No. 300 5 1999-2000 6 SENATOR LATTA-REPRESENTATIVES MYERS-LOGAN-MEAD 8 _________________________________________________________________ 9 A B I L L To authorize the Board of Trustees of Bowling Green 11 State University to convey state-owned real 12 estate located in Wood County, and to authorize 13 the Governor to convey state-owned real estate 14 located in Wood County. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 16 Section 1. (A) The Board of Trustees of Bowling Green 18 State University is hereby authorized to execute deeds in the 19 name of the Board of Trustees conveying to purchasers and the 20 purchasers' heirs and assigns or successors and assigns all of 21 the Board's right, title, and interest in any portion of the 22 following described real estate: 23 Parcel No. 1 25 Situated in the County of Wood, State of Ohio, and Township 27 of Center, and bounded and described as follows: 28 Commencing at the northeast corner of the southeast quarter 30 of the northeast quarter of Section 20, Town 5 North, Range 11 31 East, thence west along the center of a ditch 19 chains, 26 links 32 to a ditch; then south along the last named ditch 22 chains, 80 33 links thence east to the east line of said section to a point 42 34 chains, 27 links south of the northeast corner thereof; thence north 22 chains, 80 links to the place of beginning, containing 35 44 acres more or less, all in Center Township, Wood County, Ohio. 36 Parcel No. 2 38 The North three-fourths (3/4) of the East one-half (1/2) of 40 Section 20, Town Five North, Range Eleven (11) East, Center 41 2 Township, Wood County, Ohio, less the following described 42 parcels, to-wit: Parcel A. Commencing 20 11/100 chains east of the center 44 of the southwest quarter of Section 20, Town 5 North, Range 11 45 East, Wood County, Ohio, thence north 39 78/100 chains to a 46 stone, thence west 11 71/100 links, thence north on the half 47 section line to a stone in the Poe Road, thence East 2 71/100 chains, thence southerly 59 50/100 chains to the Meeker Road, 48 thence west 77 1/2 links to the place of beginning, containing 11 49 acres. Parcel B. The east 74.28 acres, more or less, of the North 51 one-half (1/2) of the Northeast quarter (1/4) of said Section 20, 52 being all that portion thereof which lies east of the eleven (11) 53 acre tract hereinbefore described heretofore conveyed to Joseph 54 H. Mitchell. Parcel C. Commencing at the northeast corner of the 56 southeast quarter of the northeast quarter of said section 20, 57 thence west along the center of a ditch, 19 chains 26 links to a 58 ditch, thence south along the last named ditch 22 chains 80 59 links, thence east to the east line of said section at a point 42 chains 27 links south of the northeast corner thereof, thence 60 north 22 chains 80 links to the place of beginning, containing 44 61 acres, more or less. Parcel D. Commencing 78 feet north of the east quarter 63 post of the southeast quarter of said Section 20, thence west 131 64 feet, thence north 76 feet, thence East 131 feet, thence south 76 65 feet to the place of beginning, containing one-fourth (1/4) of an 66 acre more or less. Parcel E. All lands in the right-of-way of Interstate 75 68 conveyed to the State of Ohio, Department of Highways in a deed 69 recorded in Volume 445, page 829 in the records of Wood County, 70 Ohio. (B) Prior to executing a deed to convey any portion of the 72 real estate described in division (A) of this section, the Board 73 3 of Trustees of Bowling Green State University shall have the 74 parcel to be conveyed surveyed, prepare a legal description to 75 the parcel, and deliver the description to the Auditor of State 76 for preparation of the deed. 77 (C) The consideration for the real estate described in 79 division (A) of this section, or any portion thereof, shall be a 80 purchase price acceptable to the Board of Trustees of Bowling 81 Green State University following a survey by a licensed surveyor 82 and an appraisal by one or more disinterested persons. 83 (D) The real estate described in division (A) of this 85 section, or any portion thereof, shall be conveyed only to 86 persons whose intended use of the real estate is consistent with 87 the purposes of Bowling Green State University, which include 88 facilitating the broadening of the economic base of Wood County 89 and the City of Bowling Green. 