No. 15 5 1999-2000 6 REPRESENTATIVES MOTTLEY-FORD-TIBERI-SCHULER- 8 ALLEN-JAMES-GRENDELL-D.MILLER-OPFER- 9 WILLAMOWSKI-LUCAS-GARDNER-TERWILLEGER- 10 BRITTON-THOMAS-SULZER-BENDER-OLMAN-EVANS-JOLIVETTE 11 12 A B I L L To amend sections 145.294, 3307.281, and 3309.27 and 15 to enact sections 145.2910, 145.311, 145.312, 3307.282, 3307.283, 3307.413, 3309.261, 3309.262, 16 and 3309.352 of the Revised Code to allow a 17 member of the Public Employees Retirement System, 18 School Employees Retirement System, or State 19 Teachers Retirement System to purchase by payroll deduction service credit for certain prior 20 service covered by one of the other systems. 21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 23 Section 1. That sections 145.294, 3307.281, and 3309.27 be 26 amended and sections 145.2910, 145.311, 145.312, 3307.282, 3307.283, 3307.413, 3309.261, 3309.262, and 3309.352 of the 28 Revised Code be enacted to read as follows: Sec. 145.294. (A) The public employees retirement board 37maySHALL establish by rule a payroll deduction plan for payment 38 of the cost of restoring service credit under section 145.31 of 40 the Revised Code or purchasing any service credit members of the 41 public employees retirement system are eligible to purchase under 42 this chapter. In addition to any other matter considered 43 relevant by the board, the rules shall specify all of the 44 following: 45 (1) The types of service credit that may be paid for 47 2 through payroll deduction, including the section of the Revised 48 Code that authorizes the purchase of each type of service credit 49 for which payment may be made by payroll deduction; 50 (2) The procedureto be followed by a member to inform his52 FOR INFORMING THE MEMBER'S employer and the system thatheTHE 55 MEMBER wishes to purchase service credit under this chapter 57 through payroll deduction; (3) The procedure to be followed by the system and 59 employers to determine for each request the amount to be 60 deducted, the number of deductions to be made, and the interval 61 at which deductions will be made. The rules may provide for a 62 minimum amount for each deduction or a maximum number of 63 deductions for the purchase of any type of credit. 64 (4) The procedure to be followed by employers in 66 transmitting amounts deducted from the salaries of their 67 employees to the system; 68 (5) The procedure to be followed by the system in 70 crediting service credit to members who choose to purchase it 71 through payroll deduction. 72 (B)If theTHE boardestablishes a payroll deduction plan74under this section, itshall certify to the member's employer for 75 each member for whom deductions are to be made, the amount of 76 each deduction and the payrolls from which deductions are to be 77 made. The employer shall make the deductions as certified and 78 transmit the amounts deducted in accordance with the rules 79 established by the board under this section. AT THE ELECTION OF 80 A MEMBER FOR WHOM DEDUCTIONS ARE TO BE MADE TO PURCHASE SERVICE 82 CREDIT UNDER SECTION 145.2910 OF THE REVISED CODE, THE EMPLOYER SHALL MAKE THE DEDUCTIONS UNDER A PLAN THAT IS IN COMPLIANCE WITH 83 DIVISION (h)(2) OF SECTION 414 OF THE "INTERNAL REVENUE CODE OF 85 1986," 100 STAT. 2085, 26 U.S.C.A. 414(h)(2), AS AMENDED. 