No. 239 5 1999-2000 6 SENATOR CUPP 8 _________________________________________________________________ 10 A B I L L To create a grant program for the 2000-2001 biennium 12 that is to be administered by the Ohio Emergency 14 Management Agency and that is to provide funds for certain purposes to countywide emergency 15 management agencies and regional authorities for 16 emergency management, to amend Section 82 of Am. Sub. H.B. 283 of the 123rd General Assembly, and 17 to make an appropriation. 18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 20 Section 1. (A) There is hereby created a grant program 22 for the 2000-2001 biennium to be administered by the Ohio 23 Emergency Management Agency within the Department of Public 24 Safety. The program shall provide funds to qualifying countywide 25 emergency management agencies or regional authorities for 26 emergency management established under section 5502.26 or 5502.27 27 of the Revised Code. 28 (B) Within one hundred twenty days after the effective 30 date of this section, the Deputy Director of the Ohio Emergency 31 Management Agency shall accept and process petitions for grants 32 of up to twenty-five thousand dollars each from the twenty-five 33 least populous counties in the state. The petitions shall be in 34 the form and shall be filed within the time limits provided by 36 rules adopted by the Deputy Director for the administration of 37 the grant program. To receive a grant of up to twenty-five 38 thousand dollars, a petitioning county must establish to the 39 satisfaction of the Deputy Director the following elements: 40 2 (1) Its countywide emergency management agency serves one 42 of the twenty-five least populous counties in the state as 43 determined by the most recent federal decennial census. 44 (2) Its countywide emergency management agency employs at 46 least one permanent full-time employee, regardless of the 47 position of that permanent full-time employee. 48 (3) Its countywide emergency management agency is in 50 compliance with all of the requirements for such agencies under 51 Chapter 5502. of the Revised Code, including compliance with the 52 professional development training program that is required by 53 section 5502.26 of the Revised Code and implemented in compliance 54 with the rules adopted by the Director of Public Safety. 55 Each agency receiving a grant of up to twenty-five thousand 57 dollars under this section shall determine how it will use the 58 grant moneys. The grant moneys are in addition to financial 59 support from the political subdivisions that entered into the 60 countywide agreement. Receipt of a grant of up to twenty-five 61 thousand dollars under this section shall not affect the amount 62 of financial support provided by a county or other contributing 63 political subdivision to an agency. (C) After the expiration of the one-hundred-twenty-day 65 period after the effective date of this section, all moneys 66 remaining in the appropriation to be distributed as grant moneys 67 under this act shall be available for grants to all countywide 68 emergency management agencies established under section 5502.26 69 of the Revised Code other than the twenty-five least populous 70 counties in the state as determined under division (B) of this 71 section, and to regional authorities for emergency management 73 established under section 5502.27 of the Revised Code. Grants 74 from these remaining moneys shall be awarded to these agencies 75 and regional authorities by a committee composed of the Deputy 76 Director of the Ohio Emergency Management Agency or the Deputy 77 Director's designee and three other employees of the Ohio Emergency Management Agency appointed by the Deputy Director, as 78 3 well as three members who represent the organization that 79 represents local emergency management agencies in this state and 81 who are chosen by that organization to serve on this committee. These grants are to be used for special projects proposed by a 82 petitioning agency or regional authority. The Deputy Director of 83 the Ohio Emergency Management Agency shall adopt rules providing 84 the procedure for applying for and awarding these grants, 85 including the determination of the amounts to be awarded, and the 86 qualifications for projects to be funded by these grants. 87 (D) The Deputy Director of the Ohio Emergency Management 89 Agency shall adopt rules for the administration of the grant 90 program in accordance with Chapter 119. of the Revised Code. 91 Section 2. That Section 82 of Am. Sub. H.B. 283 of the 93 123rd General Assembly be amended to read as follows: 94 "Sec. 82. The Ohio Emergency Management Agency shall develop an 148 agreement between the State of Ohio Chapters of the American Red 149 Cross to specify the terms by which these funds shall be 150 requested, distributed, and accounted for to enhance the disaster 151 response capability of the American Red Cross in Ohio. Funds shall not be used for administrative costs. The Ohio Emergency 152 Management Agency shall require of the American Red Cross a plan 153 that facilitates implementation of the current Statement of 154 Understanding between the State of Ohio and the American Red 155 Cross. The release of funds shall be contingent upon a plan that is satisfactory to both parties. 156 Ohio Task Force One - Urban Search and Rescue Unit 158 Of the foregoing appropriation item 763-403, Operating 160 Expenses - EMA, $200,000 in each fiscal year shall be used to 161 fund the Ohio Task Force One - Urban Search and Rescue Unit. 162 MARCS Operations and Maintenance Transfers 164 Upon the request of the Director of Public Safety, the 166 Director of Budget and Management shall transfer up to $304,284 167 in cash in fiscal year 2000 and $303,550 in cash in fiscal year 168 2001 by intrastate transfer voucher from appropriation item 169 763-409, MARCS Operations and Maintenance, to Fund 4S2, MARCS 171 Maintenance Fund. Upon the request of the Director of Public Safety, the 173 Director of Budget and Management shall transfer up to $436,000 174 in cash in fiscal year 2000 and $432,447 in cash in fiscal year 175 2001 by intrastate transfer voucher from appropriation item 176 5 763-409, MARCS Operations and Maintenance, to Fund 4W6, MARCS 177 Operations Fund. IFG State Match 179 The foregoing appropriation item 763-507, Individual and 181 Family Grants, shall be used to fund the state share of costs to 182 provide grants to individuals and families in cases of disaster. 183 COUNTY EMERGENCY PREPAREDNESS AND SERVICE UPGRADES PILOT 186 OF APPROPRIATION ITEM 763-634, COUNTY EMERGENCY 189 PREPAREDNESS, UP TO $500,000 IN EACH FISCAL YEAR SHALL BE DISTRIBUTED TO QUALIFYING COUNTYWIDE EMERGENCY MANAGEMENT 190 AGENCIES OR REGIONAL AUTHORITIES FOR EMERGENCY MANAGEMENT, AS 191 PROVIDED IN SECTION 1 OF __.B.___ OF THE 123rd GENERAL ASSEMBLY. 193 ANY UNSPENT APPROPRIATION IN APPROPRIATION ITEM 763-634, 195 COUNTY EMERGENCY PREPAREDNESS, IN FISCAL YEAR 2000 SHALL BE 196 TRANSFERRED TO FISCAL YEAR 2001, AND THE APPROPRIATION AUTHORITY 197 IN FISCAL YEAR 2001 IS AUTOMATICALLY INCREASED BY THAT AMOUNT." 198 Section 3. That existing Section 82 of Am. Sub. H.B. 283 200 of the 123rd General Assembly is hereby repealed. 201 Section 4. The uncodified sections of law contained in 203 this act are not subject to the referendum. Therefore, under 204 Ohio Constitution, Article II, Section 1d and section 1.471 of 205 the Revised Code, the uncodified sections of law contained in 206 this act go into immediate effect when this act becomes law.
