MILLER-BARRETT 11 _________________________________________________________________ 12 A B I L L To create a grant program for fiscal year 2001 that 14 is to be administered by the Ohio Emergency 16 Management Agency and that is to provide funds for certain purposes to countywide and county 17 emergency management agencies and regional 18 authorities for emergency management, to amend Section 82 of Am. Sub. H.B. 283 of the 123rd 19 General Assembly, and to make an appropriation. 20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 22 Section 1. (A) There is hereby created a grant program 24 for fiscal year 2001 to be administered by the Ohio Emergency 25 Management Agency within the Department of Public Safety. The 26 program shall provide funds to qualifying countywide emergency 27 management agencies established under section 5502.26 of the 28 Revised Code, regional authorities for emergency management 29 established under section 5502.27 of the Revised Code, and county 30 emergency management agencies established under section 5502.271 31 of the Revised Code. 32 (B) Within one hundred twenty days after the effective 34 date of this section, the Executive Director of the Emergency 35 Management Agency shall accept and process applications for 36 grants of up to twenty-five thousand dollars each from the 37 countywide and county emergency management agencies, and regional 38 2 authorities for emergency management, of the twenty-five counties 39 with the lowest average federal adjusted gross income according 40 to the most recent figures available from the Department of 41 Taxation. The applications shall be in the form and shall be 42 filed within the time limits provided by the grant application 43 procedure, which shall be established by a committee composed of 44 the Executive Director, three employees of the Ohio Emergency 45 Management Agency chosen by the Executive Director, and three 46 members chosen by the Ohio Emergency Management Association. To 47 receive a grant under this division, an applicant shall 48 demonstrate to the satisfaction of the Executive Director all of 49 the following: (1) The countywide or county emergency management agency 51 or regional authority for emergency management serves one of the 52 twenty-five counties with the lowest average federal adjusted 53 gross income according to the most recent figures available from 54 the Department of Taxation. 55 (2) The agency or authority employs, or upon receipt of 57 the grant will employ, at least one permanent full-time employee. 58 (3) The agency or authority is, or within ninety days after 60 receipt of the grant will be, in compliance with all of the 61 requirements applicable to the agency or authority under Chapter 62 5502. of the Revised Code, including compliance with or 63 enrollment in a professional development training program in 64 accordance with rules adopted under section 5502.25 of the 66 Revised Code. (4) The agency has obtained from the board of county 68 commissioners, or the authority has obtained from the executive 69 board of the regional authority, permission to apply for and to 70 receive a grant under this section. 71 (C) Following the expiration of the one-hundred-twenty-day 73 period after the effective date of this section, all money 74 remaining in the appropriation made by this act shall be 75 available for grants to all countywide and county emergency 77 3 management agencies, and regional authorities for emergency 78 management, other than those in the twenty-five counties with the 79 lowest average federal adjusted gross income according to the 80 most recent figures available from the Department of Taxation. 81 Grants of this remaining money shall be awarded to these agencies 82 and authorities by the committee established under division (B) 83 of this section. These grants shall be used for special projects 84 proposed by the agency or authority. The committee established 85 under division (B) of this section shall establish the procedure 86 for applying for and awarding these grants and shall determine 87 the amounts to be awarded and the qualifications for projects to 88 be funded by the grants. (D) Each agency or authority shall file with its 91 application a spending plan showing how it will use the grant 92 money. Grants made under this section are not intended to 93 supplant any federal, state, or local funding to an agency or 94 authority. Therefore, neither a state agency nor any political 95 subdivision of the state shall take into account the receipt of a 96 grant under this section in determining the amount of support 97 that the state agency or political subdivision provides to a 98 countywide or county emergency management agency or regional authority for emergency management. 99 Section 2. That Section 82 of Am. Sub. H.B. 283 of the 101 123rd General Assembly be amended to read as follows: 102 "Sec. 82. The Ohio Emergency Management Agency shall develop an 156 agreement between the State of Ohio Chapters of the American Red 157 Cross to specify the terms by which these funds shall be 158 requested, distributed, and accounted for to enhance the disaster 159 response capability of the American Red Cross in Ohio. Funds shall not be used for administrative costs. The Ohio Emergency 160 Management Agency shall require of the American Red Cross a plan 161 that facilitates implementation of the current Statement of 162 Understanding between the State of Ohio and the American Red 163 Cross. The release of funds shall be contingent upon a plan that is satisfactory to both parties. 164 Ohio Task Force One - Urban Search and Rescue Unit 166 Of the foregoing appropriation item 763-403, Operating 168 Expenses - EMA, $200,000 in each fiscal year shall be used to 169 fund the Ohio Task Force One - Urban Search and Rescue Unit. 170 MARCS Operations and Maintenance Transfers 172 5 Upon the request of the Director of Public Safety, the 174 Director of Budget and Management shall transfer up to $304,284 175 in cash in fiscal year 2000 and $303,550 in cash in fiscal year 176 2001 by intrastate transfer voucher from appropriation item 177 763-409, MARCS Operations and Maintenance, to Fund 4S2, MARCS 179 Maintenance Fund. Upon the request of the Director of Public Safety, the 181 Director of Budget and Management shall transfer up to $436,000 182 in cash in fiscal year 2000 and $432,447 in cash in fiscal year 183 2001 by intrastate transfer voucher from appropriation item 184 763-409, MARCS Operations and Maintenance, to Fund 4W6, MARCS 185 Operations Fund. IFG State Match 187 The foregoing appropriation item 763-507, Individual and 189 Family Grants, shall be used to fund the state share of costs to 190 provide grants to individuals and families in cases of disaster. 191 COUNTY EMERGENCY PREPAREDNESS AND SERVICE UPGRADES PILOT 194 OF APPROPRIATION ITEM 763-634, COUNTY EMERGENCY 197 PREPAREDNESS, UP TO $1,000,000 IN FISCAL YEAR 2001 SHALL BE DISTRIBUTED TO QUALIFYING COUNTYWIDE AND COUNTY EMERGENCY 199 MANAGEMENT AGENCIES OR REGIONAL AUTHORITIES FOR EMERGENCY 201 MANAGEMENT, AS PROVIDED IN SUB. S.B. 239 OF THE 123rd GENERAL 203 ASSEMBLY." Section 3. That existing Section 82 of Am. Sub. H.B. 283 205 of the 123rd General Assembly is hereby repealed. 206 Section 4. The uncodified sections of law contained in 208 this act are not subject to the referendum. Therefore, under 209 Ohio Constitution, Article II, Section 1d and section 1.471 of 210 the Revised Code, the uncodified sections of law contained in 211 this act go into immediate effect when this act becomes law.