90 (E) Any offer to purchase shall be accompanied by a 92 deposit of up to ten per cent of the purchase price as determined 93 appropriate by the Board of Trustees of Bowling Green State 94 University, in money order or bank draft. The balance of the 95 purchase price shall be paid within sixty days after notification 96 of acceptance of the offer has been sent by the Board of Trustees 97 to the offeror, or at such later time as is specified in the 98 contract of sale. If an offer has been accepted and the offeror 99 does not pay the balance within the time limits provided in this 100 division, the offeror shall forfeit the deposit to the Board of 101 Trustees as liquidated damages. (F) Upon payment of the purchase price by the purchaser, 103 the Auditor of State, with the assistance of the Attorney 104 General, shall prepare a deed to the real estate described in 105 division (A) of this section. The deed shall state the 106 consideration and shall be executed by the Board of Trustees of 107 Bowling Green State University and presented in the office of the 109 Auditor of State for recording, and delivered to the purchaser. 110 The purchaser shall present the deed for recording in the office 111 4 of the Wood County Recorder. (G) Advertising costs, appraisal fees, and all other costs 113 of the sale of the real estate described in division (A) of this 114 section shall be paid by the Board of Trustees of Bowling Green 115 State University unless otherwise specified in the contract of 116 sale. (H) The net proceeds of sales of the real estate described 118 in division (A) of this section, or any portion thereof, shall be 119 paid to Bowling Green State University and deposited in the 120 appropriate University accounts for purposes to be determined by 121 the Board of Trustees of Bowling Green State University. 122 Section 2. (A) The Governor is hereby authorized to 124 execute deeds in the name of the state conveying to purchasers 125 and the purchasers' heirs and assigns or successors and assigns 126 all of the state's right, title, and interest in any portion of 127 the following described real estate: 128 Parcel No. 1 130 Situated in the County of Wood, in the State of Ohio, and 132 in the Township of Center, Town 5 North, Range 11 East in the 133 South half of Section 17, and being a part of that land conveyed 134 to the State of Ohio, Department of Highways in a deed recorded 135 in Volume 445, Page 879, in the records of Wood County, described 136 as follows: Beginning at a point in the South line of the Southwest 138 quarter of Section 17, Town 5 North, Range 11 East in Poe Road, 139 1986.60 feet East from the Southwest corner of said Section 17, 140 said point being in the Southwest corner of lands owned by the 141 State of Ohio Department of Highways; thence North 1 degree 08 minutes 46 seconds West along the East property line of lands 142 owned by Bowling Green State University, a distance of 2630.76 143 feet to a point in the East-West half section line of said 144 Section 17, said point being in the Northwest corner of property 145 herein described, and being 1986.60 feet East of the Northwest corner of said Southwest quarter of said section; thence South 89 146 5 degrees 06 minutes 35 seconds East along said East-West half 147 section line, a distance of 1702.14 feet to a point in the West 148 Limited Access right-of-way line of I.R. 75, Section 14.91, in 149 Wood County; thence South 1 degree 01 minutes 10 seconds East 150 along said right-of-way line a distance of 775.89 feet to a point; thence South 0 degrees 18 minutes 37 seconds West, along 151 said right-of-way line, a distance of 1749.76 feet to a point; 152 thence South 88 degrees 11 minutes 55 seconds West, a distance of 153 1127.42 feet to a point; thence South 0 degrees 46 minutes 18 154 seconds West, a distance of 50.00 feet to a point in the South line of the Southwest quarter of Section 17, 172.78 feet West of 155 the Southeast corner of the Southwest quarter of Section 17; 156 thence North 89 degrees 13 minutes 42 seconds West, a distance of 157 526.16 feet along the South line of the Southwest quarter of 158 Section 17 and Poe Road, to the point of beginning, containing 159 100.95 acres, more or less. Parcel No. 2 161 Situated in the County of Wood in the State of Ohio, and in 163 the Township of Center, Town 5 North, Range 11 East in the North 164 half of Section 17, and being a part of that land conveyed to the 165 State of Ohio, Department of Highways in a deed recorded in 166 Volume 445, Page 888, in the records of Wood County, Ohio, described as follows: 167 Beginning at a point in the North line of the Northeast 169 quarter of Section 17 in Newton Road, at the intersection of the 170 West Limited Access right-of-way line of I.R. 75, Section 14.91 171 in Wood County, 1002.83 feet East from the Northwest corner of 172 the Northeast quarter of said Section 17, and 1660.48 feet west 173 from the Northeast corner of the Northeast quarter of said Section 17; thence South 0 degrees 18 minutes 37 seconds West 174 along said right-of-way line, a distance of 2632.20 feet to a 175 point in the East-West half section line of Section 17, 1675.46 176 feet from the Southeast corner of the