No. 155 5 1999-2000 6 SENATORS DRAKE-LATTA 8 _________________________________________________________________ 10 A B I L L To authorize the conveyance of state-owned real 12 estate located in Cuyahoga County to the Village 13 of Chagrin Falls. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 15 Section 1. The Governor is hereby authorized to execute a 17 deed in the name of the state conveying to the Village of Chagrin 18 Falls and its successors and assigns all of the state's right, 19 title, and interest in the following described real estate: 20 Situate in the State of Ohio, being in the Village of Chagrin 22 Falls, Cuyahoga County, State of Ohio, being a part of Township 7 23 North, Range 9 West and further known as formerly being a part of 24 Lot No. 17, Champion Tract No. 3, Russell Township, Geauga 25 County, Ohio, also being those lands conveyed by Charlotte 26 Burnard, et vir to the State of Ohio by Deeds of Record in Deed 27 Volume 460, Page 253 and in Deed Volume 2033, Page 14, Recorder's 28 Office, Cuyahoga County, Ohio and being more particularly 29 described as follows: "Beginning at a point in the center of Cleveland Street 4 chains, 30 50 links south-easterly from the intersection of the center of 31 Cleveland Street with the center of Front and Bell Street. 32 Thence S. 82° 35' E. three (3) Chains and 30 links, Thence S. 88° 33 24' E. four (4) chains and 60 links, Thence S. 61° 54' E. three 34 (3) chains, Thence S. 9° 33' W. two (2) chains and 96 links, 35 Thence N. 49° 21' W. two (2) chains and 21 links, Thence N. 86° 36 28' W. six (6) chains and 94 links to the center of Cleveland 37 Street, Thence N. 26° W. along the center of Cleveland St., three 38 2 (3) chains and 35 links to the place of beginning, containing two 39 and six hundred and ninety six one thousands (2 696/1000) acres 40 of land as surveyed by W.F. Haskins." Subject, however to all 41 legal highways. The aforedescribed parcel is recorded in Deed 42 Volume 460, Page 253, Cuyahoga County Records." 43 Parcel One: 44 "Beginning at a point in the North-easterly line of Cleveland 45 Street where the most Southerly line of the land conveyed by this 46 grantor, Charlotte Burnard to the State of Ohio, by Deed of 47 warranty dated Oct. 23rd, 1889, and recorded in Volume 460, Page 48 253 of Cuyahoga County Records, intersects with the said 49 North-easterly line of Cleveland Street; thence South 86 deg. 21' 50 E. along the Southerly line of land so conveyed to the State of Ohio, three hundred and seventy-two (372) feet to a stake; thence 51 in a South-westerly direction, in a straight line, to a point in 52 the North-east line of Cleveland Street, distance one hundred and 53 nineteen (119) feet South-easterly, measured along the 54 North-easterly line of said Cleveland Street, from the place of 55 beginning; thence North 26 deg. W. along the North-easterly line 56 of Cleveland Street one hundred and nineteen (119) feet to the 57 place of beginning." 58 Parcel Two. 59 "Beginning at a stone monument in the most Southeasterly point of 60 land conveyed by Charlotte Burnard and husband to the State of 61 Ohio, by deed dated October 23rd, 1889 and recorded in vol. 460, 62 Page 253 of Cuyahoga County Records of Deeds; thence North 9 deg. 63 33' E along the Easterly line of said land so conveyed to the 64 State of Ohio, two chains and ninety-six links to land conveyed 65 by Charlotte Burnard and husband to John Forsythe by deed dated 66 Nov. 2nd, 1893 and recorded in Volume 565, Page 197 of Cuyahoga 67 County Records of Deeds; thence South-easterly along the 68 South-westerly line of said land so conveyed to John Forsythe to 69 the Westerly line of a parcel of land conveyed by William H. Barber and wife to John Forsythe by deed dated June 3rd, 1878 and 70 3 recorded in Vol. 298, Page 6 of Cuyahoga County Records of Deeds; 71 thence S. 89 deg. 50' E along the Southerly line of land so 72 conveyed to John Forsythe by Wm. G. Barber and wife 1 chain 90 73 links to the Westerly line of a parcel of land conveyed by Wm. G. 74 Barber and wife to Henry Sencabaugh by deed dated Sept. 22nd, 75 1882 and recorded in Vol. 341, Page 262 of Cuyahoga County 76 Records of Deeds; thence Southerly 3 deg. 25' E. along said 77 westerly line one chain and 88 links to a stake and stones; 78 thence Southerly 81 deg. 45' E. along the Southerly line of land 79 conveyed to Henry Sencabaugh 3 chains and 71 links to the westerly line of a parcel of land conveyed by Oliver S. Granger 80 and wife to Olney N. Overton by deed dated April 20th, 1885 and 81 recorded in Vol. 382, Page 68 of Cuyahoga County Record of Deeds; 82 thence Southerly along said Westerly line, 3 deg. 16' E. four 83 chains and 17 links to that point in said westerly line where 84 same is intersected by the Northerly line of a parcel of land 85 conveyed by Charlotte Burnard and husband to W.H. Leach and Addie 86 Leach, by deed dated January 8th, 1894, and recorded in Vol. 566, 87 Page 286 of Cuyahoga County Records of Deeds, thence 88 North-westerly along the said Northerly line of land conveyed to W.H. Leach and Addie Leach, sixty-five feet, to the North-west 89 corner of said parcel; thence North-westerly, in a straight line, 90 to the point of beginning, be the same more or less but subject 91 to all legal highways." 92 The aforedescribed Parcels One and Two are described in Deed 93 Volume 2033, Page 14, Recorder's Office, Cuyahoga County, Ohio. 94 The aforedescribed Parcels One and Two contain, respectively 0.4 95 Acre and 2.1 Acres, for a total acreage of approximately 5.2 96 Acres, more or less. 97 The aforegoing descriptions were quoted from the descriptions as 98 recorded in Deed Volume 460, Page 253 and in Deed Volume 2033, 99 Page 14, Recorder's Office, Cuyahoga County, Ohio. 100 Further reference is made to File No. 5626 on file in the offices 101 of the Ohio Department of Administrative Services, General 102 4 Services Division, Real Estate Services, 4200 Surface Road, 103 Columbus, Ohio 43228-1395" 104 Section 2. Consideration for conveyance of the real estate 106 described in Section 1 of this act is the purchase price of 107 twenty thousand dollars. Section 3. Upon payment of the purchase price, the Auditor 109 of State, with the assistance of the Attorney General, shall 110 prepare a deed to the real estate. The deed shall state the 111 consideration. The deed shall be executed by the Governor in the 112 name of the state, countersigned by the Secretary of State, sealed with the Great Seal of the State, presented in the Office 113 of the Auditor of State for recording, and delivered to the 114 Village of Chagrin Falls. The Village of Chagrin Falls shall 115 present the deed for recording in the Office of the Cuyahoga 116 County Recorder. Section 4. The Village of Chagrin Falls shall pay the 118 costs of the conveyance of the real estate. 119 Section 5. This act expires one year after its effective 121 date.
