                          A   B I L L                                           

             To amend section 4927.01 of the Revised Code to       12           

                redefine "basic local exchange service" in         13           

                alternative telephone regulation law to specify                 

                the essential elements of that service.            14           




BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:        16           

      Section 1.  That section 4927.01 of the Revised Code be      19           

amended to read as follows:                                        20           

      Sec. 4927.01.  As used in this chapter:                      29           

      (A)  "Basic local exchange service" means the end:           31           

      (1)  END user and carrier access to and usage of telephone   34           

company-provided facilities SERVICES that enable customers A       35           

CUSTOMER, over a local exchange telephone company network          38           

operated within a local service area THE PRIMARY LINE SERVING THE  39           

CUSTOMER'S PREMISES, to originate or receive voice grade, data,    40           

or image communications and to access interexchange or other       41           

networks WITHIN A LOCAL SERVICE AREA, AND THAT CONSIST OF THE      42           

FOLLOWING:                                                                      

      (a)  LOCAL DIAL TONE SERVICE;                                44           

      (b)  TOUCH TONE DIALING SERVICE;                             46           

      (c)  ACCESS TO AND USAGE OF 9-1-1 SERVICES, WHERE SUCH       48           

SERVICES ARE AVAILABLE;                                            49           

      (d)  ACCESS TO OPERATOR SERVICES AND DIRECTORY ASSISTANCE;   51           

      (e)  PROVISION OF A TELEPHONE DIRECTORY AND A LISTING IN     53           

THAT DIRECTORY;                                                    54           

      (f)  PER CALL, CALLER IDENTIFICATION BLOCKING SERVICES;      56           

      (g)  ACCESS TO TELECOMMUNICATIONS RELAY SERVICE; AND         58

      (h)  ACCESS TO TOLL PRESUBSCRIPTION, INTEREXCHANGE OR TOLL   60           

PROVIDERS OR BOTH, AND NETWORKS OF OTHER TELEPHONE COMPANIES.      61           

      (2)  CARRIER ACCESS TO AND USAGE OF TELEPHONE                63           

COMPANY-PROVIDED FACILITIES THAT ENABLE END USER CUSTOMERS         64           

ORIGINATING OR RECEIVING VOICE GRADE, DATA, OR IMAGE               65           

COMMUNICATIONS, OVER A LOCAL EXCHANGE TELEPHONE COMPANY NETWORK    66           

OPERATED WITHIN A LOCAL SERVICE AREA, TO ACCESS INTEREXCHANGE OR   67           

OTHER NETWORKS.                                                                 

      (B)  "Cable television service" means any transmission of    69           

video or other programming service to subscribers and any          70           

subscriber interaction required for the selection of that video    71           

or other programming service.                                      72           

      (C)  "Local service area" means the geographic area within   74           

which a telephone customer may complete a call to another          75           

telephone customer without being assessed long distance toll       76           

charges.                                                           77           

      (D)  "Public telecommunications service" means the           79           

transmission by a telephone company, by electromagnetic or other   80           

means, of signs, signals, writings, images, sounds, messages, or   81           

data originating and terminating in this state regardless of       82           

actual call routing, but does not include a system, including its  83           

construction, maintenance, or operation, for the provision of      84           

telecommunications service, or any portion of such service, by     85           

any entity for the sole and exclusive use of that entity, its      86           

parent, a subsidiary, or an affiliated entity, and not for         87           

resale, directly or indirectly; the provision of terminal          88           

equipment used to originate or terminate telecommunications        89           

service; broadcast transmission by radio, television, or           90           

satellite broadcast stations regulated by the federal government;  91           

or cable television service.                                       92           

      (E)  "Telephone company" means any company described in      94           

division (A)(2) of section 4905.03 of the Revised Code that is a   95           

public utility under section 4905.02 of the Revised Code.          96           

      Section 2.  That existing section 4927.01 of the Revised     98
