A B I L L
To amend sections 325.03, 325.04, 325.06, 325.071, 12
325.08, 325.09, 325.10, 325.11, 325.111, 325.12, 13
325.14, 325.15, 505.24, and 507.09, to enact new 14
section 325.18, and to repeal section 325.18 of 17
the Revised Code to provide a 3% compensation 18
increase to nonjudicial county elected officials 19
in 2001; to reduce the number of population
classifications used to determine the 20
compensation of those officials beginning in
2001; to provide a cost-of-living increase capped 21
at 3% for calendar years 2002 and thereafter for 22
all of those officials except county auditors; to
provide a cost-of-living increase capped at 3% 23
for calendar year 2003 and thereafter for county
auditors, township trustees, and township clerks; 24
and to require that certain county elected 25
officials receive the increase in compensation in
2001 based on additional responsibilities. 26
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 28
Section 1. That sections 325.03, 325.04, 325.06, 325.071, 31
325.08, 325.09, 325.10, 325.11, 325.111, 325.12, 325.14, 325.15, 32
505.24, and 507.09 be amended and new section 325.18 of the 33
Revised Code be enacted to read as follows: 34
Sec. 325.03. Each county auditor shall be classified, for 46
salary purposes, according to the population of the county. All 47

(B) IN ADDITION TO THE ANNUAL compensation that the A 387
sheriff receives under this section for performing the duties of 388
sheriff prescribed by law, each sheriff shall receive, beginning 390
on March 1, 1996, in consideration of the impact of Amended 391
Substitute Senate Bill No. 2 of the 121st general assembly on the 393
workload of the sheriff, an additional amount equal to one-eighth 394
of the annual compensation that the sheriff receives under 395
DIVISION (A) OF this section AND SECTION 325.18 OF THE REVISED 396
CODE. This additional compensation shall be paid biweekly from 398
the county treasury if adequate funds have been appropriated by 399
the general assembly. The attorney general shall certify to the 400
fiscal officer of each county whether adequate funds have been 402
appropriated for the purposes of this division. Within fifteen 403
days after the end of the months of March, June, September, and 404
December of each year, the fiscal officer of the county shall 405
certify to the attorney general the amount of additional 406
compensation paid under THIS division (C) of this section and, 407
the related amount of employer contributions made under Chapter 408
145. of the Revised Code as required by the public employees 410

retirement board, AND THE RELATED AMOUNT OF THE PAYMENTS TO THE 411
SOCIAL SECURITY ADMINISTRATION FOR EMPLOYER CONTRIBUTIONS FOR 412
MEDICARE PART B. The attorney general shall determine the 413
accuracy of the amount AMOUNTS so certified and shall cause 414
payment to be made to the fiscal officer, who shall deposit the 415
revenue in the county general fund. 416
Sec. 325.071. There shall be allowed annually to the 425
county sheriff, in addition to all salary and allowances 426
otherwise provided by law, an amount equal to one-half of the 427
official salary allowed under divisions (A) and (B) of section 429
SECTIONS 325.06 AND 325.18 of the Revised Code, to provide for 431
expenses that the sheriff incurs in the performance of the 433
sheriff's official duties and in the furtherance of justice. 434
Upon the order of the county sheriff, the county auditor shall 436
draw the auditor's warrant on the county treasurer, payable to 438
the county sheriff or any other person as the order designates, 440
for the amount the order requires. The amounts the order 441
requires, not exceeding the amount provided by this section, 442
shall be paid out of the general fund of the county. 443
Nothing shall be paid under this section until the county 445
sheriff gives bond to the state in an amount not less than the 447
sheriff's official salary, to be fixed by the court of common 449
pleas or the probate court, with sureties to be approved by 450
either of those courts. The bond shall be conditioned that the 451
sheriff will faithfully discharge all the duties enjoined upon 452
the sheriff, and pay over all moneys the sheriff receives in an 455
official capacity. The bond, with the approval of the court of 456
common pleas or the probate court of the amount of the bond and 457
THE sureties on the bond, shall be deposited with the county 458
treasurer.
The county sheriff annually, before the first Monday of 460
January, shall file with the county auditor an itemized 461
statement, verified by the sheriff, as to the manner in which the 462
fund provided by this section has been expended during the 463

current year, and, if any part of that fund remains in the 465
sheriff's hands unexpended, forthwith shall pay the remainder 466
into the county treasury.
Sec. 325.08. Each clerk of the court of common pleas shall 475
be classified, for salary purposes, according to the population 476
of the county. All such clerks of the court of common pleas 477
shall receive annual compensation in accordance with the 478
following schedules AND IN ACCORDANCE WITH SECTION 325.18 OF THE 480