86 (C) Rules adopted under this section shall not affect any 88 right to purchase service credit conferred by any other section 89 of the Revised Code, including the right of a member under any 90 3 such section to purchase only part of the service creditheTHE 91 MEMBER is eligible to purchase. 93 (D) No payroll deduction made pursuant to this section may 95 exceed the amount of a member's net compensation after all other 96 deductions and withholdings required by law. 97 Sec. 145.2910. (A) A MEMBER OF THE PUBLIC EMPLOYEES 100 RETIREMENT SYSTEM WHO IS A FORMER MEMBER OF THE SCHOOL EMPLOYEES 101 RETIREMENT SYSTEM OR STATE TEACHERS RETIREMENT SYSTEM AND HAS 102 RECEIVED A REFUND OF ACCUMULATED CONTRIBUTIONS UNDER SECTION 103 3307.46 OR 3309.42 OF THE REVISED CODE MAY PURCHASE SERVICE 105 CREDIT FOR EACH YEAR OR PORTION OF A YEAR OF SERVICE FOR WHICH 107 THE REFUND WAS MADE. (B) A MEMBER SEEKING TO PURCHASE SERVICE CREDIT UNDER THIS 110 SECTION SHALL NOTIFY THE PUBLIC EMPLOYEES RETIREMENT SYSTEM ON A 111 FORM APPROVED BY THE PUBLIC EMPLOYEES RETIREMENT BOARD. NOT 112 LATER THAN TEN DAYS AFTER RECEIVING THE NOTICE, THE PUBLIC 113 EMPLOYEES RETIREMENT SYSTEM SHALL REQUEST THAT THE FORMER 114 RETIREMENT SYSTEM DETERMINE UNDER SECTION 3307.282 OR 3309.261 OF 115 THE REVISED CODE HOW MUCH IT WOULD COST THE MEMBER TO RESTORE 116 SERVICE CREDIT UNDER SECTION 3307.28 OR 3309.26 OF THE REVISED CODE FOR EACH YEAR OR PORTION OF A YEAR OF SERVICE FOR WHICH THE 117 MEMBER SEEKS TO PURCHASE SERVICE CREDIT UNDER THIS SECTION. THE 118 AMOUNT THE FORMER RETIREMENT SYSTEM CERTIFIES AS THE COST OF 119 RESTORING THE SERVICE CREDIT IS THE COST TO THE MEMBER OF 120 PURCHASING SERVICE CREDIT UNDER THIS SECTION. ON RECEIVING CERTIFICATION OF THE COST FROM THE FORMER RETIREMENT SYSTEM, THE 121 PUBLIC EMPLOYEES RETIREMENT SYSTEM SHALL NOTIFY THE MEMBER OF THE 123 AMOUNT CERTIFIED BY THE FORMER SYSTEM. (C) FOR EACH YEAR OR PORTION OF A YEAR OF SERVICE CREDIT 126 PURCHASED UNDER THIS SECTION, A MEMBER SHALL PAY TO THE PUBLIC 127 EMPLOYEES RETIREMENT SYSTEM THE AMOUNT CERTIFIED BY THE FORMER 128 RETIREMENT SYSTEM. (D) SUBJECT TO RULES ADOPTED BY THE BOARD, A MEMBER MAY 131 PURCHASE ALL OR PART OF THE CREDIT THE MEMBER IS ELIGIBLE TO 132 4 PURCHASE UNDER THIS SECTION IN ONE OR MORE PAYMENTS. 133 (E) IF A MEMBER DIES OR WITHDRAWS FROM SERVICE, ANY 136 PAYMENT MADE BY THE MEMBER UNDER THIS SECTION SHALL BE CONSIDERED 137 AS ACCUMULATED CONTRIBUTIONS OF THE MEMBER. 138 (F) ON APPLICATION FOR AN ALLOWANCE UNDER SECTION 145.33, 141 145.331, 145.34, 145.36, 145.361, OR 145.37 OF THE REVISED CODE 144 BY A MEMBER WHO PURCHASED SERVICE CREDIT UNDER THIS SECTION, THE 145 PUBLIC EMPLOYEES RETIREMENT SYSTEM SHALL REQUEST FROM THE FORMER 146 RETIREMENT SYSTEM AN AMOUNT OF EMPLOYER CONTRIBUTIONS EQUAL TO 147 THE AMOUNT THE MEMBER PAID UNDER THIS SECTION. 148 (G) THE BOARD SHALL ADOPT RULES TO IMPLEMENT THIS SECTION. 151 Sec. 145.311. NOT LATER THAN TEN DAYS AFTER RECEIVING A 153 REQUEST FROM THE STATE TEACHERS RETIREMENT SYSTEM UNDER DIVISION 154 (B) OF SECTION 3307.413 OR THE SCHOOL EMPLOYEES RETIREMENT SYSTEM 157 UNDER DIVISION (B) OF SECTION 3309.352 OF THE REVISED CODE, THE 160 PUBLIC EMPLOYEES RETIREMENT SYSTEM SHALL CALCULATE AND CERTIFY TO 161 THE REQUESTING RETIREMENT SYSTEM HOW MUCH IT WOULD COST A FORMER 162 MEMBER WHO RECEIVED A REFUND UNDER SECTION 145.40 OF THE REVISED 163 CODE TO RESTORE SERVICE CREDIT UNDER SECTION 145.31 OF THE REVISED CODE FOR EACH YEAR OR PORTION OF A YEAR FOR WHICH THE 164 FORMER MEMBER SEEKS TO PURCHASE SERVICE CREDIT UNDER SECTION 166 3307.413 OR 3309.352 OF THE REVISED CODE. Sec. 145.312. NOT LATER THAN TEN DAYS AFTER RECEIVING A 168 REQUEST FROM THE STATE TEACHERS RETIREMENT SYSTEM UNDER DIVISION 169 (F) OF SECTION 3307.413 OR THE SCHOOL EMPLOYEES RETIREMENT SYSTEM 172 UNDER DIVISION (F) OF SECTION 3309.352 OF THE REVISED CODE, THE 175 PUBLIC EMPLOYEES RETIREMENT SYSTEM SHALL TRANSFER TO THE 176 REQUESTING RETIREMENT SYSTEM AN AMOUNT FROM THE EMPLOYER'S 177 ACCUMULATION FUND EQUAL TO THE AMOUNT REQUESTED. 