             To authorize the Board of Trustees of Bowling Green   12           

                State University to convey state-owned real        13           

                estate located in Wood County, and to authorize    14           

                the Governor to convey state-owned real estate     15           

                located in Wood County.                                         




BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:        17           

      Section 1.  (A)  The Board of Trustees of Bowling Green      19           

State University is hereby authorized to execute deeds in the      20           

name of the Board of Trustees conveying to purchasers and the      21           

purchasers' heirs and assigns or successors and assigns all of     22           

the Board's right, title, and interest in any portion of the       23           

following described real estate:                                   24           

      Parcel No. 1                                                 26           

      Situated in the County of Wood, State of Ohio, and Township  28           

of Center, and bounded and described as follows:                   29           

      Commencing at the northeast corner of the southeast quarter  31           

of the northeast quarter of Section 20, Town 5 North, Range 11     32           

East, thence west along the center of a ditch 19 chains, 26 links  33           

to a ditch; then south along the last named ditch 22 chains, 80    34           

links thence east to the east line of said section to a point 42   35           

chains, 27 links south of the northeast corner thereof; thence                  

north 22 chains, 80 links to the place of beginning, containing    36           

44 acres more or less, all in Center Township, Wood County, Ohio.  37           

      Parcel No. 2                                                 39           

      The North three-fourths (3/4) of the East one-half (1/2) of  41

Section 20, Town Five North, Range Eleven (11) East, Center        42           

Township, Wood County, Ohio, less the following described          43           

parcels, to-wit:                                                                

      Parcel A.  Commencing 20 11/100 chains east of the center    45           

of the southwest quarter of Section 20, Town 5 North, Range 11     46           

East, Wood County, Ohio, thence north 39 78/100 chains to a        47           

stone, thence west 11 71/100 links, thence north on the half       48           

section line to a stone in the Poe Road, thence East 2 71/100                   

chains, thence southerly 59 50/100 chains to the Meeker Road,      49           

thence west 77 1/2 links to the place of beginning, containing 11  50           

acres.                                                                          

      Parcel B.  The east 74.28 acres, more or less, of the North  52           

one-half (1/2) of the Northeast quarter (1/4) of said Section 20,  53           

being all that portion thereof which lies east of the eleven (11)  54           

acre tract hereinbefore described heretofore conveyed to Joseph    55           

H. Mitchell.                                                                    

      Parcel C.  Commencing at the northeast corner of the         57           

southeast quarter of the northeast quarter of said section 20,     58           

thence west along the center of a ditch, 19 chains 26 links to a   59           

ditch, thence south along the last named ditch 22 chains 80        60           

links, thence east to the east line of said section at a point 42               

chains 27 links south of the northeast corner thereof, thence      61           

north 22 chains 80 links to the place of beginning, containing 44  62           

acres, more or less.                                                            

      Parcel D.  Commencing 78 feet north of the east quarter      64           

post of the southeast quarter of said Section 20, thence west 131  65           

feet, thence north 76 feet, thence East 131 feet, thence south 76  66           

feet to the place of beginning, containing one-fourth (1/4) of an  67           

acre more or less.                                                              

      Parcel E.  All lands in the right-of-way of Interstate 75    69           

conveyed to the State of Ohio, Department of Highways in a deed    70           

recorded in Volume 445, page 829 in the records of Wood County,    71           

Ohio.                                                                           

