A B I L L
To amend section 4121.06 of the Revised Code to 16
revise the meeting requirements of the Services
Committee of the Workers' Compensation System and 17
to make appropriations for the Industrial
Commission for the biennium beginning July 1, 19
1999, and ending June 30, 2001.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 20
Section 1. That section 4121.06 of the Revised Code be 22
amended to read as follows: 23
Sec. 4121.06. (A) There is hereby created the services 32
committee of the workers' compensation system, consisting of one 33
member of the bureau of workers' compensation appointed by the 34
administrator of workers' compensation, one member of the 35
industrial commission, appointed by the CHAIRPERSON OF THE 36
commission, and one member appointed by the governor, who shall 38
serve as chairman CHAIRPERSON of the committee. 39
(B) The committee shall meet at least monthly and other 41
times upon the request of the CHAIRPERSON OF THE commission or 42
the administrator, or at the call of the chairman. The committee 45
shall:
(1) Provide a formal avenue to coordinate the provision of 47
data processing, mail room, and facilities management services 48
between the bureau and the commission; 49

(2) Resolve conflicts between the bureau and commission; 51
(3) Assure that the bureau and commission data processing 53
and facilities needs are coordinated and integrated. 54
Section 2. That existing section 4121.06 of the Revised 56
Code is hereby repealed. 57
Section 3. All items in this section are hereby 59
appropriated out of any moneys in the state treasury to the 60
credit of the designated fund. For all appropriations made in 61
this section, those in the first column are for fiscal year 2000, 62
and those in the second column are for fiscal year 2001.

Rent - William Green Building 94
The foregoing appropriation item 845-402, Rent - William 96
Green Building, shall be used for rent and operating expenses for 97
the space occupied by the Industrial Commission in the William 98
Green Building.
Service Account 100
The foregoing appropriation item 845-605, Service Account, 102
shall be used for any expense related to revenues collected and 103
deposited in Fund 821, such as coin copier expense, coin changer 105
purchases, expenses related to conferences that produce revenue, 106
publications that produce revenue, and replacement of furniture 107
and equipment.

Section 4. Accounting 109
Within the limits set forth in this act, the Director of 111
Budget and Management shall establish accounts indicating the 112
source and amount of funds for each appropriation made in this 113
act and shall determine the form and manner in which 114
appropriation accounts shall be maintained.
The appropriations made in this act are subject to all 116
provisions of the main operating appropriations act of the 123rd 117
General Assembly that are generally applicable to such 118
appropriations. 119
Section 5. Reissuance of Voided Warrants 121
In order to provide funds for the reissuance of voided 123
warrants pursuant to section 117.47 of the Revised Code, there is 124
hereby appropriated, out of moneys in the state treasury from the 125
fund credited as provided in section 117.47 of the Revised Code, 126
that amount sufficient to pay such warrants when approved by the 127
Office of Budget and Management.
Section 6. Judgments Against State 129
Any appropriations contained in this act, except those to 131
be applied to or used for payment of guarantees by or on behalf 132
of the state or for debt service on bonds, notes, or certificates 133
of participation, may be used for the purpose of satisfying 135
judgments, settlements, or administrative awards ordered or 136
approved by the Court of Claims or any other court of competent
jurisdiction in connection with civil actions against the state. 138
Section 7. Reappropriation of Unexpended Balances 140
Notwithstanding section 131.33 of the Revised Code, 142
unexpended balances of appropriations and reappropriations 143
against which encumbrances have been lawfully incurred by the 144
Industrial Commission are, at the close of fiscal years 1999 and 145
2000, to the extent of such encumbrances, hereby reappropriated 146
from the funds from which they were originally appropriated and 147
reappropriated and, except for encumbrances for items of special 148
order manufacture not available on term contract or open market, 149

made available for the purpose of discharging such encumbrances 150
for a period of five months from the end of the fiscal year.
Unexpended balances of appropriations and reappropriations 151
against which encumbrances for items of special order manufacture 152
not available on term contract or in the open market have been 153
lawfully incurred are, at the close of the fiscal year, to the 154
extent of such encumbrances, hereby reappropriated and made 155
available for the purpose of discharging such encumbrances for a
period of five months from the end of the fiscal year or, if the 156
Director of Budget and Management approves, for a period of not 157
more than twelve months from the end of the fiscal year. 158
Any items for which unexpended balances are reappropriated 160
beyond a five-month period from the end of the fiscal year shall 161
be reported to the Controlling Board by the Director of Budget 162
and Management. The report on each such item shall include the 163
item, the cost of the item, the vendor involved, and the delivery 164
date. Such reports to the board shall be updated on a quarterly
basis while the encumbrance remains open. 165
After any such period, reappropriations made for the 167
purpose of discharging encumbrances for operating expenses, 168
defined as those encumbrances incurred for personal services, 169
maintenance, and equipment, are canceled. Reappropriations for 170
encumbrances other than operating expenses or items of special 171
manufacture not available on term contract or in the open market
may be extended by obtaining the approval of the Director of 172
Budget and Management. 173
Section 8. Responsibilities of the Chairperson 175
The Chairperson of the Industrial Commission shall, on or 177
before January 31, 2000, and subsequently on or before July 31, 179
2000, January 31, 2001, and July 31, 2001, prepare and present a 180
report to the chairperson and ranking members of the standing 181
committees of the House of Representatives and Senate to which
matters dealing with workers' compensation and the Industrial 182
Commission are normally referred, and to ranking members of both 183

committees. Each report shall contain information relative to 185
the number of cases disposed of in the preceding six-month 186
period, the number of cases pending, and the number of cases on 187
appeal as well as the efforts the Commission has made in
maintaining and improving communication with the Administrator of 188
Workers' Compensation and the Bureau of Workers' Compensation. 189
Section 9. Independent and Severable Items 191
If any item of law that constitutes the whole or part of a 194
codified or uncodified section of law contained in this act, or
if any application of any item of law that constitutes the whole 195
or part of a codified or uncodified section of law contained in 196
this act, is held invalid, the invalidity does not affect other 197
items of law or applications of items of law that can be given 198
effect without the invalid item of law or application. To this 199
end, the items of law of which the codified and uncodified 200
sections of law contained in this act are composed, and their 201
applications, are independent and severable.
Section 10. Effective Date 203
Except as otherwise specifically provided in this act, the 205
uncodified sections of law contained in this act, and the items 207
of law of which the uncodified sections of law contained in this 208
act are composed, are not subject to the referendum. Therefore, 209
under Ohio Constitution, Article II, Section 1d and section 1.471 211
of the Revised Code, the uncodified sections of law contained in 212
this act, and the items of law of which the uncodified sections 213
of law contained in this act are composed, go into immediate 214
effect when this act becomes law. 215