178 Sec. 3307.281. (A) The state teachers retirement board 187maySHALL establish by rule payroll deduction plans for payment 188 of the following: 190 (1) The cost of restoring service credit under section 192 3307.28 of the Revised Code or purchasing any service credit 193 5 members of the state teachers retirement system are eligible to 194 purchase under this chapter; 195 (2) Charges for participation in programs established 197 under section 3307.741 of the Revised Code. 198 (B) In addition to any other matter considered relevant by 200 the board, the rules adopted under this section shall specify all 201 of the following: 202 (1) The types of service credit that may be paid for 204 through payroll deduction, including the section of the Revised 205 Code that authorizes the purchase of each type of service credit 206 for which payment may be made by payroll deduction; 207 (2) The procedureto be followed by a member to inform his209 FOR INFORMING THE MEMBER'S employer and the system thatheTHE 212 MEMBER wishes to use payroll deduction to purchase service credit 214 or pay for participation in programs established under section 215 3307.741 of the Revised Code; (3) The procedure to be followed by the system and 217 employers to determine for each request the amount to be 218 deducted, the number of deductions to be made, and the interval 219 at which deductions will be made. The rules may provide for a 220 minimum amount for each deduction. They may also provide for a 221 maximum number of deductions for the purchase of any type of 222 service credit. 223 (4) The procedure to be followed by employers in 225 transmitting amounts deducted from the compensation of their 226 employees to the system; 227 (5) The procedure to be followed by the system in 229 crediting service credit to members who choose to purchase it 230 through payroll deduction; 231 (6) The time period within which employers are required to 233 transmit amounts deducted from payrolls to the system. 234 (C)(1)If theTHE boardestablishes a payroll deduction236plan under this section, itshall certify to the member's 237 employer, for each member for whom deductions are to be made, the 238 6 amount of each deduction and the payrolls from which deductions 239 are to be made. The employer shall make the deductions as 240 certified and transmit the amounts deducted in accordance with 241 the rules established by the board under this section. AT THE 242 ELECTION OF A MEMBER FOR WHOM DEDUCTIONS ARE TO BE MADE TO 243 PURCHASE SERVICE CREDIT UNDER SECTION 3307.413 OF THE REVISED 244 CODE, THE EMPLOYER SHALL MAKE THE DEDUCTIONS UNDER A PLAN THAT IS 245 IN COMPLIANCE WITH DIVISION (h)(2) OF SECTION 414 OF THE 247 "INTERNAL REVENUE CODE OF 1986," 100 STAT. 2085, 26 U.S.C.A. 249 414(h)(2), AS AMENDED. (2) If an employer does not transmit amounts deducted from 251 the compensation of an employee to the system within the time 252 period specified in rules adopted under division (B)(6) of this 253 section, the employer shall pay interest on the deducted amount 254 compounded annually at a rate to be determined by the board from 255 the date the amount is deducted to the date it is transmitted to 256 the system. 