No. 17 5 1999-2000 6 REPRESENTATIVES MOTTLEY-THOMAS-NETZLEY-PRINGLE-CORBIN-HOOD 8 9 A B I L L To amend sections 5.04 and 5.10 of the Revised Code 10 to add a representation of the Wright Brothers' 12 first piloted airplane to the Coat of Arms and 13 Great Seal of the State of Ohio. 14 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 16 Section 1. That sections 5.04 and 5.10 of the Revised Code 18 be amended to read as follows: 19 Sec. 5.04. The coat of arms of the state shall consist of 28 the following device: a circular shield; in the right foreground 29 of the shield a full sheaf of wheat bound and standing erect; in 30 the left foreground, a cluster of seventeen arrows bound in the 31 center and resembling in form the sheaf of wheat; in the 32 background, a representation of Mount Logan, Ross county, as viewed from Adena state memorial; over the mount, a rising sun 33 three-quarters exposed and radiating thirteen rays to represent 34 the thirteen original colonies shining over the first state in 35 the northwest territory, the exterior extremities of which rays 36 form a semicircle; ABOVE AND TO THE LEFT OF THE SUN, A 37 REPRESENTATION OF THE FIRST PILOTED AIRPLANE, FLOWN BY THE WRIGHT 38 BROTHERS IN 1903; and uniting the background and foreground, a 39 representation of the Scioto river and cultivated fields. 40 The coat of arms of the state shall correspond 42 substantially with the following design: 43 2 When the coat of arms of the state is reproduced in color, the 53 colors used shall be substantially the same as the natural color 54 of the terrain and objects shown. 55 Sec. 5.10. All official seals shall have engravedthereon64 ON THEM the coat of arms of the state, as described in section 66 5.04 of the Revised Code. 67 The great seal of the state shall be two and one-half 69 inches in diameter and shall consist of the coat of arms of the 70 state within a circle having a diameter of one and three-fourths 71 inches, surrounded by the words "THE GREAT SEAL OF THE STATE OF 72 OHIO" in news gothic capitals. The great seal of the state shall 73 correspond substantially with the following design: 74 The design of the great seal shall not be reproduced, 84 except as required by any provision of the Ohio Constitution and 85 the Revised Code, unless permission to do so is first obtained 86 from the governor. The governor may authorize reproduction of 87 the design of the great seal when the purpose is to: 88 (A) Permit publication of a reproduction of the great seal 90 of the state of Ohio; 91 (B) Aid educational or historical programs; 93 (C) Promote the economic or cultural development of the 95 3 state in a manner deemed appropriate by the governor. 96 A permanent record shall be kept in the governor's office 98 of each permit to reproduce the design of the great seal. 99 No person shall use or permit to be used any reproduction 101 or facsimile of the great seal or a counterfeit or nonofficial 102 version of the great seal for any purpose not authorized by the 103 governor. 104 The seal of the supreme court shall consist of the coat of 106 arms of the state within a circle one and three-fourths inches in 107 diameter and shall be surrounded by the words "THE SUPREME COURT 108 OF THE STATE OF OHIO." 109 The seal of each court of appeals, court of common pleas, 111 and probate court shall consist of the coat of arms of the state 112 within a circle one and one-fourth inches in diameter, and each 113 seal shall be surrounded by the words "COURT OF APPEALS, 114 ................ County, Ohio"; "COMMON PLEAS COURT, 115 ................ County, Ohio"; or "PROBATE COURT, 116 ................ County, Ohio." (Insert the name of the proper county.) 118 The seals of all other courts of record shall be of the 120 same size as the seal of the court of common pleas, and each 121 shall be surrounded by the proper name of the court. 122 The seal of the secretary of state shall consist of the 124 coat of arms of the state within a circle one and one-fourth 125 inches in diameter and shall be surrounded by the words "THE SEAL 126 OF THE SECRETARY OF STATE OF OHIO." 127 The seal of the auditor of state shall consist of the coat 129 of arms of the state within a circle of one and one-fourth inches 130 in diameter, and shall be surrounded by the words "THE SEAL OF 131 THE AUDITOR OF STATE OF OHIO." 132 The seal of the treasurer of state shall consist of the 134 coat of arms of the state within a circle one and one-fourth 135 inches in diameter, and shall be surrounded by the words "THE 136 SEAL OF THE TREASURER OF STATE OF OHIO." 137 4 The seal of the lieutenant governor shall consist of the 139 coat of arms of the state within a circle one and one-fourth 140 inches in diameter and shall be surrounded by the words "THE SEAL 141 OF THE LIEUTENANT GOVERNOR OF STATE OF OHIO." 142 The seal of the attorney general shall consist of the coat 144 of arms of the state within a circle one and one-fourth inches in 145 diameter and shall be surrounded by the words "THE SEAL OF THE 146 ATTORNEY GENERAL OF STATE OF OHIO." 147 The seal of each benevolent institution shall consist of 149 the coat of arms of the state within a circle one and one-fourth 150 inches in diameter and shall be surrounded by the proper name of 151 the institution. 152 The seals of all other state, county, and municipal 154 agencies, divisions, boards, and commissions shall consist of the 155 coat of arms of the state within a circle one and one-fourth 156 inches in diameter and shall be surrounded by the proper name of 157 the office. 158 All seals mentioned in this section shall contain the words 160 and devices mentioned in this section and no other. 161 Section 2. That existing sections 5.04 and 5.10 of the 163 Revised Code are hereby repealed. 164
