No. 239 6 1999-2000 7 SENATORS CUPP-CARNES-KEARNS 9 _________________________________________________________________ 11 A B I L L To create a grant program for fiscal year 2001 that 13 is to be administered by the Ohio Emergency 15 Management Agency and that is to provide funds for certain purposes to countywide and county 16 emergency management agencies and regional 17 authorities for emergency management, to amend Section 82 of Am. Sub. H.B. 283 of the 123rd 18 General Assembly, and to make an appropriation. 19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 21 Section 1. (A) There is hereby created a grant program 23 for fiscal year 2001 to be administered by the Ohio Emergency 24 Management Agency within the Department of Public Safety. The 25 program shall provide funds to qualifying countywide emergency 26 management agencies established under section 5502.26 of the 27 Revised Code, regional authorities for emergency management 28 established under section 5502.27 of the Revised Code, and county 29 emergency management agencies established under section 5502.271 30 of the Revised Code. 31 (B) Within one hundred twenty days after the effective 33 date of this section, the Executive Director of the Emergency 34 Management Agency shall accept and process applications for 35 grants of up to twenty-five thousand dollars each from the 36 countywide and county emergency management agencies, and regional 37 authorities for emergency management, of the twenty-five counties 38 with the lowest average federal adjusted gross income according 39 2 to the most recent figures available from the Department of 40 Taxation. The applications shall be in the form and shall be 41 filed within the time limits provided by the grant application 42 procedure, which shall be established by a committee composed of 43 the Executive Director, three employees of the Ohio Emergency 44 Management Agency chosen by the Executive Director, and three 45 members chosen by the Ohio Emergency Management Association. To 46 receive a grant under this division, an applicant shall 47 demonstrate to the satisfaction of the Executive Director all of 48 the following: (1) The countywide or county emergency management agency 50 or regional authority for emergency management serves one of the 51 twenty-five counties with the lowest average federal adjusted 52 gross income according to the most recent figures available from 53 the Department of Taxation. 54 (2) The agency or authority employs, or upon receipt of 56 the grant will employ, at least one permanent full-time employee. 57 (3) The agency or authority is, or within ninety days after 59 receipt of the grant will be, in compliance with all of the 60 requirements applicable to the agency or authority under Chapter 61 5502. of the Revised Code, including compliance with or 62 enrollment in a professional development training program in 63 accordance with rules adopted under section 5502.25 of the 65 Revised Code. (4) The agency has obtained from the board of county 67 commissioners, or the authority has obtained from the executive 68 board of the regional authority, permission to apply for and to 69 receive a grant under this section. 70 (C) Following the expiration of the one-hundred-twenty-day 72 period after the effective date of this section, all money 73 remaining in the appropriation made by this act shall be 74 available for grants to all countywide and county emergency 76 management agencies, and regional authorities for emergency 77 management, other than those in the twenty-five counties with the 78 3 lowest average federal adjusted gross income according to the 79 most recent figures available from the Department of Taxation. 80 Grants of this remaining money shall be awarded to these agencies 81 and authorities by the committee established under division (B) 82 of this section. These grants shall be used for special projects 83 proposed by the agency or authority. The committee established 84 under division (B) of this section shall establish the procedure 85 for applying for and awarding these grants and shall determine 86 the amounts to be awarded and the qualifications for projects to 87 be funded by the grants. (D) Each agency or authority receiving a grant under this 89 section shall file with its application a spending plan showing 90 how it will use the grant money. Grants made under this section 91 are not intended to supplant any federal, state, or local funding 92 to an agency or authority. Therefore, neither a state agency nor 93 any political subdivision of the state shall take into account 94 the receipt of a grant under this section in determining the 95 amount of support that the state agency or political subdivision 96 provides to a countywide or county emergency management agency or 97 regional authority for emergency management. 98 Section 2. That Section 82 of Am. Sub. H.B. 283 of the 100 123rd General Assembly be amended to read as follows: 101 "Sec. 82. The Ohio Emergency Management Agency shall develop an 155 agreement between the State of Ohio Chapters of the American Red 156 Cross to specify the terms by which these funds shall be 157 requested, distributed, and accounted for to enhance the disaster 158 response capability of the American Red Cross in Ohio. Funds shall not be used for administrative costs. The Ohio Emergency 159 Management Agency shall require of the American Red Cross a plan 160 that facilitates implementation of the current Statement of 161 Understanding between the State of Ohio and the American Red 162 Cross. The release of funds shall be contingent upon a plan that is satisfactory to both parties. 163 Ohio Task Force One - Urban Search and Rescue Unit 165 Of the foregoing appropriation item 763-403, Operating 167 Expenses - EMA, $200,000 in each fiscal year shall be used to 168 fund the Ohio Task Force One - Urban Search and Rescue Unit. 169 MARCS Operations and Maintenance Transfers 171 Upon the request of the Director of Public Safety, the 173 5 Director of Budget and Management shall transfer up to $304,284 174 in cash in fiscal year 2000 and $303,550 in cash in fiscal year 175 2001 by intrastate transfer voucher from appropriation item 176 763-409, MARCS Operations and Maintenance, to Fund 4S2, MARCS 178 Maintenance Fund. Upon the request of the Director of Public Safety, the 180 Director of Budget and Management shall transfer up to $436,000 181 in cash in fiscal year 2000 and $432,447 in cash in fiscal year 182 2001 by intrastate transfer voucher from appropriation item 183 763-409, MARCS Operations and Maintenance, to Fund 4W6, MARCS 184 Operations Fund. IFG State Match 186 The foregoing appropriation item 763-507, Individual and 188 Family Grants, shall be used to fund the state share of costs to 189 provide grants to individuals and families in cases of disaster. 190 COUNTY EMERGENCY PREPAREDNESS AND SERVICE UPGRADES PILOT 193 OF APPROPRIATION ITEM 763-634, COUNTY EMERGENCY 196 PREPAREDNESS, UP TO $1,000,000 IN FISCAL YEAR 2001 SHALL BE DISTRIBUTED TO QUALIFYING COUNTYWIDE AND COUNTY EMERGENCY 198 MANAGEMENT AGENCIES OR REGIONAL AUTHORITIES FOR EMERGENCY 200 MANAGEMENT, AS PROVIDED IN SUB. S.B. 239 OF THE 123rd GENERAL 202 ASSEMBLY." Section 3. That existing Section 82 of Am. Sub. H.B. 283 204 of the 123rd General Assembly is hereby repealed. 205 Section 4. The uncodified sections of law contained in 207 this act are not subject to the referendum. Therefore, under 208 Ohio Constitution, Article II, Section 1d and section 1.471 of 209 the Revised Code, the uncodified sections of law contained in 210 this act go into immediate effect when this act becomes law.
