Sub. H.B. 283 of the 123rd 22 General Assembly, and to make an appropriation. 23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 25 Section 1. (A) There is hereby created a grant program 27 for fiscal year 2001 to be administered by the Ohio Emergency 28 Management Agency within the Department of Public Safety. The 29 program shall provide funds to qualifying countywide emergency 30 management agencies established under section 5502.26 of the 31 Revised Code, regional authorities for emergency management 32 established under section 5502.27 of the Revised Code, and county 33 emergency management agencies established under section 5502.271 34 of the Revised Code. 35 (B) Within one hundred twenty days after the effective 37 date of this section, the Executive Director of the Emergency 38 2 Management Agency shall accept and process applications for 39 grants of up to twenty-five thousand dollars each from the 40 countywide and county emergency management agencies, and regional 41 authorities for emergency management, of the twenty-five counties 42 with the lowest average federal adjusted gross income according 43 to the most recent figures available from the Department of 44 Taxation. The applications shall be in the form and shall be 45 filed within the time limits provided by the grant application 46 procedure, which shall be established by a committee composed of 47 the Executive Director, three employees of the Ohio Emergency 48 Management Agency chosen by the Executive Director, and three 49 members chosen by the Ohio Emergency Management Association. To 50 receive a grant under this division, an applicant shall 51 demonstrate to the satisfaction of the Executive Director all of 52 the following: (1) The countywide or county emergency management agency 54 or regional authority for emergency management serves one of the 55 twenty-five counties with the lowest average federal adjusted 56 gross income according to the most recent figures available from 57 the Department of Taxation. 58 (2) The agency or authority employs, or upon receipt of 60 the grant will employ, at least one permanent full-time employee. 61 (3) The agency or authority is, or within ninety days after 63 receipt of the grant will be, in compliance with all of the 64 requirements applicable to the agency or authority under Chapter 65 5502. of the Revised Code, including compliance with or 66 enrollment in a professional development training program in 67 accordance with rules adopted under section 5502.25 of the 69 Revised Code. (4) The agency has obtained from the board of county 71 commissioners, or the authority has obtained from the executive 72 board of the regional authority, permission to apply for and to 73 receive a grant under this section. 74 (C) Following the expiration of the one-hundred-twenty-day 76 3 period after the effective date of this section, all money 77 remaining in the appropriation made by this act shall be 78 available for grants to all countywide and county emergency 80 management agencies, and regional authorities for emergency 81 management, other than those in the twenty-five counties with the 82 lowest average federal adjusted gross income according to the 83 most recent figures available from the Department of Taxation. 84 Grants of this remaining money shall be awarded to these agencies 85 and authorities by the committee established under division (B) 86 of this section. These grants shall be used for special projects 87 proposed by the agency or authority. The committee established 88 under division (B) of this section shall establish the procedure 89 for applying for and awarding these grants and shall determine 90 the amounts to be awarded and the qualifications for projects to 91 be funded by the grants. (D) Each agency or authority shall file with its 94 application a spending plan showing how it will use the grant 95 money. Grants made under this section are not intended to 96 supplant any federal, state, or local funding to an agency or 97 authority. Therefore, neither a state agency nor any political 98 subdivision of the state shall take into account the receipt of a 99 grant under this section in determining the amount of support 100 that the state agency or political subdivision provides to a 101 countywide or county emergency management agency or regional authority for emergency management. 102 Section 2. That Section 82 of Am. Sub. H.B. 283 of the 104 123rd General Assembly be amended to read as follows: 105 "Sec. 82. The Ohio Emergency Management Agency shall develop an 159 agreement between the State of Ohio Chapters of the American Red 160 Cross to specify the terms by which these funds shall be 161 requested, distributed, and accounted for to enhance the disaster 162 response capability of the American Red Cross in Ohio. Funds shall not be used for administrative costs. The Ohio Emergency 163 Management Agency shall require of the American Red Cross a plan 164 that facilitates implementation of the current Statement of 165 Understanding between the State of Ohio and the American Red 166 Cross. The release of funds shall be contingent upon a plan that is satisfactory to both parties. 167 Ohio Task Force One - Urban Search and Rescue Unit 169 5 Of the foregoing appropriation item 763-403, Operating 171 Expenses - EMA, $200,000 in each fiscal year shall be used to 172 fund the Ohio Task Force One - Urban Search and Rescue Unit. 173 MARCS Operations and Maintenance Transfers 175 Upon the request of the Director of Public Safety, the 177 Director of Budget and Management shall transfer up to $304,284 178 in cash in fiscal year 2000 and $303,550 in cash in fiscal year 179 2001 by intrastate transfer voucher from appropriation item 180 763-409, MARCS Operations and Maintenance, to Fund 4S2, MARCS 182 Maintenance Fund. Upon the request of the Director of Public Safety, the 184 Director of Budget and Management shall transfer up to $436,000 185 in cash in fiscal year 2000 and $432,447 in cash in fiscal year 186 2001 by intrastate transfer voucher from appropriation item 187 763-409, MARCS Operations and Maintenance, to Fund 4W6, MARCS 188 Operations Fund. IFG State Match 190 The foregoing appropriation item 763-507, Individual and 192 Family Grants, shall be used to fund the state share of costs to 193 provide grants to individuals and families in cases of disaster. 194 COUNTY EMERGENCY PREPAREDNESS AND SERVICE UPGRADES PILOT 197 OF APPROPRIATION ITEM 763-634, COUNTY EMERGENCY 200 PREPAREDNESS, UP TO $1,000,000 IN FISCAL YEAR 2001 SHALL BE DISTRIBUTED TO QUALIFYING COUNTYWIDE AND COUNTY EMERGENCY 202 MANAGEMENT AGENCIES OR REGIONAL AUTHORITIES FOR EMERGENCY 204 MANAGEMENT, AS PROVIDED IN SUB. S.B. 239 OF THE 123rd GENERAL 206 ASSEMBLY." Section 3. That existing Section 82 of Am. Sub. H.B. 283 208 of the 123rd General Assembly is hereby repealed. 209 Section 4. The uncodified sections of law contained in 211 this act are not subject to the referendum. Therefore, under 212 Ohio Constitution, Article II, Section 1d and section 1.471 of 213 the Revised Code, the uncodified sections of law contained in 214 this act go into immediate effect when this act becomes law.
