BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 15 Section 1. All items in this section are hereby 17 appropriated out of any moneys in the state treasury to the 18 credit of the designated fund. For all appropriations made in 19 this section, those in the first column are for fiscal year 2000, 20 and those in the second column are for fiscal year 2001. Service Account 58 The foregoing appropriation item 845-605, Service Account, 60 shall be used for any expense related to revenues collected and 61 deposited in Fund 821, such as coin copier expense, coin changer 63 purchases, expenses related to conferences that produce revenue, 64 publications that produce revenue, and replacement of furniture 65 and equipment. Section 2. Accounting 67 Within the limits set forth in this act, the Director of 69 Budget and Management shall establish accounts indicating the 70 source and amount of funds for each appropriation made in this 71 act and shall determine the form and manner in which 72 appropriation accounts shall be maintained. The appropriations made in this act are subject to all 74 provisions of the main operating appropriations act of the 123rd 75 General Assembly that are generally applicable to such 76 appropriations. 77 Section 3. Reissuance of Voided Warrants 79 In order to provide funds for the reissuance of voided 81 warrants pursuant to section 117.47 of the Revised Code, there is 82 hereby appropriated, out of moneys in the state treasury from the 83 fund credited as provided in section 117.47 of the Revised Code, 84 that amount sufficient to pay such warrants when approved by the 85 Office of Budget and Management. Section 4. Judgments Against State 87 Any appropriations contained in this act, except those to 89 be applied to or used for payment of guarantees by or on behalf 90 of the state or for debt service on bonds, notes, or certificates 91 of participation, may be used for the purpose of satisfying 93 judgments, settlements, or administrative awards ordered or 94 approved by the Court of Claims or any other court of competent jurisdiction in connection with civil actions against the state. 96 3 Section 5. Reappropriation of Unexpended Balances 98 Notwithstanding section 131.33 of the Revised Code, 100 unexpended balances of appropriations and reappropriations 101 against which encumbrances have been lawfully incurred by the 102 Industrial Commission are, at the close of fiscal years 1999 and 103 2000, to the extent of such encumbrances, hereby reappropriated 104 from the funds from which they were originally appropriated and 105 reappropriated and, except for encumbrances for items of special 106 order manufacture not available on term contract or open market, 107 made available for the purpose of discharging such encumbrances 108 for a period of five months from the end of the fiscal year. Unexpended balances of appropriations and reappropriations 109 against which encumbrances for items of special order manufacture 110 not available on term contract or in the open market have been 111 lawfully incurred are, at the close of the fiscal year, to the 112 extent of such encumbrances, hereby reappropriated and made 113 available for the purpose of discharging such encumbrances for a period of five months from the end of the fiscal year or, if the 114 Director of Budget and Management approves, for a period of not 115 more than twelve months from the end of the fiscal year. 116 Any items for which unexpended balances are reappropriated 118 beyond a five-month period from the end of the fiscal year shall 119 be reported to the Controlling Board by the Director of Budget 120 and Management. The report on each such item shall include the 121 item, the cost of the item, the vendor involved, and the delivery 122 date. Such reports to the board shall be updated on a quarterly basis while the encumbrance remains open. 123 After any such period, reappropriations made for the 125 purpose of discharging encumbrances for operating expenses, 126 defined as those encumbrances incurred for personal services, 127 maintenance, and equipment, are canceled. Reappropriations for 128 encumbrances other than operating expenses or items of special 129 manufacture not available on term contract or in the open market may be extended by obtaining the approval of the Director of 130 4 Budget and Management. 131 Section 6. Responsibilities of the Chairperson 133 The Chairperson of the Industrial Commission shall, on or 135 before January 31, 2000, and subsequently on or before July 31, 137 2000, January 31, 2001, and July 31, 2001, prepare and present a 138 report to the chairperson and ranking members of the standing 139 committees of the House of Representatives and Senate to which matters dealing with workers' compensation and the Industrial 140 Commission are normally referred, and to ranking members of both 141 committees. Each report shall contain information relative to 143 the number of cases disposed of in the preceding six-month 144 period, the number of cases pending, and the number of cases on 145 appeal as well as the efforts the Commission has made in maintaining and improving communication with the Administrator of 146 Workers' Compensation and the Bureau of Workers' Compensation. 147 Section 7. Independent and Severable Items 149 If any item of law that constitutes the whole or part of a 152 codified or uncodified section of law contained in this act, or if any application of any item of law that constitutes the whole 153 or part of a codified or uncodified section of law contained in 154 this act, is held invalid, the invalidity does not affect other 155 items of law or applications of items of law that can be given 156 effect without the invalid item of law or application. To this 157 end, the items of law of which the codified and uncodified 158 sections of law contained in this act are composed, and their 159 applications, are independent and severable. Section 8. Effective Date 161 Except as otherwise specifically provided in this act, the 163 uncodified sections of law contained in this act, and the items 165 of law of which the uncodified sections of law contained in this 166 act are composed, are not subject to the referendum. Therefore, 167 under Ohio Constitution, Article II, Section 1d and section 1.471 169 of the Revised Code, the uncodified sections of law contained in 170 this act, and the items of law of which the uncodified sections 171 5 of law contained in this act are composed, go into immediate 172 effect when this act becomes law. 173