A prosecuting attorney may elect to engage or not to engage 1,054
in the private practice of law before the commencement of each 1,055
new term of office, and a prosecuting attorney who engages in the 1,056
private practice of law who intends not to engage in the private 1,057
practice of law during the prosecuting attorney's next term of 1,058
office shall so notify the board of county commissioners. A 1,060
prosecuting attorney who elects not to engage in the private 1,061
practice of law may, for a period of six months after taking 1,062
office, engage in the private practice of law for the purpose of 1,063

concluding the affairs of private practice of law without any 1,064
diminution of salary as provided for in division (B)(A) of this 1,065
section AND IN SECTION 325.18 OF THE REVISED CODE. 1,066
(C) As used in this section, "salary" does not include any 1,068
portion of the cost, premium, or charge for health, medical, 1,069
hospital, dental, or surgical benefits, or any combination 1,070
thereof OF THOSE BENEFITS, covering the prosecuting attorney and 1,071
paid on that person's behalf by a governmental entity. 1,073
Sec. 325.111. (A) As used in this section, "population 1,082
class" means a population class specified in division (A) of 1,083
section 325.11 of the Revised Code. 1,084
(B)(1) A prosecuting attorney in a county included in 1,086
population class 1, 2, 3, or 4 shall not engage in the private 1,087
practice of law unless, before taking office, the prosecuting 1,088
attorney notifies the board of county commissioners of the county 1,090
of the prosecuting attorney's intention to engage in the private
practice of law. 1,091
(2) A prosecuting attorney in a county included in 1,093
population class 1 or 2 who does not engage in the private 1,094
practice of law shall be paid, in lieu of the amount specified in 1,095
division (B)(1) of section 325.11 of the Revised Code, eighty per 1,097
cent of the annual salary specified for the appropriate year in 1,098
division (B)(2) of that section, in equal biweekly installments. 1,099
(3) A prosecuting attorney in a county included in 1,101
population class 3 or 4 who does not engage in the private 1,103
practice of law shall be paid, in lieu of the amount specified in 1,104
division (B)(1) of section 325.11 of the Revised Code, ninety per 1,106
cent of the annual salary specified for the appropriate year in 1,107
division (B)(2) of that section, in equal biweekly installments. 1,108
(C) A prosecuting attorney subject to division (B)(1) of 1,110
this section may elect to engage or not to engage in the private 1,111
practice of law before the commencement of each new term of 1,112
office, and a prosecuting attorney who engages in the private 1,113
practice of law but who intends not to engage in the private 1,114

practice of law during the next term of office shall so notify 1,116
the board of county commissioners. A prosecuting attorney who
elects not to engage in the private practice of law may engage in 1,117
the private practice of law for a period of six months after 1,118
taking office, without any diminution of the salary as provided 1,119
for in division (B) of this section, for the purpose of 1,120
concluding the affairs of the private practice of law.
(D) If the prosecuting attorney in a county included in 1,122
WITH A population class 1, 2, 3, or 4 OF LESS THAN SEVENTY 1,124
THOUSAND ONE elects not to engage in the private practice of law, 1,125
forty per cent of the difference between the compensation as a 1,127
prosecuting attorney who elects not to engage in the private 1,128
practice of law and the compensation for a prosecuting attorney 1,129
in a county included in the same population class who engages in 1,131
the private practice of law shall be paid as additional 1,133
compensation TO THE GENERAL FUND OF THE COUNTY from the state 1,134
treasury from funds appropriated to the attorney general for that 1,135
THE purpose OF REIMBURSING THE COUNTY FOR A PART OF THE COST OF 1,136
PAYING THE COMPENSATION TO THE PROSECUTING ATTORNEY ELECTING NOT 1,137
TO ENGAGE IN THE PRIVATE PRACTICE OF LAW. This amount shall be 1,139
paid in equal monthly installments. WITHIN FIFTEEN DAYS AFTER 1,140
THE END OF THE MONTHS OF MARCH, JUNE, SEPTEMBER, AND DECEMBER OF 1,141
EACH YEAR, THE FISCAL OFFICER OF THE COUNTY SHALL CERTIFY TO THE 1,142
ATTORNEY GENERAL THE AMOUNT OF COMPENSATION PAID UNDER THIS 1,143
SECTION, THE RELATED AMOUNT OF EMPLOYER CONTRIBUTIONS MADE UNDER 1,144
CHAPTER 145. OF THE REVISED CODE AS REQUIRED BY THE PUBLIC 1,145
EMPLOYEES RETIREMENT BOARD, AND THE RELATED AMOUNT OF THE
PAYMENTS TO THE SOCIAL SECURITY ADMINISTRATION FOR EMPLOYER 1,146
CONTRIBUTIONS FOR MEDICARE PART B. THE ATTORNEY GENERAL SHALL 1,147
DETERMINE THE ACCURACY OF THE AMOUNTS SO CERTIFIED AND SHALL 1,148
CAUSE PAYMENT TO BE MADE TO THE FISCAL OFFICER, WHO SHALL DEPOSIT 1,149
THE REVENUE IN THE COUNTY GENERAL FUND. 1,150
Sec. 325.12. (A) Except for the prosecuting attorney of a 1,159
county included in WITH A population class 1, 2, 3, or 4 as 1,160