      (B)  Prior to executing a deed to convey any portion of the  73

real estate described in division (A) of this section, the Board   74           

of Trustees of Bowling Green State University shall have the       75           

parcel to be conveyed surveyed, prepare a legal description to     76           

the parcel, and deliver the description to the Auditor of State    77           

for preparation of the deed.                                       78           

      (C)  The consideration for the real estate described in      80           

division (A) of this section, or any portion thereof, shall be a   81           

purchase price acceptable to the Board of Trustees of Bowling      82           

Green State University following a survey by a licensed surveyor   83           

and an appraisal by one or more disinterested persons.             84           

      (D)  The real estate described in division (A) of this       86           

section, or any portion thereof, shall be conveyed only to         87           

persons whose intended use of the real estate is consistent with   88           

the purposes of Bowling Green State University, which include      89           

facilitating the broadening of the economic base of Wood County    90           

and the City of Bowling Green.                                     91           

      (E)  Any offer to purchase shall be accompanied by a         93           

deposit of up to ten per cent of the purchase price as determined  94           

appropriate by the Board of Trustees of Bowling Green State        95           

University, in money order or bank draft.  The balance of the      96           

purchase price shall be paid within sixty days after notification  97           

of acceptance of the offer has been sent by the Board of Trustees  98           

to the offeror, or at such later time as is specified in the       99           

contract of sale.  If an offer has been accepted and the offeror   100          

does not pay the balance within the time limits provided in this   101          

division, the offeror shall forfeit the deposit to the Board of    102          

Trustees as liquidated damages.                                                 

      (F)  Upon payment of the purchase price by the purchaser,    104          

the Auditor of State, with the assistance of the Attorney          105          

General, shall prepare a deed to the real estate described in      106          

division (A) of this section.  The deed shall state the            107          

consideration and shall be executed by the Board of Trustees of    108          

Bowling Green State University and presented in the office of the  110          

Auditor of State for recording, and delivered to the purchaser.    111

The purchaser shall present the deed for recording in the office   112          

of the Wood County Recorder.                                                    

      (G)  Advertising costs, appraisal fees, and all other costs  114          

of the sale of the real estate described in division (A) of this   115          

section shall be paid by the Board of Trustees of Bowling Green    116          

State University unless otherwise specified in the contract of     117          

sale.                                                                           

      (H)  The net proceeds of sales of the real estate described  119          

in division (A) of this section, or any portion thereof, shall be  120          

paid to Bowling Green State University and deposited in the        121          

appropriate University accounts for purposes to be determined by   122          

the Board of Trustees of Bowling Green State University.           123          

      Section 2.  (A)  The Governor is hereby authorized to        125          

execute deeds in the name of the state conveying to purchasers     126          

and the purchasers' heirs and assigns or successors and assigns    127          

all of the state's right, title, and interest in any portion of    128          

the following described real estate:                               129          

      Parcel No. 1                                                 131          

      Situated in the County of Wood, in the State of Ohio, and    133          

in the Township of Center, Town 5 North, Range 11 East in the      134          

South half of Section 17, and being a part of that land conveyed   135          

to the State of Ohio, Department of Highways in a deed recorded    136          

in Volume 445, Page 879, in the records of Wood County, described  137          

as follows:                                                                     

      Beginning at a point in the South line of the Southwest      139          

quarter of Section 17, Town 5 North, Range 11 East in Poe Road,    140          

1986.60 feet East from the Southwest corner of said Section 17,    141          

said point being in the Southwest corner of lands owned by the     142          

State of Ohio Department of Highways; thence North 1 degree 08                  

minutes 46 seconds West along the East property line of lands      143          

owned by Bowling Green State University, a distance of 2630.76     144          

feet to a point in the East-West half section line of said         145          

Section 17, said point being in the Northwest corner of property   146          

herein described, and being 1986.60 feet East of the Northwest

degrees 06 minutes 35 seconds East along said East-West half       148          

section line, a distance of 1702.14 feet to a point in the West    149

Wood County; thence South 1 degree 01 minutes 10 seconds East      151          

along said right-of-way line a distance of 775.89 feet to a                     

point; thence South 0 degrees 18 minutes 37 seconds West, along    152          

said right-of-way line, a distance of 1749.76 feet to a point;     153          

thence South 88 degrees 11 minutes 55 seconds West, a distance of  154          

1127.42 feet to a point; thence South 0 degrees 46 minutes 18      155          

seconds West, a distance of 50.00 feet to a point in the South                  

line of the Southwest quarter of Section 17, 172.78 feet West of   156          

the Southeast corner of the Southwest quarter of Section 17;       157          

thence North 89 degrees 13 minutes 42 seconds West, a distance of  158          

526.16 feet along the South line of the Southwest quarter of       159          

Section 17 and Poe Road, to the point of beginning, containing     160          

100.95 acres, more or less.                                                     