257 (D) Rules adopted under this section shall not affect any 259 right to purchase service credit conferred by any other section 260 of the Revised Code, including the right of a member under any 261 such section to purchase only part of the service creditheTHE 262 MEMBER is eligible to purchase. 264 (E) No payroll deduction made pursuant to this section may 266 exceed the amount of a member's net compensation after all other 267 deductions and withholdings required by law. 268 (F) No payments made to the system under this section 270 shall affect any contribution required by section 3307.51 or 271 3307.53 of the Revised Code. 272 Sec. 3307.282. NOT LATER THAN TEN DAYS AFTER RECEIVING A 274 REQUEST FROM THE PUBLIC EMPLOYEES RETIREMENT SYSTEM UNDER 275 DIVISION (B) OF SECTION 145.2910 OR THE SCHOOL EMPLOYEES 277 RETIREMENT SYSTEM UNDER DIVISION (B) OF SECTION 3309.352 OF THE 280 REVISED CODE, THE STATE TEACHERS RETIREMENT SYSTEM SHALL 282 CALCULATE AND CERTIFY TO THE REQUESTING RETIREMENT SYSTEM HOW 283 7 MUCH IT WOULD COST A FORMER MEMBER WHO RECEIVED A REFUND UNDER 284 SECTION 3307.46 OF THE REVISED CODE TO RESTORE SERVICE CREDIT UNDER SECTION 3307.28 OF THE REVISED CODE FOR EACH YEAR OR 285 PORTION OF A YEAR FOR WHICH THE FORMER MEMBER SEEKS TO PURCHASE 286 SERVICE CREDIT UNDER SECTION 145.2910 OR 3309.352 OF THE REVISED CODE. Sec. 3307.283. NOT LATER THAN TEN DAYS AFTER RECEIVING A 288 REQUEST FROM THE PUBLIC EMPLOYEES RETIREMENT SYSTEM UNDER 289 DIVISION (F) OF SECTION 145.2910 OR THE SCHOOL EMPLOYEES 291 RETIREMENT SYSTEM UNDER DIVISION (F) OF SECTION 3309.352 OF THE 294 REVISED CODE, THE STATE TEACHERS RETIREMENT SYSTEM SHALL TRANSFER 296 TO THE REQUESTING RETIREMENT SYSTEM AN AMOUNT FROM THE EMPLOYER'S 297 TRUST FUND EQUAL TO THE AMOUNT REQUESTED. 298 Sec. 3307.413. (A) A MEMBER OF THE STATE TEACHERS 301 RETIREMENT SYSTEM WHO IS A FORMER MEMBER OF THE PUBLIC EMPLOYEES 302 RETIREMENT SYSTEM OR SCHOOL EMPLOYEES RETIREMENT SYSTEM AND HAS 303 RECEIVED A REFUND OF ACCUMULATED CONTRIBUTIONS UNDER SECTION 304 145.40 OR 3309.42 OF THE REVISED CODE MAY PURCHASE SERVICE CREDIT 306 FOR EACH YEAR OR PORTION OF A YEAR OF SERVICE FOR WHICH THE 308 REFUND WAS MADE. (B) A MEMBER SEEKING TO PURCHASE SERVICE CREDIT UNDER THIS 311 SECTION SHALL NOTIFY THE STATE TEACHERS RETIREMENT SYSTEM ON A 312 FORM APPROVED BY THE STATE TEACHERS RETIREMENT BOARD. NOT LATER 313 THAN TEN DAYS AFTER RECEIVING THE NOTICE, THE STATE TEACHERS 314 RETIREMENT SYSTEM SHALL REQUEST THAT THE FORMER RETIREMENT SYSTEM 315 DETERMINE UNDER SECTION 145.311 OR 3309.261 OF THE REVISED CODE 316 HOW MUCH IT WOULD COST THE MEMBER TO RESTORE SERVICE CREDIT UNDER 317 SECTION 145.31 OR 3309.26 OF THE REVISED CODE FOR EACH YEAR OR PORTION OF A YEAR OF SERVICE FOR WHICH THE MEMBER SEEKS TO 318 PURCHASE CREDIT UNDER THIS SECTION. THE AMOUNT THE FORMER 319 RETIREMENT SYSTEM CERTIFIES AS THE COST OF RESTORING THE SERVICE 320 CREDIT IS THE COST TO THE MEMBER OF PURCHASING SERVICE CREDIT UNDER THIS SECTION. ON RECEIVING CERTIFICATION OF THE COST FROM 322 THE FORMER RETIREMENT SYSTEM, THE STATE TEACHERS RETIREMENT 323 8 SYSTEM SHALL NOTIFY THE MEMBER OF THE AMOUNT CERTIFIED BY THE 324 FORMER SYSTEM. (C) FOR EACH YEAR OR PORTION OF A YEAR OF CREDIT PURCHASED 327 UNDER THIS SECTION, A MEMBER SHALL PAY TO THE STATE TEACHERS 328 RETIREMENT SYSTEM THE AMOUNT CERTIFIED BY THE FORMER RETIREMENT 329 SYSTEM. (D) SUBJECT TO RULES ADOPTED BY THE BOARD, A MEMBER MAY 332 PURCHASE ALL OR PART OF THE CREDIT THE MEMBER IS ELIGIBLE TO 333 PURCHASE UNDER THIS SECTION IN ONE OR MORE PAYMENTS. 