That sections 2301.02, 2501.011, and 2501.012 28 of the Revised Code be amended to read as follows: 29 Sec. 2301.02. The number of judges of the court of common 38 pleas for each county, the time for the next election of the 39 judges in the several counties, and the beginning of their terms 40 shall be as follows: 41 (A) In Adams, Ashland, Fayette, and Pike counties, one 43 judge, elected in 1956, term to begin February 9, 1957; 44 2 In Brown, Crawford, Defiance, Highland, Holmes, Morgan, 46 Ottawa, and Union counties, one judge, to be elected in 1954, 47 term to begin February 9, 1955; 48 In Auglaize county, one judge, to be elected in 1956, term 50 to begin January 9, 1957; one to be elected in 329 1966, term to begin on January 4, 1967; and two to be elected in 330 1992, terms to begin January 1, 1993, and January 2, 1993, 331 respectively; 332 9 In Summit county, eleven judges; four to be elected in 334 1954, terms to begin January 1, 1955, January 2, 1955, January 3, 335 1955, and February 9, 1955, respectively; three to be elected in 336 1958, terms to begin January 1, 1959, January 2, 1959, and May 337 17, 1959, respectively; one to be elected in 1966, term to begin 338 January 4, 1967; one to be elected in 1968, term to begin January 339 5, 1969; one to be elected in 1990, term to begin May 1, 1991; 340 and one to be elected in 1992, term to begin January 6, 1993. 341 Notwithstanding the foregoing provisions, in any county 343 having two or more judges of the court of common pleas, in which 344 more than one-third of the judges plus one were previously 345 elected at the same election, if the office of one of those 346 judges so elected becomes vacant more than forty days prior to 347 the second general election preceding the expiration of that 348 judge's term, the office that that judge had filled shall be 349 abolished as of the date of the next general election, and a new 350 office of judge of the court of common pleas shall be created. 351 The judge who is to fill that new office shall be elected for a 352 six-year term at the next general election, and the term of that 354 judge shall commence on the first day of the year following that 355 general election, on which day no other judge's term begins, so 356 that the number of judges that the county shall elect shall not 358 be reduced. 359 Judges of the probate division of the court of common pleas 361 are judges of the court of common pleas but shall be elected 362 pursuant to sections 2101.02 and 2101.021 of the Revised Code, 363 except in Adams, Harrison, Henry, Morgan, Morrow, Noble, and 364 Wyandot counties in which the judge of the court of common pleas 365 elected pursuant to this section also shall serve as judge of the 367 probate division. 368 Sec. 2501.011. (A)ThereEXCEPT AS OTHERWISE PROVIDED IN 377 THIS DIVISION, THERE shall be two additional judges of the court 379 of appeals of the fifth district, composed of Ashland, Coshocton, 380 Delaware, Fairfield, Guernsey, Holmes, Knox, Licking, Morgan, 381 10 Morrow, Muskingum, Perry, Richland, Stark, and Tuscarawas 382 counties. FROM FEBRUARY 11, 2001, THROUGH FEBRUARY 10, 2007, 383 THERE SHALL BE THREE ADDITIONAL JUDGES OF THE COURT OF APPEALS OF 384 THE FIFTH DISTRICT. One of the additional judges of the fifth district court of 386 appeals shall be elected at the general election in 1980 for a 387 term of six years beginning February 10, 1981. One of the 388 additional judges of the fifth district court of appeals shall be 389 elected at the general election in 1982 for a term of six years 390 beginning February 10, 1983. ONE OF THE ADDITIONAL JUDGES OF THE 391 FIFTH DISTRICT COURT OF APPEALS SHALL BE ELECTED AT THE GENERAL 392 ELECTION IN 2000 FOR A TERM OF SIX YEARS BEGINNING FEBRUARY 11, 393 2001. The TWO additional judges WHOSE TERMS BEGIN ON FEBRUARY 10 395 shall thereafter be elected to hold terms of six years. 396 In the fifth district, any three judges shall comprise the 398 court of appeals in the hearing and disposition of cases in 399 accordance with any local rules of practice and procedure that 400 may be adopted by the judges of the court. 401 (B) There shall be two additional judges of the court of 403 appeals of the sixth district, composed of Erie, Fulton, Huron, 404 Lucas, Ottawa, Sandusky, Williams, and Wood counties. 405 One of the additional judges of the sixth district court of 407 appeals shall be elected at the general election in 1980 for a 408 term of six years beginning February 10, 1981. One of the 409 additional judges of the sixth district court of appeals shall be 410 elected at the general election in 1990 for a term of six years 411 beginning on February 10, 1991. The additional judges shall 412 thereafter be elected to hold terms of six years. 