      Parcel No. 2                                                 162          

      Situated in the County of Wood in the State of Ohio, and in  164          

the Township of Center, Town 5 North, Range 11 East in the North   165          

half of Section 17, and being a part of that land conveyed to the  166          

State of Ohio, Department of Highways in a deed recorded in        167          

Volume 445, Page 888, in the records of Wood County, Ohio,                      

described as follows:                                              168          

      Beginning at a point in the North line of the Northeast      170          

quarter of Section 17 in Newton Road, at the intersection of the   171          

West Limited Access right-of-way line of I.R. 75, Section 14.91    172          

in Wood County, 1002.83 feet East from the Northwest corner of     173          

the Northeast quarter of said Section 17, and 1660.48 feet west    174          

from the Northeast corner of the Northeast quarter of said                      

Section 17; thence South 0 degrees 18 minutes 37 seconds West      175          

along said right-of-way line, a distance of 2632.20 feet to a      176          

point in the East-West half section line of Section 17, 1675.46    177

      Parcel No. 3                                                 190          

      All that part of the North three-quarters of Section 20,     192          

Center Township, Wood County, Ohio, lying east of the East line    193          

of Interstate 75 (lands for Interstate 75 conveyed to the State    194          

of Ohio, Department of Highways, by instrument recorded in Volume  195          

453, Page 861, Deed Records, Wood County, Ohio), excepting         196          

therefrom the following described two parcels of real estate, to                

wit:                                                               197          

      Parcel A:  Commencing 75 feet north of the east quarter      199          

post of the Southeast quarter of Section 20, Center Township,      200          

Wood County, Ohio, thence West 131 feet; thence North 76 feet;     201          

thence East 131 feet; thence South 76 feet to the place of         202          

beginning, containing about one-quarter of an acre, more or less;               

and                                                                             

      Parcel B:  Beginning at the Northeast Corner of Section 20,  204          

Town 5 North, Range 11 East, Center Township, Wood County, Ohio,   205          

said point being the intersection of the center lines of           206          

Dunbridge and Poe Roads; thence Southerly along the center line    207          

of Dunbridge Road and East line of Section 20, a distance of       208          

twelve hundred and eighty five and 02/100 (1,285.02) feet to the

South line of the North one-half (1/2) of the Northeast            209          

one-quarter (1/4) of Section 20; thence Westerly along the last    210          

described line a distance of fourteen hundred thirty four (1,434)  211          

feet, more or less, to the Eastern right-of-way line of I-75;      212          

thence Northerly and along said right-of-way line a distance of    213          

thirteen hundred five (1,305) feet, more or less, to the North                  

line of Section 20 and center line of Poe Road; thence Easterly    214          

along last described line a distance of fourteen hundred one and   215          

26/100 (1,401.26) feet to the place of beginning.  Subject,        216          

however, to all legal highways, rights-of-way, easements and       217          

appurtenances thereunto included.  Containing 42 acres, more or    218          

less.                                                                           

      (B)  Prior to the Governor executing a deed to convey any    220          

portion of the real estate described in division (A) of this       221          

section, the Board of Trustees of Bowling Green State University   222          

shall have the parcel to be conveyed surveyed, prepare a legal     223          

description to the parcel, and deliver the description to the      224          

Auditor of State for preparation of the deed.                      225          

      (C)  The consideration for the real estate described in      227          

division (A) of this section, or any portion thereof, shall be a   228          

purchase price acceptable to the Board of Trustees of Bowling      229          

Green State University following a survey by a licensed surveyor   230          

and an appraisal by one or more disinterested persons.             231          

      (D)  The real estate described in division (A) of this       233          

section, or any portion thereof, shall be conveyed only to         234          

persons whose intended use of the real estate is consistent with   235

purchaser.  The purchaser shall present the deed for recording in  259          

the office of the Wood County Recorder.                            260          

      (G)  Advertising costs, appraisal fees, and all other costs  262          

of the sale of the real estate described in division (A) of this   263          

section shall be paid by the Board of Trustees of Bowling Green    264          

State University unless otherwise specified in the contract of     265          

sale.                                                                           

      (H)  The net proceeds of sales of the real estate described  267          

in division (A) of this section, or any portion thereof, shall be  268          

paid to Bowling Green State University and deposited in the        269          

appropriate University accounts for purposes to be determined by   270          

the Board of Trustees of Bowling Green State University.           271          

      Section 3.  This act shall expire ten years after its        273          

effective date.                                                    274
