No. 239 5 1999-2000 6 SENATORS CUPP-CARNES-KEARNS-OELSLAGER-DRAKE 8 _________________________________________________________________ 10 A B I L L To create a grant program for fiscal year 2001 that 12 is to be administered by the Ohio Emergency 14 Management Agency and that is to provide funds for certain purposes to countywide and county 15 emergency management agencies and regional 16 authorities for emergency management, to amend Section 82 of Am. Sub. H.B. 283 of the 123rd 17 General Assembly, and to make an appropriation. 18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 20 Section 1. (A) There is hereby created a grant program 22 for fiscal year 2001 to be administered by the Ohio Emergency 23 Management Agency within the Department of Public Safety. The 24 program shall provide funds to qualifying countywide emergency 25 management agencies established under section 5502.26 of the 26 Revised Code, regional authorities for emergency management 27 established under section 5502.27 of the Revised Code, and county 28 emergency management agencies established under section 5502.271 29 of the Revised Code. 30 (B) Within one hundred twenty days after the effective 32 date of this section, the Executive Director of the Emergency 33 Management Agency shall accept and process applications for 34 grants of up to twenty-five thousand dollars each from the 35 countywide and county emergency management agencies, and regional 36 authorities for emergency management, of the twenty-five counties 37 with the lowest average federal adjusted gross income according 38 to the most recent figures available from the Department of 39 2 Taxation. The applications shall be in the form and shall be 40 filed within the time limits provided by the grant application 41 procedure, which shall be established by a committee composed of 42 the Executive Director, three employees of the Ohio Emergency 43 Management Agency chosen by the Executive Director, and three 44 members chosen by the Ohio Emergency Management Association. To 45 receive a grant under this division, an applicant shall 46 demonstrate to the satisfaction of the Executive Director all of 47 the following: (1) The countywide or county emergency management agency 49 or regional authority for emergency management serves one of the 50 twenty-five counties with the lowest average federal adjusted 51 gross income according to the most recent figures available from 52 the Department of Taxation. 53 (2) The agency or authority employs, or upon receipt of 55 the grant will employ, at least one permanent full-time employee. 56 (3) The agency or authority is, or within ninety days after 58 receipt of the grant will be, in compliance with all of the 59 requirements applicable to the agency or authority under Chapter 60 5502. of the Revised Code, including compliance with or 61 enrollment in a professional development training program in 62 accordance with rules adopted under section 5502.25 of the 64 Revised Code. (4) The agency has obtained from the board of county 66 commissioners, or the authority has obtained from the executive 67 board of the regional authority, permission to apply for and to 68 receive a grant under this section. 69 (C) Following the expiration of the one-hundred-twenty-day 71 period after the effective date of this section, all money 72 remaining in the appropriation made by this act shall be 73 available for grants to all countywide and county emergency 75 management agencies, and regional authorities for emergency 76 management, other than those in the twenty-five counties with the 77 lowest average federal adjusted gross income according to the 78 3 most recent figures available from the Department of Taxation. 79 Grants of this remaining money shall be awarded to these agencies 80 and authorities by the committee established under division (B) 81 of this section. These grants shall be used for special projects 82 proposed by the agency or authority. The committee established 83 under division (B) of this section shall establish the procedure 84 for applying for and awarding these grants and shall determine 85 the amounts to be awarded and the qualifications for projects to 86 be funded by the grants. (D) Each agency or authority shall file with its 89 application a spending plan showing how it will use the grant 90 money. Grants made under this section are not intended to 91 supplant any federal, state, or local funding to an agency or 92 authority. Therefore, neither a state agency nor any political 93 subdivision of the state shall take into account the receipt of a 94 grant under this section in determining the amount of support 95 that the state agency or political subdivision provides to a 96 countywide or county emergency management agency or regional authority for emergency management. 97 Section 2. That Section 82 of Am. Sub. H.B. 283 of the 99 123rd General Assembly be amended to read as follows: 100 "Sec. 82. The Ohio Emergency Management Agency shall develop an 154 agreement between the State of Ohio Chapters of the American Red 155 Cross to specify the terms by which these funds shall be 156 requested, distributed, and accounted for to enhance the disaster 157 response capability of the American Red Cross in Ohio. Funds shall not be used for administrative costs. The Ohio Emergency 158 Management Agency shall require of the American Red Cross a plan 159 that facilitates implementation of the current Statement of 160 Understanding between the State of Ohio and the American Red 161 Cross. The release of funds shall be contingent upon a plan that is satisfactory to both parties. 162 Ohio Task Force One - Urban Search and Rescue Unit 164 Of the foregoing appropriation item 763-403, Operating 166 Expenses - EMA, $200,000 in each fiscal year shall be used to 167 fund the Ohio Task Force One - Urban Search and Rescue Unit. 168 MARCS Operations and Maintenance Transfers 170 Upon the request of the Director of Public Safety, the 172 Director of Budget and Management shall transfer up to $304,284 173 in cash in fiscal year 2000 and $303,550 in cash in fiscal year 174 5 2001 by intrastate transfer voucher from appropriation item 175 763-409, MARCS Operations and Maintenance, to Fund 4S2, MARCS 177 Maintenance Fund. Upon the request of the Director of Public Safety, the 179 Director of Budget and Management shall transfer up to $436,000 180 in cash in fiscal year 2000 and $432,447 in cash in fiscal year 181 2001 by intrastate transfer voucher from appropriation item 182 763-409, MARCS Operations and Maintenance, to Fund 4W6, MARCS 183 Operations Fund. IFG State Match 185 The foregoing appropriation item 763-507, Individual and 187 Family Grants, shall be used to fund the state share of costs to 188 provide grants to individuals and families in cases of disaster. 189 COUNTY EMERGENCY PREPAREDNESS AND SERVICE UPGRADES PILOT 192 OF APPROPRIATION ITEM 763-634, COUNTY EMERGENCY 195 PREPAREDNESS, UP TO $1,000,000 IN FISCAL YEAR 2001 SHALL BE DISTRIBUTED TO QUALIFYING COUNTYWIDE AND COUNTY EMERGENCY 197 MANAGEMENT AGENCIES OR REGIONAL AUTHORITIES FOR EMERGENCY 199 MANAGEMENT, AS PROVIDED IN SUB. S.B. 239 OF THE 123rd GENERAL 201 ASSEMBLY." Section 3. That existing Section 82 of Am. Sub. H.B. 283 203 of the 123rd General Assembly is hereby repealed. 204 Section 4. The uncodified sections of law contained in 206 this act are not subject to the referendum. Therefore, under 207 Ohio Constitution, Article II, Section 1d and section 1.471 of 208 the Revised Code, the uncodified sections of law contained in 209 this act go into immediate effect when this act becomes law.
