BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 13 Section 1. All items in this section are hereby 15 appropriated out of any moneys in the state treasury to the 16 credit of the designated fund. For all appropriations made in 17 this section, those in the first column are for fiscal year 2000, 18 and those in the second column are for fiscal year 2001. Section 2. Accounting 65 Within the limits set forth in this act, the Director of 67 Budget and Management shall establish accounts indicating the 68 source and amount of funds for each appropriation made in this 69 act and shall determine the form and manner in which 70 appropriation accounts shall be maintained. The appropriations made in this act are subject to all 72 provisions of the main operating appropriations act of the 123rd 73 General Assembly that are generally applicable to such 74 appropriations. 75 Section 3. Reissuance of Voided Warrants 77 In order to provide funds for the reissuance of voided 79 warrants pursuant to section 117.47 of the Revised Code, there is 80 hereby appropriated, out of moneys in the state treasury from the 81 fund credited as provided in section 117.47 of the Revised Code, 82 that amount sufficient to pay such warrants when approved by the 83 Office of Budget and Management. Section 4. Judgments Against State 85 Any appropriations contained in this act, except those to 87 be applied to or used for payment of guarantees by or on behalf 88 of the state or for debt service on bonds, notes, or certificates 89 of participation, may be used for the purpose of satisfying 91 judgments, settlements, or administrative awards ordered or 92 approved by the Court of Claims or any other court of competent jurisdiction in connection with civil actions against the state. 94 Section 5. Reappropriation of Unexpended Balances 96 Notwithstanding section 131.33 of the Revised Code, 98 3 unexpended balances of appropriations and reappropriations 99 against which encumbrances have been lawfully incurred by the 100 Industrial Commission are, at the close of fiscal years 1999 and 101 2000, to the extent of such encumbrances, hereby reappropriated 102 from the funds from which they were originally appropriated and 103 reappropriated and, except for encumbrances for items of special 104 order manufacture not available on term contract or open market, 105 made available for the purpose of discharging such encumbrances 106 for a period of five months from the end of the fiscal year. Unexpended balances of appropriations and reappropriations 107 against which encumbrances for items of special order manufacture 108 not available on term contract or in the open market have been 109 lawfully incurred are, at the close of the fiscal year, to the 110 extent of such encumbrances, hereby reappropriated and made 111 available for the purpose of discharging such encumbrances for a period of five months from the end of the fiscal year or, if the 112 Director of Budget and Management approves, for a period of not 113 more than twelve months from the end of the fiscal year. 114 Any items for which unexpended balances are reappropriated 116 beyond a five-month period from the end of the fiscal year shall 117 be reported to the Controlling Board by the Director of Budget 118 and Management. The report on each such item shall include the 119 item, the cost of the item, the vendor involved, and the delivery 120 date. Such reports to the board shall be updated on a quarterly basis while the encumbrance remains open. 121 After any such period, reappropriations made for the 123 purpose of discharging encumbrances for operating expenses, 124 defined as those encumbrances incurred for personal services, 125 maintenance, and equipment, are canceled. Reappropriations for 126 encumbrances other than operating expenses or items of special 127 manufacture not available on term contract or in the open market may be extended by obtaining the approval of the Director of 128 Budget and Management. 129 Section 6. Responsibilities of the Chairperson 131 4 The Chairperson of the Industrial Commission shall, on or 133 before January 31, 2000, and subsequently on or before July 31, 135 2000, January 31, 2001, and July 31, 2001, prepare and present a 136 report to the chairperson and ranking members of the standing 137 committees of the House of Representatives and Senate to which matters dealing with workers' compensation and the Industrial 138 Commission are normally referred, and to ranking members of both 139 committees. Each report shall contain information relative to 141 the number of cases disposed of in the preceding six-month 142 period, the number of cases pending, and the number of cases on 143 appeal as well as the efforts the Commission has made in maintaining and improving communication with the Administrator of 144 Workers' Compensation and the Bureau of Workers' Compensation. 145 Section 7. Independent and Severable Items 147 If any item of law that constitutes the whole or part of a 150 codified or uncodified section of law contained in this act, or if any application of any item of law that constitutes the whole 151 or part of a codified or uncodified section of law contained in 152 this act, is held invalid, the invalidity does not affect other 153 items of law or applications of items of law that can be given 154 effect without the invalid item of law or application. To this 155 end, the items of law of which the codified and uncodified 156 sections of law contained in this act are composed, and their 157 applications, are independent and severable. Section 8. Effective Date 159 Except as otherwise specifically provided in this act, the 161 uncodified sections of law contained in this act, and the items 163 of law of which the uncodified sections of law contained in this 164 act are composed, are not subject to the referendum. Therefore, 165 under Ohio Constitution, Article II, Section 1d and section 1.471 167 of the Revised Code, the uncodified sections of law contained in 168 this act, and the items of law of which the uncodified sections 169 of law contained in this act are composed, go into immediate 170 effect when this act becomes law. 171