Northeast quarter of 177 Section 17; thence North 89 degrees 06 minutes 35 seconds West 6 along said East-West half section line, a distance of 1356.90 178 feet to a point in the Southwest corner of the parcel herein 179 described; thence North 0 degrees 46 minutes 52 seconds East 180 along the West property line of said parcel, a distance of 181 2621.39 feet to a point in the North line of the Northwest quarter of Section 17 and in Newton Road, 332.48 feet West of the 182 Northeast corner of said Northwest quarter of Section 17; thence 183 South 89 degrees 34 minutes 40 seconds East, a distance of 332.48 184 feet to the Northeast corner of said Northeast quarter, thence 185 South 89 degrees 33 minutes 53 seconds East along the North line 186 of the Northeast quarter of Section 17, a distance of 1002.83 feet to the place of beginning, containing 81.17 acres, more or 187 less. Parcel No. 3 189 All that part of the North three-quarters of Section 20, 191 Center Township, Wood County, Ohio, lying east of the East line 192 of Interstate 75 (lands for Interstate 75 conveyed to the State 193 of Ohio, Department of Highways, by instrument recorded in Volume 194 453, Page 861, Deed Records, Wood County, Ohio), excepting 195 therefrom the following described two parcels of real estate, to wit: 196 Parcel A: Commencing 75 feet north of the east quarter 198 post of the Southeast quarter of Section 20, Center Township, 199 Wood County, Ohio, thence West 131 feet; thence North 76 feet; 200 thence East 131 feet; thence South 76 feet to the place of 201 beginning, containing about one-quarter of an acre, more or less; and Parcel B: Beginning at the Northeast Corner of Section 20, 203 Town 5 North, Range 11 East, Center Township, Wood County, Ohio, 204 said point being the intersection of the center lines of 205 Dunbridge and Poe Roads; thence Southerly along the center line 206 of Dunbridge Road and East line of Section 20, a distance of 207 twelve hundred and eighty five and 02/100 (1,285.02) feet to the South line of the North one-half (1/2) of the Northeast 208 7 one-quarter (1/4) of Section 20; thence Westerly along the last 209 described line a distance of fourteen hundred thirty four (1,434) 210 feet, more or less, to the Eastern right-of-way line of I-75; 211 thence Northerly and along said right-of-way line a distance of 212 thirteen hundred five (1,305) feet, more or less, to the North line of Section 20 and center line of Poe Road; thence Easterly 213 along last described line a distance of fourteen hundred one and 214 26/100 (1,401.26) feet to the place of beginning. Subject, 215 however, to all legal highways, rights-of-way, easements and 216 appurtenances thereunto included. Containing 42 acres, more or 217 less. (B) Prior to the Governor executing a deed to convey any 219 portion of the real estate described in division (A) of this 220 section, the Board of Trustees of Bowling Green State University 221 shall have the parcel to be conveyed surveyed, prepare a legal 222 description to the parcel, and deliver the description to the 223 Auditor of State for preparation of the deed. 224 (C) The consideration for the real estate described in 226 division (A) of this section, or any portion thereof, shall be a 227 purchase price acceptable to the Board of Trustees of Bowling 228 Green State University following a survey by a licensed surveyor 229 and an appraisal by one or more disinterested persons. 230 (D) The real estate described in division (A) of this 232 section, or any portion thereof, shall be conveyed only to 233 persons whose intended use of the real estate is consistent with 234 the purposes of Bowling Green State University, which include 235 facilitating the broadening of the economic base of Wood County 236 and the City of Bowling Green. 237 (E) Any offer to purchase shall be accompanied by a 239 deposit of up to ten per cent of the purchase price as determined 240 appropriate by the Board of Trustees of Bowling Green State 241 University, in money order or bank draft. The purchaser shall present the deed for recording in 258 the office of the Wood County Recorder. 259 (G) Advertising costs, appraisal fees, and all other costs 261 of the sale of the real estate described in division (A) of this 262 section shall be paid by the Board of Trustees of Bowling Green 263 State University unless otherwise specified in the contract of 264 sale. (H) The net proceeds of sales of the real estate described 266 in division (A) of this section, or any portion thereof, shall be 267 paid to Bowling Green State University and deposited in the 268 appropriate University accounts for purposes to be determined by 269 the Board of Trustees of Bowling Green State University. 270 Section 3. This act shall expire ten years after its 272 effective date. 273
