             To authorize the conveyance of state-owned real       15           

                estate in Franklin County from the Department of   16           

                Mental Retardation and Developmental Disabilities               

                to the Friendship Missionary Baptist Church.       17           




BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:        19           

      Section 1.  The Governor is hereby authorized to execute a   21           

deed in the name of the state conveying to the Friendship          22           

Missionary Baptist Church, and its successors and assigns, all of  24           

the state's right, title, and interest in the following described  25           

real estate:                                                                    

      SITUATE in the State of Ohio, County of Franklin, City of    27           

Columbus, in Lot No. 1 of M. L. Sullivants Subdivision of Farming  28           

lands, Virginia Military Survey No. 2668, and being a part of the  29           

land conveyed to the State of Ohio by deeds of record in Deed      30           

Book 82, Page 582, and in Deed Book 126, Page 227, Recorders                    

Office, Franklin County, Ohio, and being more particularly         31           

described as follows:                                              32           

      Beginning for reference at a northeast corner of a 5.513     34           

acre tract, conveyed to the Friendship Missionary Baptist Church   35           

by deed of record in Official Record 2118, Page A19, Recorders     38           

Office, Franklin County, Ohio, said reference point being on the   39           

west LA ROW of the Interstate Route 70: thence South 08° 56' 14"                

West, a distance of 168.36 feet, and South 45° 21' 29" West, a     40

distance of 115.79 feet along the southeast line of said 5.513     41           

acre tract to a found iron pin at the TRUE POINT OF BEGINNING,     42           

said beginning reference point being 0.04 ft south and 0.06 ft     43           

east of a found iron pin; thence across said State of Ohio lands   44           

the following five courses,                                                     

South 55° 28' 04" West, a distance of 47.66 feet to a set iron     46           

pin; thence                                                        47           

North 77° 47' 26" West, a distance of 327.41 feet to a set iron    49           

pin; thence                                                        50           

North 77° 08' 04" West, a distance of 127.97 feet to a set iron    52           

pin; thence                                                        53           

North 17° 36' 46" West, a distance of 365.05 feet to a found iron  55           

pin on the southwest line of said 5.513 acre tract, being South    56           

54° 50' 42" East, a distance of 142.18 feet from the southwest     57           

corner of said 5.513 acre tract; thence with said southwest line   58           

and a southwest line of a 0.131 acre tract conveyed by deed of     59           

record in Official Record 23524, Page E13,                                      

South 54° 50' 42" East, a distance of 727.10 feet to the TRUE      61           

POINT OF BEGINNING, passing found iron pins on corners of said     62           

0.131 acre tract at 141.11 feet and 265.57 feet, containing 2.031  63           

acres more or less, and being subject however to all legal         64           

easements of record.                                                            

      This description was prepared from surveys made in           66           

September 1993 and April 1998 by Robert G. Watts, RPLS #4138.      67           

Bearings are based on a bearing of South 54° 35' 57" East for the  68           

common line found on the State of Ohio, Department of              69           

Transportation Right-of-Way plan for I-70, Franklin County,                     

FRA-70-10.36 S, Sheets numbered 251/255 & 11/15. and 252/255 &     70           

12/15, and in the deed for said 5.513 acre tract.  Set iron pins   71           

are 5/8"x30" rebars with yellow plastic caps embossed "Thomas      72           

Engr & Surveying".                                                              

      Section 2.  Consideration for the conveyance of the real     74           

estate described in Section 1 of this act is the purchase price    75           

of twenty thousand dollars to be paid by the Friendship            76

Missionary Baptist Church.                                                      

      Section 3.  Upon payment of the purchase price, the Auditor  78           

of State, with the assistance of the Attorney General, shall       79           

prepare a deed to the real estate.  The deed shall state the       80           

consideration.  The deed shall be executed by the Governor in the  81           

name of the state, countersigned by the Secretary of State,                     

sealed with the great seal of the state, presented in the office   82           

of the Auditor of State for recording, and delivered to the        83           

Friendship Missionary Baptist Church.  The Friendship Missionary   84           

Baptist Church shall present the deed for recording in the office  87           

of the Franklin County Recorder.                                                

      Section 4.  The Friendship Missionary Baptist Church shall   89           

pay the costs of the conveyance of the real estate.                91           

      Section 5.  The net proceeds of the conveyance of the real   93           

estate described in Section 1 of this act shall be deposited in    94           

the State Treasury to the credit of the Miscellaneous Revenue      95           

Fund 152 and shall be for the use of the Columbus Developmental    96           

Center.                                                                         

      Section 6.  This act shall expire one year after its         98           

effective date.
