BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 16 Section 1. All items in this section are hereby 18 appropriated out of any moneys in the state treasury to the 19 credit of the designated fund. For all appropriations made in 20 this section, those in the first column are for fiscal year 2000, 21 and those in the second column are for fiscal year 2001. Service Account 59 The foregoing appropriation item 845-605, Service Account, 61 shall be used for any expense related to revenues collected and 62 deposited in Fund 821, such as coin copier expense, coin changer 64 purchases, expenses related to conferences that produce revenue, 65 publications that produce revenue, and replacement of furniture 66 and equipment. Section 2. Accounting 68 Within the limits set forth in this act, the Director of 70 Budget and Management shall establish accounts indicating the 71 source and amount of funds for each appropriation made in this 72 act and shall determine the form and manner in which 73 appropriation accounts shall be maintained. The appropriations made in this act are subject to all 75 provisions of the main operating appropriations act of the 123rd 76 General Assembly that are generally applicable to such 77 appropriations. 78 Section 3. Reissuance of Voided Warrants 80 In order to provide funds for the reissuance of voided 82 warrants pursuant to section 117.47 of the Revised Code, there is 83 hereby appropriated, out of moneys in the state treasury from the 84 fund credited as provided in section 117.47 of the Revised Code, 85 that amount sufficient to pay such warrants when approved by the 86 Office of Budget and Management. Section 4. Judgments Against State 88 Any appropriations contained in this act, except those to 90 be applied to or used for payment of guarantees by or on behalf 91 of the state or for debt service on bonds, notes, or certificates 92 of participation, may be used for the purpose of satisfying 94 judgments, settlements, or administrative awards ordered or 95 approved by the Court of Claims or any other court of competent 3 jurisdiction in connection with civil actions against the state. 97 Section 5. Reappropriation of Unexpended Balances 99 Notwithstanding section 131.33 of the Revised Code, 101 unexpended balances of appropriations and reappropriations 102 against which encumbrances have been lawfully incurred by the 103 Industrial Commission are, at the close of fiscal years 1999 and 104 2000, to the extent of such encumbrances, hereby reappropriated 105 from the funds from which they were originally appropriated and 106 reappropriated and, except for encumbrances for items of special 107 order manufacture not available on term contract or open market, 108 made available for the purpose of discharging such encumbrances 109 for a period of five months from the end of the fiscal year. Unexpended balances of appropriations and reappropriations 110 against which encumbrances for items of special order manufacture 111 not available on term contract or in the open market have been 112 lawfully incurred are, at the close of the fiscal year, to the 113 extent of such encumbrances, hereby reappropriated and made 114 available for the purpose of discharging such encumbrances for a period of five months from the end of the fiscal year or, if the 115 Director of Budget and Management approves, for a period of not 116 more than twelve months from the end of the fiscal year. 117 Any items for which unexpended balances are reappropriated 119 beyond a five-month period from the end of the fiscal year shall 120 be reported to the Controlling Board by the Director of Budget 121 and Management. The report on each such item shall include the 122 item, the cost of the item, the vendor involved, and the delivery 123 date. Such reports to the board shall be updated on a quarterly basis while the encumbrance remains open. 124 After any such period, reappropriations made for the 126 purpose of discharging encumbrances for operating expenses, 127 defined as those encumbrances incurred for personal services, 128 maintenance, and equipment, are canceled. Reappropriations for 129 encumbrances other than operating expenses or items of special 130 manufacture not available on term contract or in the open market 4 may be extended by obtaining the approval of the Director of 131 Budget and Management. 132 Section 6. Responsibilities of the Chairperson 134 The Chairperson of the Industrial Commission shall, on or 136 before January 31, 2000, and subsequently on or before July 31, 138 2000, January 31, 2001, and July 31, 2001, prepare and present a 139 report to the chairperson and ranking members of the standing 140 committees of the House of Representatives and Senate to which matters dealing with workers' compensation and the Industrial 141 Commission are normally referred, and to ranking members of both 142 committees. Each report shall contain information relative to 144 the number of cases disposed of in the preceding six-month 145 period, the number of cases pending, and the number of cases on 146 appeal as well as the efforts the Commission has made in maintaining and improving communication with the Administrator of 147 Workers' Compensation and the Bureau of Workers' Compensation. 148 Section 7. Independent and Severable Items 150 If any item of law that constitutes the whole or part of a 153 codified or uncodified section of law contained in this act, or if any application of any item of law that constitutes the whole 154 or part of a codified or uncodified section of law contained in 155 this act, is held invalid, the invalidity does not affect other 156 items of law or applications of items of law that can be given 157 effect without the invalid item of law or application. To this 158 end, the items of law of which the codified and uncodified 159 sections of law contained in this act are composed, and their 160 applications, are independent and severable. Section 8. Effective Date 162 Except as otherwise specifically provided in this act, the 164 uncodified sections of law contained in this act, and the items 166 of law of which the uncodified sections of law contained in this 167 act are composed, are not subject to the referendum. Therefore, 168 under Ohio Constitution, Article II, Section 1d and section 1.471 170 of the Revised Code, the uncodified sections of law contained in 171 5 this act, and the items of law of which the uncodified sections 172 of law contained in this act are composed, go into immediate 173 effect when this act becomes law. 174