334 (E) IF A MEMBER DIES OR WITHDRAWS FROM SERVICE, ANY 337 PAYMENT MADE BY THE MEMBER UNDER THIS SECTION SHALL BE CONSIDERED 338 AS ACCUMULATED CONTRIBUTIONS OF THE MEMBER. 339 (F) ON APPLICATION FOR AN ALLOWANCE UNDER SECTION 3307.38, 342 3307.39, 3307.41, 3307.43, OR 3307.431 OF THE REVISED CODE BY A 344 MEMBER WHO PURCHASED SERVICE CREDIT UNDER THIS SECTION, THE STATE 345 TEACHERS RETIREMENT SYSTEM SHALL REQUEST FROM THE FORMER 346 RETIREMENT SYSTEM AN AMOUNT OF EMPLOYER CONTRIBUTIONS EQUAL TO 347 THE AMOUNT THE MEMBER PAID UNDER THIS SECTION. 348 (G) THE BOARD SHALL ADOPT RULES TO IMPLEMENT THIS SECTION. 351 Sec. 3309.261. NOT LATER THAN TEN DAYS AFTER RECEIVING A 353 REQUEST FROM THE PUBLIC EMPLOYEES RETIREMENT SYSTEM UNDER 354 DIVISION (B) OF SECTION 145.2910 OR THE STATE TEACHERS RETIREMENT 357 SYSTEM UNDER DIVISION (B) OF SECTION 3307.413 OF THE REVISED 360 CODE, THE SCHOOL EMPLOYEES RETIREMENT SYSTEM SHALL CALCULATE AND 361 CERTIFY TO THE REQUESTING RETIREMENT SYSTEM HOW MUCH IT WOULD 362 COST A FORMER MEMBER WHO RECEIVED A REFUND UNDER SECTION 3309.42 363 OF THE REVISED CODE TO RESTORE SERVICE CREDIT UNDER SECTION 3309.26 OF THE REVISED CODE FOR EACH YEAR OR PORTION OF A YEAR 364 FOR WHICH THE FORMER MEMBER SEEKS TO PURCHASE SERVICE CREDIT 365 UNDER SECTION 145.2910 OR 3307.413 OF THE REVISED CODE. Sec. 3309.262. NOT LATER THAN TEN DAYS AFTER RECEIVING A 367 REQUEST FROM THE PUBLIC EMPLOYEES RETIREMENT SYSTEM UNDER 368 DIVISION (F) OF SECTION 145.2910 OR THE STATE TEACHERS RETIREMENT 371 SYSTEM UNDER DIVISION (F) OF SECTION 3307.413 OF THE REVISED 374 9 CODE, THE SCHOOL EMPLOYEES RETIREMENT SYSTEM SHALL TRANSFER TO 375 THE REQUESTING RETIREMENT SYSTEM AN AMOUNT FROM THE EMPLOYER'S 376 TRUST FUND EQUAL TO THE AMOUNT REQUESTED. 377 Sec. 3309.27. (A) The school employees retirement board 386maySHALL establish by rule payroll deduction plans for payment 387 of the following: 389 (1) The cost of restoring service credit under section 391 3309.26 of the Revised Code or purchasing any service credit 392 members of the school employees retirement system are eligible to 393 purchase under this chapter; 394 (2) Charges for participation in programs established 396 under section 3309.691 of the Revised Code. 397 (B) In addition to any other matter considered relevant by 399 the board, the rules adopted under this section shall specify all 400 of the following: 401 (1) The types of service credit that may be paid for 403 through payroll deduction, including the section of the Revised 404 Code that authorizes the purchase of each type of service credit 405 for which payment may be made by payroll deduction; 406 (2) The procedureto be followed by a member to inform his408 FOR INFORMING THE MEMBER'S employer and the system thatheTHE 411 MEMBER wishes to use payroll deduction to purchase service credit 413 or pay for participation in programs established under section 414 3309.691 of the Revised Code; (3) The procedure to be followed by the system and 416 employers to determine for each request the amount to be 417 deducted, the number of deductions to be made, and the interval 418 at which deductions will be made. The rules may provide for a 419 minimum amount for each deduction or a maximum number of 420 deductions for the purchase of any type of service credit. 