To amend section 4927.01 of the Revised Code to 16
redefine "basic local exchange service" in 17
alternative telephone regulation law to specify
the essential elements of that service. 18
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 20
Section 1. That section 4927.01 of the Revised Code be 23
amended to read as follows: 24
Sec. 4927.01. As used in this chapter: 33
(A) "Basic local exchange service" means the end: 35
(1) END user and carrier access to and usage of telephone 38
company-provided facilities SERVICES that enable customers A 39
CUSTOMER, over a local exchange telephone company network 42
operated within a local service area THE PRIMARY LINE SERVING THE 43
CUSTOMER'S PREMISES, to originate or receive voice grade, data, 44
or image communications and to access interexchange or other 45
networks WITHIN A LOCAL SERVICE AREA, AND THAT CONSIST OF THE 46
FOLLOWING:
(a) LOCAL DIAL TONE SERVICE; 48
(b) TOUCH TONE DIALING SERVICE; 50
(c) ACCESS TO AND USAGE OF 9-1-1 SERVICES, WHERE SUCH 52
SERVICES ARE AVAILABLE; 53

(d) ACCESS TO OPERATOR SERVICES AND DIRECTORY ASSISTANCE; 55
(e) PROVISION OF A TELEPHONE DIRECTORY AND A LISTING IN 57
THAT DIRECTORY; 58
(f) PER CALL, CALLER IDENTIFICATION BLOCKING SERVICES; 60
(g) ACCESS TO TELECOMMUNICATIONS RELAY SERVICE; AND 62
(h) ACCESS TO TOLL PRESUBSCRIPTION, INTEREXCHANGE OR TOLL 64
PROVIDERS OR BOTH, AND NETWORKS OF OTHER TELEPHONE COMPANIES. 65
(2) CARRIER ACCESS TO AND USAGE OF TELEPHONE 67
COMPANY-PROVIDED FACILITIES THAT ENABLE END USER CUSTOMERS 68
ORIGINATING OR RECEIVING VOICE GRADE, DATA, OR IMAGE 69
COMMUNICATIONS, OVER A LOCAL EXCHANGE TELEPHONE COMPANY NETWORK 70
OPERATED WITHIN A LOCAL SERVICE AREA, TO ACCESS INTEREXCHANGE OR 71
OTHER NETWORKS.
(B) "Cable television service" means any transmission of 73
video or other programming service to subscribers and any 74
subscriber interaction required for the selection of that video 75
or other programming service. 76
(C) "Local service area" means the geographic area within 78
which a telephone customer may complete a call to another 79
telephone customer without being assessed long distance toll 80
charges. 81
(D) "Public telecommunications service" means the 83
transmission by a telephone company, by electromagnetic or other 84
means, of signs, signals, writings, images, sounds, messages, or 85
data originating and terminating in this state regardless of 86
actual call routing, but does not include a system, including its 87
construction, maintenance, or operation, for the provision of 88
telecommunications service, or any portion of such service, by 89
any entity for the sole and exclusive use of that entity, its 90
parent, a subsidiary, or an affiliated entity, and not for 91
resale, directly or indirectly; the provision of terminal 92
equipment used to originate or terminate telecommunications 93
service; broadcast transmission by radio, television, or 94
satellite broadcast stations regulated by the federal government; 95

or cable television service. 96
(E) "Telephone company" means any company described in 98
division (A)(2) of section 4905.03 of the Revised Code that is a 99
public utility under section 4905.02 of the Revised Code. 100
Section 2. That existing section 4927.01 of the Revised 102
Code is hereby repealed. 103
