             To enact section 4731.227 of the Revised Code to      12           

                permit physicians to use alternative medical       13           

                treatments if the risk of harm is  reasonable      14           

                when compared to the potential benefit, the        16           

                patient provides informed consent,  and the        17           

                treatment is consistent with the standards         19           

                enforced by the State Medical  Board.              20           




BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:        21           

      Section 1.  That section 4731.227 of the Revised Code be     23           

enacted to read as follows:                                        24           

      Sec. 4731.227.  AS USED IN THIS SECTION, "ALTERNATIVE        26           

MEDICAL TREATMENT" MEANS A TREATMENT THAT DIFFERS FROM TREATMENTS  28           

USED IN STANDARD OR PREVAILING APPROACHES IN MEDICINE BUT IS       29           

REASONABLE WHEN ITS POTENTIAL BENEFITS ARE COMPARED TO THE RISK    30           

OF HARM.                                                                        

      AN INDIVIDUAL AUTHORIZED TO PRACTICE MEDICINE AND SURGERY    32           

OR OSTEOPATHIC MEDICINE AND SURGERY MAY USE ALTERNATIVE MEDICAL    33           

TREATMENTS IF THE PATIENT PROVIDES INFORMED CONSENT AND THE        34           

TREATMENT IS CONSISTENT WITH SECTION 4731.22 OF THE REVISED CODE.  35
