All items in this section are hereby 19 appropriated out of any moneys in the state treasury to the 20 credit of the designated fund. For all appropriations made in 21 this section, those in the first column are for fiscal year 2000, 22 and those in the second column are for fiscal year 2001. Service Account 60 The foregoing appropriation item 845-605, Service Account, 62 shall be used for any expense related to revenues collected and 63 deposited in Fund 821, such as coin copier expense, coin changer 65 purchases, expenses related to conferences that produce revenue, 66 publications that produce revenue, and replacement of furniture 67 and equipment. Section 2. Accounting 69 Within the limits set forth in this act, the Director of 71 Budget and Management shall establish accounts indicating the 72 source and amount of funds for each appropriation made in this 73 act and shall determine the form and manner in which 74 appropriation accounts shall be maintained. The appropriations made in this act are subject to all 76 provisions of the main operating appropriations act of the 123rd 77 General Assembly that are generally applicable to such 78 appropriations. 79 Section 3. Reissuance of Voided Warrants 81 In order to provide funds for the reissuance of voided 83 warrants pursuant to section 117.47 of the Revised Code, there is 84 hereby appropriated, out of moneys in the state treasury from the 85 fund credited as provided in section 117.47 of the Revised Code, 86 that amount sufficient to pay such warrants when approved by the 87 Office of Budget and Management. Section 4. Judgments Against State 89 Any appropriations contained in this act, except those to 91 be applied to or used for payment of guarantees by or on behalf 92 of the state or for debt service on bonds, notes, or certificates 93 of participation, may be used for the purpose of satisfying 95 judgments, settlements, or administrative awards ordered or 96 3 approved by the Court of Claims or any other court of competent jurisdiction in connection with civil actions against the state. 98 Section 5. Reappropriation of Unexpended Balances 100 Notwithstanding section 131.33 of the Revised Code, 102 unexpended balances of appropriations and reappropriations 103 against which encumbrances have been lawfully incurred by the 104 Industrial Commission are, at the close of fiscal years 1999 and 105 2000, to the extent of such encumbrances, hereby reappropriated 106 from the funds from which they were originally appropriated and 107 reappropriated and, except for encumbrances for items of special 108 order manufacture not available on term contract or open market, 109 made available for the purpose of discharging such encumbrances 110 for a period of five months from the end of the fiscal year. Unexpended balances of appropriations and reappropriations 111 against which encumbrances for items of special order manufacture 112 not available on term contract or in the open market have been 113 lawfully incurred are, at the close of the fiscal year, to the 114 extent of such encumbrances, hereby reappropriated and made 115 available for the purpose of discharging such encumbrances for a period of five months from the end of the fiscal year or, if the 116 Director of Budget and Management approves, for a period of not 117 more than twelve months from the end of the fiscal year. 118 Any items for which unexpended balances are reappropriated 120 beyond a five-month period from the end of the fiscal year shall 121 be reported to the Controlling Board by the Director of Budget 122 and Management. The report on each such item shall include the 123 item, the cost of the item, the vendor involved, and the delivery 124 date. Such reports to the board shall be updated on a quarterly basis while the encumbrance remains open. 125 After any such period, reappropriations made for the 127 purpose of discharging encumbrances for operating expenses, 128 defined as those encumbrances incurred for personal services, 129 maintenance, and equipment, are canceled. Reappropriations for 130 encumbrances other than operating expenses or items of special 131 4 manufacture not available on term contract or in the open market may be extended by obtaining the approval of the Director of 132 Budget and Management. 133 Section 6. Responsibilities of the Chairperson 135 The Chairperson of the Industrial Commission shall, on or 137 before January 31, 2000, and subsequently on or before July 31, 139 2000, January 31, 2001, and July 31, 2001, prepare and present a 140 report to the chairperson and ranking members of the standing 141 committees of the House of Representatives and Senate to which matters dealing with workers' compensation and the Industrial 142 Commission are normally referred, and to ranking members of both 143 committees. Each report shall contain information relative to 145 the number of cases disposed of in the preceding six-month 146 period, the number of cases pending, and the number of cases on 147 appeal as well as the efforts the Commission has made in maintaining and improving communication with the Administrator of 148 Workers' Compensation and the Bureau of Workers' Compensation. 149 Section 7. Independent and Severable Items 151 If any item of law that constitutes the whole or part of a 154 codified or uncodified section of law contained in this act, or if any application of any item of law that constitutes the whole 155 or part of a codified or uncodified section of law contained in 156 this act, is held invalid, the invalidity does not affect other 157 items of law or applications of items of law that can be given 158 effect without the invalid item of law or application. To this 159 end, the items of law of which the codified and uncodified 160 sections of law contained in this act are composed, and their 161 applications, are independent and severable. Section 8. Effective Date 163 Except as otherwise specifically provided in this act, the 165 uncodified sections of law contained in this act, and the items 167 of law of which the uncodified sections of law contained in this 168 act are composed, are not subject to the referendum. Therefore, 169 under Ohio Constitution, Article II, Section 1d and section 1.471 171 5 of the Revised Code, the uncodified sections of law contained in 172 this act, and the items of law of which the uncodified sections 173 of law contained in this act are composed, go into immediate 174 effect when this act becomes law. 175
