTABLISHED UNDER DIVISION (A) OF SECTION 1901.01 OF THE 584 REVISED CODE having territorial jurisdiction outside the 585 corporate limits of the municipal corporation in which it is 586 located may sit outside the corporate limits of the municipal 587 corporation within the area of its territorial jurisdiction. 588 (B) Two or more of the judges of the Hamilton county 590 municipal court shall be assigned by the presiding judge of the 591 court to sit outside the municipal corporation of Cincinnati. 592 (C) Two of the judges of the Portage county municipal 594 court shall sit within the municipal corporation of Ravenna, and 595 one of the judges shall sit within the municipal corporation of 596 Kent. The judges may sit in other incorporated areas of Portage 597 county. 598 (D) One of the judges of the Wayne county municipal court 600 14 shall sit within the municipal corporation of Wooster, and one 601 shall sit within the municipal corporation of Orrville. Both 602 judges may sit in other incorporated areas of Wayne county. 603 (E) The judge of the Auglaize county municipal court shall 605 sit within the municipal corporations of Wapakoneta and St. Marys 606 and may sit in other incorporated areas in Auglaize county. 607 (F) At least one of the judges of the Miami county 609 municipal court shall sit within the municipal corporations of 610 Troy, Piqua, and Tipp City, and the judges may sit in other 611 incorporated areas of Miami county. 612 (G) The judge of the Crawford county municipal court shall 614 sit within the municipal corporations of Bucyrus and Galion and 615 may sit in other incorporated areas in Crawford county. 616 (H) The judge of the Jackson county municipal court shall 618 sit within the municipal corporations of Jackson and Wellston and 619 may sit in other incorporated areas in Jackson county. 620 (I) In any municipal court, other than the Hamilton county 622 municipal court, that has more than one judge, the decision for 623 one or more judges to sit outside the corporate limits of the 624 municipal corporation shall be made by rule of the court as 625 provided in division (C) of sections 1901.14 and 1901.16 of the 626 Revised Code. 627 (J) The assignment of a judge to sit in a municipal 629 corporation other than that in which the court is located does 630 not affect the jurisdiction of the mayor except as provided in 631 section 1905.01 of the Revised Code. 632 (K) THE JUDGES OF THE CLERMONT COUNTY MUNICIPAL COURT MAY 635 SIT IN ANY MUNICIPAL CORPORATION OR UNINCORPORATED TERRITORY WITHIN CLERMONT COUNTY. 636 Sec. 1901.08. (A) In all municipal corporations, OTHER 1,094 THAN BATAVIA IN CLERMONT COUNTY, not being the site of a 1,096 municipal court nor a place where a judge of the Auglaize county, 1,097 Crawford county, Jackson county, Miami county, Portage county, or 1,098 Wayne county municipal court sits as required pursuant to section 1,099 1901.021 of the Revised Code or by designation of the judges 1,100 pursuant to section 1901.021 of the Revised Code, the mayor of 1,101 the municipal corporation has jurisdiction, except as provided in 1,102 divisions (B), (C), and (E) of this section and subject to the 1,104 limitation contained in section 1905.03 and the limitation 1,105 contained in section 1905.031 of the Revised Code, to hear and 1,106 determine any prosecution for the violation of an ordinance of 1,107 the municipal corporation, to hear and determine any case 1,108 involving a violation of a vehicle parking or standing ordinance 1,109 of the municipal corporation unless the violation is required to 1,110 be handled by a parking violations bureau or joint parking 1,111 violations bureau pursuant to Chapter 4521. of the Revised Code, 1,112 and to hear and determine all criminal causes involving any 1,113 moving traffic violation occurring on a state highway located 1,114 within the boundaries of the municipal corporation, subject to 1,115 the limitations of sections 2937.08 and 2938.04 of the Revised 1,116 Code. 25 (B)(1) In all municipal corporations, OTHER THAN BATAVIA 1,118 IN CLERMONT COUNTY, not being the site of a municipal court nor a 1,120 place where a judge of a court listed in division (A) of this 1,121 section sits as required pursuant to section 1901.021 of the 1,122 Revised Code or by designation of the judges pursuant to section 1,123 1901.021 of the Revised Code, the mayor of the municipal 1,124 corporation has jurisdiction, subject to the limitation contained 1,125 in section 1905.03 of the Revised Code, to hear and determine 1,126 prosecutions involving a violation of an ordinance of the 1,127 municipal corporation relating to operating a vehicle while under 1,128 the influence of alcohol, a drug of abuse, or alcohol and a drug 1,129 of abuse or relating to operating a vehicle with a prohibited 1,130 concentration of alcohol in the blood, breath, or urine, and to 1,131 hear and determine criminal causes involving a violation of 1,132 section 4511.19 of the Revised Code that occur on a state highway 1,133 located within the boundaries of the municipal corporation, 1,134 subject to the limitations of sections 2937.08 and 2938.04 of the 1,135 Revised Code, only if the person charged with the violation, 1,136 within six years of the date of the violation charged, has not 1,137 been convicted of or pleaded guilty to any of the following: 1,138 (a) A violation of an ordinance of any municipal 1,140 corporation relating to operating a vehicle while under the 1,141 influence of alcohol, a drug of abuse, or alcohol and a drug of 1,142 abuse or relating to operating a vehicle with a prohibited 1,143 concentration of alcohol in the blood, breath, or urine; 1,144 (b) A violation of section 4511.19 of the Revised Code; 1,146 (c) A violation of any ordinance of any municipal 1,148 corporation or of any section of the Revised Code that regulates 1,149 the operation of vehicles, streetcars, and trackless trolleys 1,150 upon the highways or streets, in relation to which all of the 1,151 following apply: 1,152 (i) The person, in the case in which the conviction was 1,154 obtained or the plea of guilty was entered, had been charged with 1,155 a violation of an ordinance of any municipal corporation relating 1,156 26 to operating a vehicle while under the influence of alcohol, a 1,157 drug of abuse, or alcohol and a drug of abuse or relating to 1,158 operating a vehicle with a prohibited concentration of alcohol in 1,159 the blood, breath, or urine, or with a violation of section 1,160 4511.19 of the Revised Code; 1,161 (ii) The charge of the violation described in division 1,163 (B)(1)(c)(i) of this section was dismissed or reduced; 1,164 (iii) The violation of which the person was convicted or 1,166 to which the person pleaded guilty arose out of the same facts 1,168 and circumstances and the same act as did the charge that was dismissed or reduced. 1,169 (d) A violation of a statute of the United States or of 1,171 any other state or a municipal ordinance of a municipal 1,172 corporation located in any other state that is substantially 1,173 similar to section 4511.19 of the Revised Code. (2) The mayor of a municipal corporation does not have 1,175 jurisdiction to hear and determine any prosecution or criminal 1,176 cause involving a violation described in division (B)(1)(a) or 1,177 (b) of this section, regardless of where the violation occurred, 1,178 if the person charged with the violation, within six years of the 1,180 violation charged, has been convicted of or pleaded guilty to any 1,181 violation listed in division (B)(1)(a), (b), (c), or (d) of this 1,182 section. If the mayor of a municipal corporation, in hearing a 1,184 prosecution involving a violation of an ordinance of the 1,185 municipal corporation the mayor serves relating to operating a 1,187 vehicle while under the influence of alcohol, a drug of abuse, or alcohol and a drug of abuse or relating to operating a vehicle 1,188 with a prohibited concentration of alcohol in the blood, breath, 1,189 or urine, or in hearing a criminal cause involving a violation of 1,190 section 4511.19 of the Revised Code, determines that the person 1,191 charged, within six years of the violation charged, has been 1,193 convicted of or pleaded guilty to any violation listed in 1,194 division (B)(1)(a), (b), (c), or (d) of this section, the mayor 1,196 27 immediately