A B I L L
To amend section 4927.01 of the Revised Code to 15
redefine "basic local exchange service" in 16
alternative telephone regulation law to specify
the essential elements of that service. 17
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 19
Section 1. That section 4927.01 of the Revised Code be 22
amended to read as follows: 23
Sec. 4927.01. As used in this chapter: 32
(A) "Basic local exchange service" means the end: 34
(1) END user and carrier access to and usage of telephone 37
company-provided facilities SERVICES that enable customers A 38
CUSTOMER, over a local exchange telephone company network 41
operated within a local service area THE PRIMARY LINE SERVING THE 42
CUSTOMER'S PREMISES, to originate or receive voice grade, data, 43
or image communications and to access interexchange or other 44
networks WITHIN A LOCAL SERVICE AREA, AND THAT CONSIST OF THE 45
FOLLOWING:
(a) LOCAL DIAL TONE SERVICE; 47
(b) TOUCH TONE DIALING SERVICE; 49
(c) ACCESS TO AND USAGE OF 9-1-1 SERVICES, WHERE SUCH 51
SERVICES ARE AVAILABLE; 52
(d) ACCESS TO OPERATOR SERVICES AND DIRECTORY ASSISTANCE; 54

(e) PROVISION OF A TELEPHONE DIRECTORY AND A LISTING IN 56
THAT DIRECTORY; 57
(f) PER CALL, CALLER IDENTIFICATION BLOCKING SERVICES; 59
(g) ACCESS TO TELECOMMUNICATIONS RELAY SERVICE; AND 61
(h) ACCESS TO TOLL PRESUBSCRIPTION, INTEREXCHANGE OR TOLL 63
PROVIDERS OR BOTH, AND NETWORKS OF OTHER TELEPHONE COMPANIES. 64
(2) CARRIER ACCESS TO AND USAGE OF TELEPHONE 66
COMPANY-PROVIDED FACILITIES THAT ENABLE END USER CUSTOMERS 67
ORIGINATING OR RECEIVING VOICE GRADE, DATA, OR IMAGE 68
COMMUNICATIONS, OVER A LOCAL EXCHANGE TELEPHONE COMPANY NETWORK 69
OPERATED WITHIN A LOCAL SERVICE AREA, TO ACCESS INTEREXCHANGE OR 70
OTHER NETWORKS.
(B) "Cable television service" means any transmission of 72
video or other programming service to subscribers and any 73
subscriber interaction required for the selection of that video 74
or other programming service. 75
(C) "Local service area" means the geographic area within 77
which a telephone customer may complete a call to another 78
telephone customer without being assessed long distance toll 79
charges. 80
(D) "Public telecommunications service" means the 82
transmission by a telephone company, by electromagnetic or other 83
means, of signs, signals, writings, images, sounds, messages, or 84
data originating and terminating in this state regardless of 85
actual call routing, but does not include a system, including its 86
construction, maintenance, or operation, for the provision of 87
telecommunications service, or any portion of such service, by 88
any entity for the sole and exclusive use of that entity, its 89
parent, a subsidiary, or an affiliated entity, and not for 90
resale, directly or indirectly; the provision of terminal 91
equipment used to originate or terminate telecommunications 92
service; broadcast transmission by radio, television, or 93
satellite broadcast stations regulated by the federal government; 94
or cable television service. 95

(E) "Telephone company" means any company described in 97
division (A)(2) of section 4905.03 of the Revised Code that is a 98
public utility under section 4905.02 of the Revised Code. 99
Section 2. That existing section 4927.01 of the Revised 101
Code is hereby repealed. 102
