To amend section 5512.07 and to enact sections 15
5533.40, 5533.41, 5533.51, and 5533.52 of the 16
Revised Code to designate United States Route 23, 17
from the junction with Interstate Route 475 to
the Michigan border, as the "General Walter 18
Churchill Highway"; to modify the conflict of 19
interest standards applicable to members of the
Transportation Review Advisory Council; to 21
designate United States Route 36, between the
municipal corporation of Coshocton and the 22
boundary of Coshocton and Tuscarawas counties, as 23
the "William Green Memorial Highway"; to 25
designate State Route 800, within the community
of Hendrysburg in Belmont County only, as the 26
"William 'Hopalong Cassidy' Boyd Memorial 27
Highway"; and to designate United States Route 28
36, between the boundary of Coshocton and 29
Tuscarawas counties and Interstate 77, and 30
between the boundary of Champaign and Miami
counties and the Indiana border the "Korean War 31
Veterans' Memorial Highway."
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 33
Section 1. That section 5512.07 be amended and sections 35

5533.40, 5533.41, 5533.51, and 5533.52 of the Revised Code be 36
enacted to read as follows: 37
Sec. 5512.07. (A) There is hereby created the 46
transportation review advisory council. No member of the general 47
assembly shall be a member of the council. The council shall 48
consist of nine members, one of whom is the director of 49
transportation. Six members shall be appointed by the governor 50
with the advice and consent of the senate. One member shall be 52
appointed by the speaker of the house of representatives and one 53
member shall be appointed by the president of the senate. In 54
making their appointments, the governor, the speaker of the house 55
of representatives, and the president of the senate shall consult 56
with each other so that of the total number of eight appointed 57
members, at least two are affiliated with the major political 58
party not represented by the governor. In making the governor's 59
appointments, the governor shall appoint persons who reside in 60
different geographic areas of the state. Within ninety days 61
after June 30, 1997, the governor, speaker, and president shall 64
make the initial appointments to the council.
Appointed members shall have no conflict of interest with 66
the position and shall be capable of performing the duties of the 67
council with impartiality. For purposes of this section, 69
conflicts "CONFLICT of interest may include, but are not limited 71
to, employment by or on behalf of, affiliation with, or public
advocacy of a new highway capacity project under consideration 72
for possible approval by the council" MEANS TAKING ANY ACTION 73
THAT VIOLATES ANY PROVISION OF CHAPTER 102. OR 2921. OF THE 74
REVISED CODE.
Each of the members the governor appoints shall have 76
experience either in the area of transportation or in that of 79
business or economic development. 80
One such member shall be selected from a list of five names 82
provided by the Ohio public expenditure council. 83
(B) Of the governor's initial appointments made to the 86

council, one shall be for a term ending one year after June 30, 87
1997, one shall be for a term ending two years after June 30, 89
1997, one shall be for a term ending four years after June 30, 92
1997, and one shall be for a term ending five years after June 94
30, 1997. Within ninety days after the effective date of this 95
amendment SEPTEMBER 16, 1998, the governor shall make two 97
appointments to the council. Of these appointments, one shall be 98
for a term ending June 30, 2001, and one shall be for a term
ending June 30, 2002. The speaker's and president's initial 100
appointments made to the council shall be for a term ending three 101
years after June 30, 1997. Thereafter, all terms of office, 103
including the terms for those persons who are appointed to
succeed the persons whose appointments are made within ninety 104
days after the effective date of this amendment SEPTEMBER 16, 106
1998, shall be for five years, with each term ending on the same 108
day of the same month as did the term that it succeeds. Each 109
member shall hold office from the date of appointment until the 110
end of the term for which the member was appointed. Members may 111
be reappointed. Vacancies shall be filled in the manner provided 112
for original appointments. Any member appointed to fill another 113
member's unexpired term shall hold office for the remainder of
that unexpired term. A member shall continue in office 114
subsequent to the expiration of the member's term until the 116
member's successor takes office.
(C) The director of transportation is the chairperson of 119
the council.
Sec. 5533.40. THE ROAD KNOWN AS STATE ROUTE NUMBER EIGHT 121
HUNDRED, WITHIN THE COMMUNITY OF HENDRYSBURG IN BELMONT COUNTY 123
ONLY, SHALL BE KNOWN AS THE "WILLIAM 'HOPALONG CASSIDY' BOYD 125
MEMORIAL HIGHWAY."
THE DIRECTOR OF TRANSPORTATION MAY ERECT SUITABLE MARKERS 127
ALONG THE HIGHWAY INDICATING ITS NAME. 128
Sec. 5533.41. THAT PORTION OF THE ROAD KNOWN AS UNITED 131
STATES ROUTE NUMBER TWENTY-THREE, RUNNING IN A NORTH AND SOUTH

Sec. 5533.52. AT BOTH OF THE FOLLOWING LOCATIONS, THE ROAD 150

"KOREAN WAR VETERANS' MEMORIAL HIGHWAY": 153

Section 2. That existing section 5512.07 of the Revised 165
Code is hereby repealed. 166