413 In the sixth district, any three judges shall comprise the 415 court of appeals in the hearing and disposition of cases in 416 accordance with any local rules of practice and procedure that 417 may be adopted by the judges of the court. 418 (C) There shall be one additional judge of the court of 420 appeals of the seventh district, composed of Belmont, Carroll, 422 11 Columbiana, Harrison, Jefferson, Mahoning, Monroe, and Noble 424 counties. The additional judge shall be elected at the general 426 election in 1996 for a term of six years beginning February 10, 427 1997. The additional judge thereafter shall be elected to hold 428 terms of six years. In the seventh district, any three judges shall comprise 430 the court of appeals in the hearing and disposition of cases in 431 accordance with any local rules of practice and procedure that 432 may be adopted by the judges of the court. 433 (D) The judges provided for in this section and sections 435 2501.012 and 2501.013 of the Revised Code shall exercise the same 436 powers and jurisdiction and perform the same duties as the judges 437 of the courts of appeals; and shall receive the same 438 compensation, as provided by law, for the judges of the courts of 439 appeals. 440 Sec. 2501.012. (A) There shall be nine additional judges 449 of the court of appeals of the eighth district, composed of 450 Cuyahoga county. 451 Three of the additional judges of the eighth district court 453 of appeals shall be elected at the general election in 1962 for a 454 term of six years, their terms to commence on successive days 455 beginning on the first day of January, 1963. Three of the 456 additional judges of the eighth district court of appeals shall 457 be elected at the general election in 1976 for a term of six 458 years, their terms to commence on successive days beginning on 459 the first day of January, 1977. Three of the additional judges 460 of the eighth district court of appeals shall be elected at the 461 general election in 1990 for a term of six years, their terms to 462 commence on successive days beginning on February 10, 1991. The 463 additional judges shall thereafter be elected to hold terms of 464 six years. 465 In the eighth district, any three judges shall comprise the 467 court of appeals in the hearing and disposition of cases in 468 12 accordance with any local rules of practice and procedure that 469 may be adopted by the judges of the court. 470 (B) There shall be two additional judges of the court of 472 appeals of the ninth district, composed of Lorain, Medina, 473 Summit, and Wayne counties. 474 One of the additional judges of the ninth district court of 476 appeals shall be elected at the general election in 1980 for a 477 term of six years beginning February 10, 1981. One of the 478 additional judges of the ninth district court of appeals shall be 479 elected at the general election in 1986 for a term of six years 480 beginning February 11, 1987. The additional judges shall 481 thereafter be elected to hold terms of six years. 482 In the ninth district, any three judges shall comprise the 484 court of appeals in the hearing and disposition of cases in 485 accordance with any local rules of practice and procedure that 486 may be adopted by the judges of the court. 487 (C) There shall be five additional judges of the court of 489 appeals of the tenth district, composed of Franklin county. 490 One of the additional judges of the tenth district court of 492 appeals shall be elected at the general election in 1962 for a 493 term of six years beginning January 1, 1963. One of the 494 additional judges of the tenth district court of appeals shall be 495 elected at the general election in 1970 for a term of six years 496 beginning February 10, 1971. One of the additional judges of the 497 tenth district court of appeals shall be elected at the general 498 election in 1980 for a term of six years beginning January 2, 499 1981. One of the additional judges of the tenth district court 500 of appeals shall be elected at the general election in 1986 for a 501 term of six years beginning January 3, 1987. One of the 502 additional judges of the tenth district court of appeals shall be 503 elected at the general election in 1990 for a term of six years 504 beginning July 1, 1991. The additional judges shall thereafter 505 be elected to hold terms of six years. 506 In the tenth district, any three judges shall comprise the 508 13 court of appeals in the hearing and disposition of cases in 509 accordance with any local rules of practice and procedure that 510 may be adopted by the judges of the court. 511 (D) There shall beoneTWO additionaljudgeJUDGES of the 514 court of appeals of the eleventh district, composed of Lake, 515 Ashtabula, Geauga, Trumbull, andPortgagePORTAGE counties. 