shall transfer the case to the county court or 1,197 municipal court with jurisdiction over the violation charged, in 1,198 accordance with section 1905.032 of the Revised Code. 1,199 (C)(1) In all municipal corporations, OTHER THAN BATAVIA 1,201 IN CLERMONT COUNTY, not being the site of a municipal court and 1,203 not being a place where a judge of a court listed in division (A) 1,204 of this section sits as required pursuant to section 1901.021 of 1,205 the Revised Code or by designation of the judges pursuant to 1,206 section 1901.021 of the Revised Code, the mayor of the municipal 1,207 corporation, subject to sections 1901.031, 2937.08, and 2938.04 1,208 of the Revised Code, has jurisdiction to hear and determine 1,209 prosecutions involving a violation of a municipal ordinance that 1,210 is substantially equivalent to division (B)(1) or (D)(2) of 1,211 section 4507.02 of the Revised Code and to hear and determine 1,212 criminal causes that involve a moving traffic violation, that 1,213 involve a violation of division (B)(1) or (D)(2) of section 1,214 4507.02 of the Revised Code, and that occur on a state highway 1,215 located within the boundaries of the municipal corporation only 1,216 if all of the following apply regarding the violation and the 1,217 person charged: (a) Regarding a violation of division (B)(1) of section 1,219 4507.02 of the Revised Code or a violation of a municipal 1,220 ordinance that is substantially equivalent to that division, the 1,221 person charged with the violation, within five years of the date 1,222 of the violation charged, has not been convicted of or pleaded 1,223 guilty to any of the following: 1,224 (i) A violation of division (B)(1) of section 4507.02 of 1,226 the Revised Code; 1,227 (ii) A violation of a municipal ordinance that is 1,229 substantially equivalent to division (B)(1) of section 4507.02 of 1,230 the Revised Code; 1,231 (iii) A violation of any municipal ordinance or section of 1,233 the Revised Code that regulates the operation of vehicles, 1,234 streetcars, and trackless trolleys upon the highways or streets, 1,235 28 in a case in which, after a charge against the person of a 1,236 violation of a type described in division (C)(1)(a)(i) or (ii) of 1,237 this section was dismissed or reduced, the person is convicted of 1,238 or pleads guilty to a violation that arose out of the same facts 1,239 and circumstances and the same act as did the charge that was 1,240 dismissed or reduced. 1,241 (b) Regarding a violation of division (D)(2) of section 1,243 4507.02 of the Revised Code or a violation of a municipal 1,244 ordinance that is substantially equivalent to that division, the 1,245 person charged with the violation, within five years of the date 1,246 of the violation charged, has not been convicted of or pleaded 1,247 guilty to any of the following: 1,248 (i) A violation of division (D)(2) of section 4507.02 of 1,250 the Revised Code; 1,251 (ii) A violation of a municipal ordinance that is 1,253 substantially equivalent to division (D)(2) of section 4507.02 of 1,254 the Revised Code; 1,255 (iii) A violation of any municipal ordinance or section of 1,257 the Revised Code that regulates the operation of vehicles, 1,258 streetcars, and trackless trolleys upon the highways or streets 1,259 in a case in which, after a charge against the person of a 1,260 violation of a type described in division (C)(1)(b)(i) or (ii) of 1,261 this section was dismissed or reduced, the person is convicted of 1,262 or pleads guilty to a violation that arose out of the same facts 1,263 and circumstances and the same act as did the charge that was 1,264 dismissed or reduced. 1,265 (2) The mayor of a municipal corporation does not have 1,267 jurisdiction to hear and determine any prosecution or criminal 1,268 cause involving a violation described in division (C)(1)(a)(i) or 1,269 (ii) of this section if the person charged with the violation, 1,270 within five years of the violation charged, has been convicted of 1,271 or pleaded guilty to any violation listed in division 1,272 (C)(1)(a)(i), (ii), or (iii) of this section and does not have 1,273 jurisdiction to hear and determine any prosecution or criminal 1,274 29 cause involving a violation described in division (C)(1)(b)(i) or 1,275 (ii) of this section if the person charged with the violation, 1,276 within five years of the violation charged, has been convicted of 1,277 or pleaded guilty to any violation listed in division 1,278 (C)(1)(b)(i), (ii), or (iii) of this section. 