421 (4) The procedure to be followed by employers in 423 transmitting amounts deducted from the compensation of their 424 employees to the system; 425 (5) The procedure to be followed by the system in 427 10 crediting service credit to members who choose to purchase it 428 through payroll deduction. 429 (C)If theTHE boardestablishes a payroll deduction plan431under this section, itshall certify to the member's employer, 432 for each member for whom deductions are to be made, the amount of 433 each deduction and the payrolls from which deductions are to be 434 made. (A) A MEMBER OF THE SCHOOL EMPLOYEES 458 RETIREMENT SYSTEM WHO IS A FORMER MEMBER OF THE PUBLIC EMPLOYEES 459 RETIREMENT SYSTEM OR STATE TEACHERS RETIREMENT SYSTEM AND HAS 460 RECEIVED A REFUND OF ACCUMULATED CONTRIBUTIONS UNDER SECTION 461 145.40 OR 3307.46 OF THE REVISED CODE MAY PURCHASE SERVICE CREDIT 463 FOR EACH YEAR OR PORTION OF A YEAR OF SERVICE FOR WHICH THE 465 REFUND WAS MADE. (B) A MEMBER SEEKING TO PURCHASE SERVICE CREDIT UNDER THIS 468 SECTION SHALL NOTIFY THE SCHOOL EMPLOYEES RETIREMENT SYSTEM ON A 469 FORM APPROVED BY THE SCHOOL EMPLOYEES RETIREMENT BOARD. NOT 470 LATER THAN TEN DAYS AFTER RECEIVING THE NOTICE, THE SCHOOL 471 EMPLOYEES RETIREMENT SYSTEM SHALL REQUEST THAT THE FORMER 472 11 RETIREMENT SYSTEM DETERMINE UNDER SECTION 145.311 OR 3307.282 OF 473 THE REVISED CODE HOW MUCH IT WOULD COST THE MEMBER TO RESTORE 474 SERVICE CREDIT UNDER SECTION 145.31 OR 3307.28 OF THE REVISED CODE FOR EACH YEAR OR PORTION OF A YEAR OF SERVICE FOR WHICH THE 475 MEMBER SEEKS TO PURCHASE CREDIT UNDER THIS SECTION. THE AMOUNT 476 THE FORMER RETIREMENT SYSTEM CERTIFIES AS THE COST OF RESTORING 477 THE SERVICE CREDIT IS THE COST TO THE MEMBER OF PURCHASING 478 SERVICE CREDIT UNDER THIS SECTION. ON RECEIVING CERTIFICATION OF 479 THE COST FROM THE FORMER RETIREMENT SYSTEM, THE STATE TEACHERS 480 RETIREMENT SYSTEM SHALL NOTIFY THE MEMBER OF THE AMOUNT CERTIFIED 481 BY THE FORMER SYSTEM. (C) FOR EACH YEAR OR PORTION OF A YEAR OF CREDIT PURCHASED 484 UNDER THIS SECTION, A MEMBER SHALL PAY TO THE SCHOOL EMPLOYEES 485 RETIREMENT SYSTEM THE AMOUNT CERTIFIED BY THE FORMER RETIREMENT 486 SYSTEM. (D) SUBJECT TO RULES ADOPTED BY THE BOARD, A MEMBER MAY 489 PURCHASE ALL OR PART OF THE CREDIT THE MEMBER IS ELIGIBLE TO 490 PURCHASE UNDER THIS SECTION IN ONE OR MORE PAYMENTS. 491 (E) IF A MEMBER DIES OR WITHDRAWS FROM SERVICE, ANY 494 PAYMENT MADE BY THE MEMBER UNDER THIS SECTION SHALL BE CONSIDERED 495 AS ACCUMULATED CONTRIBUTIONS OF THE MEMBER. 496 (F) ON APPLICATION FOR AN ALLOWANCE UNDER SECTION 3309.35, 499 3309.36, 3309.38, 3309.381, 3309.40, OR 3309.401 OF THE REVISED 502 CODE BY A MEMBER WHO PURCHASED SERVICE CREDIT UNDER THIS SECTION, 503 THE SCHOOL EMPLOYEES RETIREMENT SYSTEM SHALL REQUEST FROM THE 504 FORMER RETIREMENT SYSTEM AN AMOUNT OF EMPLOYER CONTRIBUTIONS 505 EQUAL TO THE AMOUNT THE MEMBER PAID UNDER THIS SECTION. 506 (G) THE BOARD SHALL ADOPT RULES TO IMPLEMENT THIS SECTION. 509 Section 2. That existing sections 145.294, 3307.281, and 512 3309.27 of the Revised Code are hereby repealed. 513