516TheONE OF THE additionaljudgeJUDGES OF THE ELEVENTH 518 DISTRICT COURT OF APPEALS shall be elected at the general 519 election in 1990 for a term of six years beginning February 10, 520 1991. ONE OF THE ADDITIONAL JUDGES OF THE ELEVENTH DISTRICT 521 COURT OF APPEALS SHALL BE ELECTED AT THE GENERAL ELECTION IN 2000 522 FOR A TERM OF SIX YEARS BEGINNING FEBRUARY 10, 2001. The 523 additionaljudgeJUDGES shall thereafter be elected to hold terms 525 of six years. In the eleventh district, any three judges shall comprise 527 the court of appeals in the hearing and disposition of cases in 528 accordance with any local rules of practice and procedure that 529 may be adopted by the judges of the court. 530 (E) There shall be one additional judge of the court of 532 appeals of the twelfth district, composed of Brown, Butler, 533 Clermont, Clinton, Fayette, Madison, Preble, and Warren counties. 534 The additional judge shall be elected at the general 536 election in 1986 for a term of six years beginning February 10, 537 1987. The additional judge shall thereafter be elected to hold 538 terms of six years. 539 In the twelfth district, any three judges shall comprise 541 the court of appeals in the hearing and disposition of cases in 542 accordance with any local rules of practice and procedure that 543 may be adopted by the judges of the court. 544 (F) Any judge of the court of appeals may be assigned by 546 the chief justice of the supreme court to hold court in another 547 district and shall hold court in the district to whichheTHE 548 JUDGE is assigned. 549 Section 2. That existing sections 2301.02, 2501.011, and 551 14 2501.012 of the Revised Code are hereby repealed. 552 Section 3. (A) There is hereby created the Appellate 555 District Study Committee. The committee shall consist of the 556 following members: 557 (1) One judge of a court of record from each appellate 559 district, to be appointed by the Chief Justice; 560 (2) Five members to be appointed by the Chief Justice; 562 (3) The Chair of the House Criminal Justice Committee, or 564 the Chair's designee; 565 (4) The Ranking Minority Member of the House Criminal 567 Justice Committee, or that member's designee; 568 (5) The Chair of the Senate Judiciary Committee, or the 570 Chair's designee; 571 (6) The Ranking Minority Member of the Senate Judiciary 573 Committee, or that member's designee. 574 (B) The Chief Justice shall appoint the chair and 576 vice-chair of the study committee from among the study 577 committee's members. The Chief Justice shall make the initial 578 appointments to the study committee within sixty days after the 579 effective date of this act. A vacancy on the study committee 580 shall be filled in the same manner as the original appointment. 581 The Supreme Court shall provide facilities in which the study 582 committee shall meet, provide any clerical or other services 583 required by the study committee in performing its official 584 duties, and be responsible for any administrative expenses 585 incurred by the study committee in performing its official 586 duties. The members of the study committee shall serve without 587 compensation. The chair of the study committee shall schedule a 588 date for the study committee's first meeting not later than 589 thirty days after the final initial appointment to the study 590 committee is made. (C) The study committee shall review the existing 592 boundaries of the twelve appellate districts and recommend to the 593 General Assembly any necessary revisions to those boundaries. In 594 15 conducting its review and making its recommendations, the study 595 committee shall consider changes over the past fifty years in 596 caseloads, populations, other demographic factors that affect 597 appellate district workloads, and the membership, by county, of 598 multi-county appellate districts. 599 Not later than December 31, 2001, the study committee shall 601 submit recommendations on whether and how to revise appellate 602 district boundaries to the Speaker and Minority Leader of the 603 House of Representatives, the President and Minority Leader of 604 the Senate, and the Chief Justice of the Supreme Court. On 605 January 1, 2002, the study committee shall cease to exist. 606 Section 4. This act is hereby declared to be an emergency 608 measure necessary for the immediate preservation of the public 609 peace, health, and safety. The reason for such necessity is that 610 it is crucial that this act be enacted into law at the earliest 611 possible time to enable candidates for the new judicial positions 612 that are created by this act to timely file their declarations of 613 candidacy and statements of candidacy and nominating petitions. 614 Therefore, this act shall go into immediate effect. 615