specified in section 325.11 of the Revised Code OF LESS THAN 1,162
SEVENTY THOUSAND ONE, there shall be allowed annually to the 1,164
prosecuting attorney, in addition to the prosecuting attorney's 1,165
salary PROVIDED BY SECTIONS 325.11 AND 325.18 OF THE REVISED CODE 1,166
and to the allowance provided for by section 309.06 of the 1,168
Revised Code, an amount equal to one-half of the official salary
the prosecuting attorney receives, to provide for expenses the 1,170
prosecuting attorney may incur in the performance of the 1,171
prosecuting attorney's official duties and in the furtherance of 1,172

(B) THERE shall be allowed annually to the prosecuting 1,177

325.18 OF THE REVISED CODE and to the allowance provided for by 1,184
section 309.06 of the Revised Code, an amount equal to one-half 1,185
of the salary specified for the A prosecuting attorney's office 1,187
ATTORNEY WITH A PRIVATE PRACTICE under division (B)(1) of section 1,188
SECTIONS 325.11 AND 325.18 of the Revised Code, to provide for 1,189
expenses the prosecuting attorney may incur in the performance of 1,191
the prosecuting attorney's official duties and in the furtherance 1,192
of justice. Upon 1,194
(C) UPON the order of the prosecuting attorney, the county 1,197
auditor shall draw the county auditor's warrant on the county 1,198
treasurer, payable to the prosecuting attorney or such ANY other 1,199
person as the order designates, for such THE amount as the order 1,201
requires, not exceeding the amount provided by DIVISION (A) OR 1,203
(B) OF this section to be paid out of the general fund of the 1,204

(D) Nothing shall be paid under this section until the 1,207
prosecuting attorney has given bond to the state in a sum, not 1,209
less than the prosecuting attorney's official salary, to be fixed 1,211
by the court of common pleas or the probate court, with sureties

to be approved by either of such THOSE courts, and such. THE 1,213
bond shall be conditioned that the prosecuting attorney will 1,215
faithfully discharge all the duties enjoined upon the prosecuting 1,216
attorney, and pay over all moneys received by the prosecuting 1,217
attorney in the prosecuting attorney's official capacity. Such 1,218

receipts from motor vehicle licenses, as distributed by section 1,361
4501.04 of the Revised Code, and the county's share of the fund 1,362
derived from the motor vehicle fuel tax, as distributed by 1,363
section 5735.27 of the Revised Code, as the board of county 1,364
commissioners directs, upon the warrant of the county auditor and 1,365
shall be in lieu of all fees, costs, per diem or other 1,366
allowances, and all other perquisites, of whatever kind, which 1,367
any engineer collects and receives. The engineer shall be the 1,368
county tax map draftperson, but shall receive no additional 1,369
compensation for performing the duties of such THAT position. 1,370
When such THE engineer performs service in connection with 1,372
ditches or drainage works, the engineer shall charge and collect 1,373
the per diem allowances or other fees provided by law and shall 1,374
pay all such OF THOSE allowances and fees, monthly, into the 1,375
county treasury to the credit of the general county fund. The 1,376
engineer shall pay into the county treasury all allowances and 1,377
fees collected when the engineer performs services under sections 1,378
315.28 to 315.34 of the Revised Code.
(B)(1) Notwithstanding division (A) of this section, the 1,380
annual compensation for each county engineer shall be as follows: 1,381
(a) In calendar year 1985, the amount of the annual salary 1,383
each such officer is entitled to receive under the 1984 schedule 1,384
increased by five per cent; 1,385
(b) In calendar year 1986, the annual compensation 1,387
determined under division (B)(1)(a) of this section for calendar 1,388
year 1985 increased by five per cent; 1,389
(c) In calendar year 1987, the annual compensation 1,391

