             To amend section 4927.01 of the Revised Code to       14           

                redefine "basic local exchange service" in         15           

                alternative telephone regulation law to specify                 

                the essential elements of that service.            16           




BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:        18           

      Section 1.  That section 4927.01 of the Revised Code be      21           

amended to read as follows:                                        22           

      Sec. 4927.01.  As used in this chapter:                      31           

      (A)  "Basic local exchange service" means the end:           33           

      (1)  END user and carrier access to and usage of telephone   36           

company-provided facilities SERVICES that enable customers A       37           

CUSTOMER, over a local exchange telephone company network          40           

operated within a local service area THE PRIMARY LINE SERVING THE  41           

CUSTOMER'S PREMISES, to originate or receive voice grade, data,    42           

or image communications and to access interexchange or other       43           

networks WITHIN A LOCAL SERVICE AREA, AND THAT CONSIST OF THE      44           

FOLLOWING:                                                                      

      (a)  LOCAL DIAL TONE SERVICE;                                46           

      (b)  TOUCH TONE DIALING SERVICE;                             48           

      (c)  ACCESS TO AND USAGE OF 9-1-1 SERVICES, WHERE SUCH       50           

SERVICES ARE AVAILABLE;                                            51           

      (d)  ACCESS TO OPERATOR SERVICES AND DIRECTORY ASSISTANCE;   53           

      (e)  PROVISION OF A TELEPHONE DIRECTORY AND A LISTING IN     55           

THAT DIRECTORY;                                                    56

      (f)  PER CALL, CALLER IDENTIFICATION BLOCKING SERVICES;      58           

      (g)  ACCESS TO TELECOMMUNICATIONS RELAY SERVICE; AND         60           

      (h)  ACCESS TO TOLL PRESUBSCRIPTION, INTEREXCHANGE OR TOLL   62           

PROVIDERS OR BOTH, AND NETWORKS OF OTHER TELEPHONE COMPANIES.      63           

      (2)  CARRIER ACCESS TO AND USAGE OF TELEPHONE                65           

COMPANY-PROVIDED FACILITIES THAT ENABLE END USER CUSTOMERS         66           

ORIGINATING OR RECEIVING VOICE GRADE, DATA, OR IMAGE               67           

COMMUNICATIONS, OVER A LOCAL EXCHANGE TELEPHONE COMPANY NETWORK    68           

OPERATED WITHIN A LOCAL SERVICE AREA, TO ACCESS INTEREXCHANGE OR   69           

OTHER NETWORKS.                                                                 

      (B)  "Cable television service" means any transmission of    71           

video or other programming service to subscribers and any          72           

subscriber interaction required for the selection of that video    73           

or other programming service.                                      74           

      (C)  "Local service area" means the geographic area within   76           

which a telephone customer may complete a call to another          77           

telephone customer without being assessed long distance toll       78           

charges.                                                           79           

      (D)  "Public telecommunications service" means the           81           

transmission by a telephone company, by electromagnetic or other   82           

means, of signs, signals, writings, images, sounds, messages, or   83           

data originating and terminating in this state regardless of       84           

actual call routing, but does not include a system, including its  85           

construction, maintenance, or operation, for the provision of      86           

telecommunications service, or any portion of such service, by     87           

any entity for the sole and exclusive use of that entity, its      88           

parent, a subsidiary, or an affiliated entity, and not for         89           

resale, directly or indirectly; the provision of terminal          90           

equipment used to originate or terminate telecommunications        91           

service; broadcast transmission by radio, television, or           92           

satellite broadcast stations regulated by the federal government;  93           

or cable television service.                                       94           

      (E)  "Telephone company" means any company described in      96           

division (A)(2) of section 4905.03 of the Revised Code that is a   97

public utility under section 4905.02 of the Revised Code.          98           

      Section 2.  That existing section 4927.01 of the Revised     100          

Code is hereby repealed.                                           101
