             To authorize the conveyance of state-owned real       13           

                estate in Franklin County from the Department of   14           

                Mental Retardation and Developmental Disabilities               

                to the Friendship Missionary Baptist Church.       15           




BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:        17           

      Section 1.  The Governor is hereby authorized to execute a   19           

deed in the name of the state conveying to the Friendship          20           

Missionary Baptist Church, and its successors and assigns, all of  22           

the state's right, title, and interest in the following described  23           

real estate:                                                                    

      SITUATE in the State of Ohio, County of Franklin, City of    25           

Columbus, in Lot No. 1 of M. L. Sullivants Subdivision of Farming  26           

lands, Virginia Military Survey No. 2668, and being a part of the  27           

land conveyed to the State of Ohio by deeds of record in Deed      28           

Book 82, Page 582, and in Deed Book 126, Page 227, Recorders                    

Office, Franklin County, Ohio, and being more particularly         29           

described as follows:                                              30           

      Beginning for reference at a northeast corner of a 5.513     32           

acre tract, conveyed to the Friendship Missionary Baptist Church   33           

by deed of record in Official Record 2118, Page A19, Recorders     36           

Office, Franklin County, Ohio, said reference point being on the   37           

west LA ROW of the Interstate Route 70: thence South 08° 56' 14"                

West, a distance of 168.36 feet, and South 45° 21' 29" West, a     38           

distance of 115.79 feet along the southeast line of said 5.513     39

acre tract to a found iron pin at the TRUE POINT OF BEGINNING,     40           

said beginning reference point being 0.04 ft south and 0.06 ft     41           

east of a found iron pin; thence across said State of Ohio lands   42           

the following five courses,                                                     

South 55° 28' 04" West, a distance of 47.66 feet to a set iron     44           

pin; thence                                                        45           

North 77° 47' 26" West, a distance of 327.41 feet to a set iron    47           

pin; thence                                                        48           

North 77° 08' 04" West, a distance of 127.97 feet to a set iron    50           

pin; thence                                                        51           

North 17° 36' 46" West, a distance of 365.05 feet to a found iron  53           

pin on the southwest line of said 5.513 acre tract, being South    54           

54° 50' 42" East, a distance of 142.18 feet from the southwest     55           

corner of said 5.513 acre tract; thence with said southwest line   56           

and a southwest line of a 0.131 acre tract conveyed by deed of     57           

record in Official Record 23524, Page E13,                                      

South 54° 50' 42" East, a distance of 727.10 feet to the TRUE      59           

POINT OF BEGINNING, passing found iron pins on corners of said     60           

0.131 acre tract at 141.11 feet and 265.57 feet, containing 2.031  61           

acres more or less, and being subject however to all legal         62           

easements of record.                                                            

      This description was prepared from surveys made in           64           

September 1993 and April 1998 by Robert G. Watts, RPLS #4138.      65           

Bearings are based on a bearing of South 54° 35' 57" East for the  66           

common line found on the State of Ohio, Department of              67           

Transportation Right-of-Way plan for I-70, Franklin County,                     

FRA-70-10.36 S, Sheets numbered 251/255 & 11/15. and 252/255 &     68           

12/15, and in the deed for said 5.513 acre tract.  Set iron pins   69           

are 5/8"x30" rebars with yellow plastic caps embossed "Thomas      70           

Engr & Surveying".                                                              

      Section 2.  Consideration for the conveyance of the real     72           

estate described in Section 1 of this act is the purchase price    73           

of twenty thousand dollars to be paid by the Friendship            74           

Missionary Baptist Church.

      Section 3.  Upon payment of the purchase price, the Auditor  76           

of State, with the assistance of the Attorney General, shall       77           

prepare a deed to the real estate.  The deed shall state the       78           

consideration.  The deed shall be executed by the Governor in the  79           

name of the state, countersigned by the Secretary of State,                     

sealed with the great seal of the state, presented in the office   80           

of the Auditor of State for recording, and delivered to the        81           

Friendship Missionary Baptist Church.  The Friendship Missionary   82           

Baptist Church shall present the deed for recording in the office  85           

of the Franklin County Recorder.                                                

      Section 4.  The Friendship Missionary Baptist Church shall   87           

pay the costs of the conveyance of the real estate.                89           

      Section 5.  The net proceeds of the conveyance of the real   91           

estate described in Section 1 of this act shall be deposited in    92           

the State Treasury to the credit of the Miscellaneous Revenue      93           

Fund 152 and shall be for the use of the Columbus Developmental    94           

Center.                                                                         

      Section 6.  This act shall expire one year after its         96           

effective date.
