A B I L L
To amend section 4121.06 of the Revised Code to 17
revise the meeting requirements of the Services
Committee of the Workers' Compensation System and 18
to make appropriations for the Industrial
Commission for the biennium beginning July 1, 20
1999, and ending June 30, 2001.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 21
Section 1. That section 4121.06 of the Revised Code be 23
amended to read as follows: 24
Sec. 4121.06. (A) There is hereby created the services 33
committee of the workers' compensation system, consisting of one 34
member of the bureau of workers' compensation appointed by the 35
administrator of workers' compensation, one member of the 36
industrial commission, appointed by the CHAIRPERSON OF THE 37
commission, and one member appointed by the governor, who shall 39
serve as chairman CHAIRPERSON of the committee. 40
(B) The committee shall meet at least monthly and other 42
times upon the request of the CHAIRPERSON OF THE commission or 43
the administrator, or at the call of the chairman. The committee 46
shall:
(1) Provide a formal avenue to coordinate the provision of 48
data processing, mail room, and facilities management services 49

between the bureau and the commission; 50
(2) Resolve conflicts between the bureau and commission; 52
(3) Assure that the bureau and commission data processing 54
and facilities needs are coordinated and integrated. 55
Section 2. That existing section 4121.06 of the Revised 57
Code is hereby repealed. 58
Section 3. All items in this section are hereby 60
appropriated out of any moneys in the state treasury to the 61
credit of the designated fund. For all appropriations made in 62
this section, those in the first column are for fiscal year 2000, 63
and those in the second column are for fiscal year 2001.

Rent - William Green Building 95
The foregoing appropriation item 845-402, Rent - William 97
Green Building, shall be used for rent and operating expenses for 98
the space occupied by the Industrial Commission in the William 99
Green Building.
Service Account 101
The foregoing appropriation item 845-605, Service Account, 103
shall be used for any expense related to revenues collected and 104
deposited in Fund 821, such as coin copier expense, coin changer 106
purchases, expenses related to conferences that produce revenue, 107
publications that produce revenue, and replacement of furniture 108

and equipment.
Section 4. Accounting 110
Within the limits set forth in this act, the Director of 112
Budget and Management shall establish accounts indicating the 113
source and amount of funds for each appropriation made in this 114
act and shall determine the form and manner in which 115
appropriation accounts shall be maintained.
The appropriations made in this act are subject to all 117
provisions of the main operating appropriations act of the 123rd 118
General Assembly that are generally applicable to such 119
appropriations. 120
Section 5. Reissuance of Voided Warrants 122
In order to provide funds for the reissuance of voided 124
warrants pursuant to section 117.47 of the Revised Code, there is 125
hereby appropriated, out of moneys in the state treasury from the 126
fund credited as provided in section 117.47 of the Revised Code, 127
that amount sufficient to pay such warrants when approved by the 128
Office of Budget and Management.
Section 6. Judgments Against State 130
Any appropriations contained in this act, except those to 132
be applied to or used for payment of guarantees by or on behalf 133
of the state or for debt service on bonds, notes, or certificates 134
of participation, may be used for the purpose of satisfying 136
judgments, settlements, or administrative awards ordered or 137
approved by the Court of Claims or any other court of competent
jurisdiction in connection with civil actions against the state. 139
Section 7. Reappropriation of Unexpended Balances 141
Notwithstanding section 131.33 of the Revised Code, 143
unexpended balances of appropriations and reappropriations 144
against which encumbrances have been lawfully incurred by the 145
Industrial Commission are, at the close of fiscal years 1999 and 146
2000, to the extent of such encumbrances, hereby reappropriated 147
from the funds from which they were originally appropriated and 148
reappropriated and, except for encumbrances for items of special 149

order manufacture not available on term contract or open market, 150
made available for the purpose of discharging such encumbrances 151
for a period of five months from the end of the fiscal year.
Unexpended balances of appropriations and reappropriations 152
against which encumbrances for items of special order manufacture 153
not available on term contract or in the open market have been 154
lawfully incurred are, at the close of the fiscal year, to the 155
extent of such encumbrances, hereby reappropriated and made 156
available for the purpose of discharging such encumbrances for a
period of five months from the end of the fiscal year or, if the 157
Director of Budget and Management approves, for a period of not 158
more than twelve months from the end of the fiscal year. 159
Any items for which unexpended balances are reappropriated 161
beyond a five-month period from the end of the fiscal year shall 162
be reported to the Controlling Board by the Director of Budget 163
and Management. The report on each such item shall include the 164
item, the cost of the item, the vendor involved, and the delivery 165
date. Such reports to the board shall be updated on a quarterly
basis while the encumbrance remains open. 166
After any such period, reappropriations made for the 168
purpose of discharging encumbrances for operating expenses, 169
defined as those encumbrances incurred for personal services, 170
maintenance, and equipment, are canceled. Reappropriations for 171
encumbrances other than operating expenses or items of special 172
manufacture not available on term contract or in the open market
may be extended by obtaining the approval of the Director of 173
Budget and Management. 174
Section 8. Responsibilities of the Chairperson 176
The Chairperson of the Industrial Commission shall, on or 178
before January 31, 2000, and subsequently on or before July 31, 180
2000, January 31, 2001, and July 31, 2001, prepare and present a 181
report to the chairperson and ranking members of the standing 182
committees of the House of Representatives and Senate to which
matters dealing with workers' compensation and the Industrial 183

Commission are normally referred, and to ranking members of both 184
committees. Each report shall contain information relative to 186
the number of cases disposed of in the preceding six-month 187
period, the number of cases pending, and the number of cases on 188
appeal as well as the efforts the Commission has made in
maintaining and improving communication with the Administrator of 189
Workers' Compensation and the Bureau of Workers' Compensation. 190
Section 9. Independent and Severable Items 192
If any item of law that constitutes the whole or part of a 195
codified or uncodified section of law contained in this act, or
if any application of any item of law that constitutes the whole 196
or part of a codified or uncodified section of law contained in 197
this act, is held invalid, the invalidity does not affect other 198
items of law or applications of items of law that can be given 199
effect without the invalid item of law or application. To this 200
end, the items of law of which the codified and uncodified 201
sections of law contained in this act are composed, and their 202
applications, are independent and severable.
Section 10. Effective Date 204
Except as otherwise specifically provided in this act, the 206
uncodified sections of law contained in this act, and the items 208
of law of which the uncodified sections of law contained in this 209
act are composed, are not subject to the referendum. Therefore, 210
under Ohio Constitution, Article II, Section 1d and section 1.471 212
of the Revised Code, the uncodified sections of law contained in 213
this act, and the items of law of which the uncodified sections 214
of law contained in this act are composed, go into immediate 215
effect when this act becomes law. 216