(C) Whenever members of a board of township trustees are 1,818
compensated per diem and not by annual salary, the board shall 1,819
establish, by resolution, a method by which each member of the 1,820
board shall periodically notify the township clerk of the number 1,821
of days spent in the service of the township and the kinds of 1,822
services rendered on those days. The per diem compensation shall 1,823
be paid from the township general fund or from such other 1,824
township funds in such proportions as the kinds of services 1,825
performed may require. The notice shall be filed with the 1,826
township clerk and preserved for inspection by any persons 1,827
interested. 1,828
By unanimous vote, a board of township trustees may adopt a 1,830
method of compensation consisting of an annual salary to be paid 1,831

in equal monthly payments. If the office of trustee is held by 1,832
more than one person during any calendar year, each person 1,833
holding the office shall receive payments for only those months, 1,834
and any fractions thereof OF THOSE MONTHS, during which the 1,835
person holds the office. The amount of the annual salary 1,838
approved by the board shall be no more than the maximum amount 1,839
that could be received annually by a trustee if the trustee were 1,840
paid on a per diem basis as specified in this division, and shall 1,842
be paid from the township general fund or from such other 1,843
township funds in such proportions as the board may specify by 1,844
resolution. A board of township trustees which THAT has adopted 1,846
a salary method of compensation may return to a method of 1,847
compensation on a per diem basis as specified in this division by 1,848
a majority vote. Any change in the method of compensation shall 1,849
be effective on the first day of January of the year following 1,850
the year during which the board has voted to change the method of 1,851
compensation.
Sec. 507.09. (A) Except as otherwise provided in division 1,860
(D) of this section, the township clerk shall be entitled to 1,861
compensation as follows: 1,862
(1) In townships having a budget of fifty thousand dollars 1,864
or less, three thousand five hundred dollars; 1,865
(2) In townships having a budget of more than fifty 1,867
thousand but not more than one hundred thousand dollars, five 1,868

(B) Any township clerk may elect to receive less than the 1,901
compensation the clerk is entitled to under division (A) of this 1,903
section. Any clerk electing to do this shall so notify the board 1,904
of township trustees in writing, and the board shall include this 1,905
notice in the minutes of its next board meeting. 1,906
(C) The compensation of the township clerk shall be paid 1,908
in equal monthly payments. If the office of clerk is held by 1,909
more than one person during any calendar year, each person 1,910
holding the office shall receive payments for only those months, 1,911
and any fractions thereof OF THOSE MONTHS, during which the 1,912
person holds the office. 1,914
(D) In BEGINNING IN calendar years YEAR 1999, 2000, 2001, 1,917
and 2002, the township clerk shall be entitled to compensation as 1,919
follows:
(1) In calendar year 1999, the compensation specified in 1,921
division (A) of this section increased by three per cent; 1,922
(2) In calendar year 2000, the compensation determined 1,924

Section 2. That existing sections 325.03, 325.04, 325.06, 1,945
325.071, 325.08, 325.09, 325.10, 325.11, 325.111, 325.12, 325.14, 1,946
325.15, 505.24, and 507.09 and section 325.18 of the Revised Code 1,947
are hereby repealed. 1,948
Section 3. The annual compensation for calendar year 2001 1,950
provided for county auditors in section 325.03 of the Revised 1,951
Code, as amended by this act, for county treasurers in section 1,952
325.04 of the Revised Code, as amended by this act, and for 1,953
county commissioners in section 325.10 of the Revised Code, as
amended by this act, shall be paid to all of those county 1,954
officers beginning on January 1, 2001, in consideration of the 1,956
impact on the workload of those officers resulting from the 1,957
enactment of various legislative measures by the Congress of the 1,958
United States and the General Assembly. In the case of county
auditors and county treasurers, the compensation payable 1,959
beginning on January 1, 2001, is in particular consideration of 1,960
the impact on the workload of these county officers resulting 1,961
from the enactment of Am. Sub. S.B. 142 of the 122nd General 1,962
Assembly. In the case of county commissioners, including the
county commissioners whose term of office began on January 1, 1,963
1999, the compensation payable beginning on January 1, 2001, is 1,964
in particular consideration of the impact on the workload of 1,965
these county officers resulting from the enactment of the federal 1,966
Workforce Investment Act, 112 Stat. 936 (1998), 29 U.S.C.A. 2801, 1,967
and the enactment of the authority to levy a permissive 1,968

manufactured home transfer tax under section 322.06 of the 1,969
Revised Code, as enacted by Am. Sub. S.B. 142 of the 122nd 1,970
General Assembly.
