                          A   B I L L                                           

             To amend section 5571.01 and to repeal section        12           

                5571.17 of the Revised Code to specifically        13           

                permit a board of township trustees, at township                

                road intersections, to erect and maintain          14           

                suitable signposts and to purchase or lease and    16           

                erect and maintain suitable traffic control                     

                devices and traffic control signals.               17           




BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:        18           

      Section 1.  That section 5571.01 of the Revised Code be      20           

amended to read as follows:                                        21           

      Sec. 5571.01.  (A)  The A board of township trustees may     30           

construct, reconstruct, resurface, or improve any public road or   32           

part thereof under its jurisdiction, or any county road,           33           

intercounty highway, or state highway within its township.  In     35           

the case of a county road, the plans and specifications for the                 

proposed improvement shall first SHALL be submitted to the board   37           

of county commissioners of the county and receive its approval,    39           

and in.  IN the case of an intercounty or state highway, THE       41           

plans and specifications shall first SHALL be submitted to the     42           

director of transportation and receive his THE DIRECTOR'S          43           

approval.  The board of township trustees may widen, straighten,   44           

or change the direction of any part of a road in connection with   46           

the proceedings for its improvement.                                            

      (B)  The board of township trustees may construct, improve,  48           

maintain, or repair the berm of any road under its jurisdiction,   49           

in order to provide a hard surface or other improved approach to   50

rural mail boxes located on public highways.                       51           

      (C)  A BOARD OF TOWNSHIP TRUSTEES, IN CONFORMITY WITH THE    54           

MANUAL AND UNIFORM SYSTEM OF TRAFFIC CONTROL DEVICES ADOPTED       55           

UNDER SECTION 4511.09 OF THE REVISED CODE, MAY ERECT AND MAINTAIN  56           

AT INTERSECTING ROADS, AT LEAST ONE OF WHICH IS A TOWNSHIP ROAD,   57           

SUITABLE SIGNPOSTS SHOWING THE NAMES AND NUMBERS OF THE ROADS.     58           

THE COST OF THE SIGNS SHALL BE PAID FROM THE TOWNSHIP ROAD FUND.   60           

      (D)  SUBJECT TO DIVISION (F) OF THIS SECTION, A BOARD OF     63           

TOWNSHIP TRUSTEES, IN CONFORMITY WITH THE MANUAL AND UNIFORM       64           

SYSTEM OF TRAFFIC CONTROL DEVICES ADOPTED UNDER SECTION 4511.09    65           

OF THE REVISED CODE, MAY ERECT AND MAINTAIN AT INTERSECTING        67           

ROADS, AT LEAST ONE OF WHICH IS A TOWNSHIP ROAD, SUITABLE                       

SIGNPOSTS SHOWING THE DIRECTION AND DISTANCE TO ANY NEARBY         68           

MUNICIPAL CORPORATION.  THE COSTS OF THE SIGNS SHALL BE PAID FROM  69           

THE TOWNSHIP ROAD FUND.                                            70           

      (E)  SUBJECT TO DIVISION (F) OF THIS SECTION, A BOARD OF     73           

TOWNSHIP TRUSTEES MAY PURCHASE OR LEASE AND ERECT AND MAINTAIN AT  75           

INTERSECTING ROADS, AT LEAST ONE OF WHICH IS A TOWNSHIP ROAD,                   

SUITABLE TRAFFIC CONTROL DEVICES AND TRAFFIC CONTROL SIGNALS.      76           

THE TRAFFIC CONTROL DEVICES AND TRAFFIC CONTROL SIGNALS AND THEIR  78           

PLACEMENT AND MAINTENANCE SHALL CONFORM WITH THE MANUAL AND        79           

SPECIFICATIONS ADOPTED UNDER SECTION 4511.09 OF THE REVISED CODE.  80           

IN PURCHASING OR LEASING AND ERECTING AND MAINTAINING THE TRAFFIC  81           

CONTROL DEVICES AND TRAFFIC CONTROL SIGNALS, THE BOARD MAY EXPEND  82           

ANY MONEYS THAT ARE AVAILABLE TO IT THAT LEGALLY MAY BE EXPENDED   83           

FOR THAT PURPOSE.                                                  84           

      (F)  IF ONE OF THE INTERSECTING HIGHWAYS AS PROVIDED IN      86           

DIVISIONS (D) AND (E) OF THIS SECTION IS A STATE HIGHWAY, BOTH OF  88           

THE FOLLOWING APPLY:                                                            

      (1)  NO SIGNPOST SHOWING THE DIRECTION AND DISTANCE TO ANY   92           

NEARBY MUNICIPAL CORPORATION SHALL BE PLACED AT OR NEAR THE        93           

INTERSECTION, AND NO TRAFFIC CONTROL DEVICE OR TRAFFIC CONTROL     94           

SIGNAL SHALL BE ERECTED AT THE INTERSECTION, WITHOUT PRIOR         95           

PERMISSION OF THE DIRECTOR AS REQUIRED BY SECTION 4511.10 OF THE   96

      (2)  THE DEPARTMENT OF TRANSPORTATION SHALL MAINTAIN ANY     99           

TRAFFIC CONTROL SIGNAL ERECTED BY THE BOARD OF TOWNSHIP TRUSTEES   100          

AT THAT INTERSECTION.                                              101          

      (G)  No contract for the construction or repair of a         103          

bridge, the entire cost of which construction or repair exceeds    105          

fifty thousand dollars, shall be entered into by the township      106          

unless the plans are first approved by the director.                            

      Section 2.  That existing section 5571.01 and section        108          

5571.17 of the Revised Code are hereby repealed.                   109