1,279 (3) If the mayor of a municipal corporation, in hearing a 1,281 prosecution involving a violation of an ordinance of the 1,282 municipal corporation the mayor serves that is substantially 1,283 equivalent to division (B)(1) or (D)(2) of section 4507.02 of the 1,285 Revised Code or a violation of division (B)(1) or (D)(2) of 1,286 section 4507.02 of the Revised Code, determines that, under 1,287 division (C)(2) of this section, mayors do not have jurisdiction 1,288 of the prosecution, the mayor immediately shall transfer the case 1,289 to the county court or municipal court with jurisdiction over the 1,290 violation in accordance with section 1905.032 of the Revised 1,291 Code. (D) If the mayor of a municipal corporation has 1,293 jurisdiction pursuant to division (B)(1) of this section to hear 1,294 and determine a prosecution or criminal cause involving a 1,295 violation described in division (B)(1)(a) or (b) of this section, 1,296 the authority of the mayor to hear or determine the prosecution 1,297 or cause is subject to the limitation contained in division (C) 1,298 of section 1905.03 of the Revised Code. If the mayor of a 1,299 municipal corporation has jurisdiction pursuant to division (A) 1,300 or (C) of this section to hear and determine a prosecution or 1,301 criminal cause involving a violation other than a violation 1,302 described in division (B)(1)(a) or (b) of this section, the 1,303 authority of the mayor to hear or determine the prosecution or 1,304 cause is subject to the limitation contained in division (C) of 1,306 section 1905.031 of the Revised Code. (E)(1) The mayor of a municipal corporation does not have 1,308 jurisdiction to hear and determine any prosecution or criminal 1,309 cause involving any of the following: 1,310 (a) A violation of section 2919.25 or 2919.27 of the 1,312 30 Revised Code; (b) A violation of section 2903.11, 2903.12, 2903.13, 1,314 2903.211, or 2911.211 of the Revised Code that involves a person 1,316 who was a family or household member of the defendant at the time 1,317 of the violation; (c) A violation of a municipal ordinance that is 1,319 substantially equivalent to an offense described in division 1,320 (E)(1)(a) or (b) of this section and that involves a person who 1,321 was a family or household member of the defendant at the time of 1,322 the violation. (2) The mayor of a municipal corporation does not have 1,324 jurisdiction to hear and determine a motion filed pursuant to 1,325 section 2919.26 of the Revised Code or filed pursuant to a 1,326 municipal ordinance that is substantially equivalent to that 1,328 section or to issue a protection order pursuant to that section 1,329 or a substantially equivalent municipal ordinance. 1,330 (3) As used in this section, "family or household member" 1,332 has the same meaning as in section 2919.25 of the Revised Code. 1,333 (F) In keeping a docket and files, the mayor, and a 1,335 mayor's court magistrate appointed under section 1905.05 of the 1,336 Revised Code, shall be governed by the laws pertaining to county 1,337 courts. 1,338 Section 2. That existing sections 1901.01, 1901.02, 1,340 1902.021, 1901.08, and 1905.01 of the Revised Code are hereby 1,341 repealed. 1,342 Section 3. Section 1905.01 of the Revised Code is 1,344 presented in this act as a composite of the section as amended by 1,345 both Am. Sub. S.B. 1 and Am. Sub. S.B. 60 of the 122nd General 1,346 Assembly, with the new language of neither of the acts shown in 1,348 capital letters. This is in recognition of the principle stated 1,349 in division (B) of section 1.52 of the Revised Code that such 1,350 amendments are to be harmonized where not substantively 1,351 irreconcilable and constitutes a legislative finding that such is 1,352 the resulting version in effect prior to the effective date of 1,353 31 this act.
