The plan shall consist of a comprehensive, 1,222 detailed, and specialized landscaping plan for portions of the 1,223 real estate that are to be conveyed pursuant to division (A) of 1,224 this section and that are adjacent to the Apple Creek 1,225 Developmental Center. The "Buffer Zone Plan" shall identify the area under the jurisdiction of the plan, inventory proposed tree 1,226 and vegetation installations, and provide a timetable for 1,227 completion of the plan, taking into account visual impact and 1,228 scientifically sound odor management principles. 1,229 (I) The "Buffer Zone Plan" described in division (H) of 1,231 this section shall be developed by the College of Food, 1,232 Agriculture, and Environmental Sciences of The Ohio State 1,234 University and implemented by the College at the College's sole 1,235 expense within three years after the effective date of this act. 1,236 If the College has not implemented the plan as approved by the 1,238 Director of Mental Retardation and Developmental Disabilities 1,239 pursuant to division (H) of this section, all right, title, and 1,240 interest in the transferred real estate shall immediately revert 1,241 to the state and the jurisdiction of the Department of Mental 1,242 Retardation and Developmental Disabilities without the need for 1,243 further action by the grantor. (J) The conveyance of the real estate described in 1,245 division (A) of this section is subject to the conditions that 1,246 The Ohio State University and its College of Food, Agriculture, 1,247 and Environmental Sciences accept the real estate subject to a 1,248 former Indian burial ground that is believed to be located on the 1,249 real estate in or near the wooded plot southeast of the 1,250 intersection of Ely Road and Barnard Road in Wayne County, and 1,251 34 that The Ohio State University and its College of Food, 1,252 Agriculture, and Environmental Sciences assume all obligations 1,253 associated with that former Indian burial ground. If The Ohio 1,254 State University and its College of Food, Agriculture, and 1,255 Environmental Sciences do not assume such responsibilities as 1,256 provided in this section, all right, title, and interest in the 1,257 transferred real estate shall immediately revert to the state and 1,258 the jurisdiction of the Department of Mental Retardation and 1,259 Developmental Disabilities without the need for further action by 1,260 the grantor. (K) The conveyance described in division (A) of this 1,262 section is contingent upon The Ohio State University's 1,263 satisfaction with the result of a due diligence investigation of 1,264 the real estate, which The Ohio State University shall conduct. 1,265 If The Ohio State University is not satisfied with the result of 1,266 its investigation, it may, as soon as reasonably feasible after 1,267 the effective date of this act, provide written notice of its 1,268 intent not to proceed with the conveyance to the Director of 1,269 Mental Retardation and Developmental Disabilities and shall have 1,270 no further obligation with respect to the conveyance. 1,271 (L) The conveyance described in division (A) of this 1,273 section is contingent upon The Ohio State University obtaining a 1,274 title insurance commitment to issue a title insurance policy 1,275 insuring the real estate satisfactory to The Ohio State 1,277 University as soon as reasonably feasible after the effective date of this act. If The Ohio State University does not obtain 1,279 title insurance that it considers satisfactory, it may, as soon 1,280 as reasonably feasible after the effective date of this act, 1,282 notify the Director of Mental Retardation and Developmental 1,284 Disabilities that it does not intend to proceed with the conveyance and shall be under no further obligation with respect 1,286 to the conveyance. (M) The conveyance described in division (A) of this 1,288 section is contingent upon the approval of the conveyance by the 1,289 35 Board of Trustees of The Ohio State University, if the board 1,290 determines that its approval is necessary. The Ohio State 1,292 University may, if its Board of Trustees has failed to approve 1,293 the conveyance, notify the Director of Mental Retardation and 1,294 Developmental Disabilities as soon as reasonably feasible after 1,295 the effective date of this act that it does not intend to proceed 1,296 with the conveyance and shall have no further obligation with 1,297 respect to the conveyance. 1,298 (N) The conveyance described in division (A) of this 1,300 section is subject to all easements including an easement of the 1,301 State of Ohio with regard to one producing water well that 1,302 currently supplies the Apple Creek Developmental Center, which 1,303 easement shall be retained by the State of Ohio. The Department 1,305 of Mental Retardation and Developmental Disabilities shall 1,306 maintain and repair, at its expense, this well and the lines 1,307 transporting water to the Apple Creek Developmental Center. The 1,308 Ohio State University and its College of Food, Agriculture, and 1,309 Environmental Sciences shall take no action that would interfere 1,310 with continued production of potable water from the identified 1,312 well. The Department shall maintain well head pumps or supply 1,314 lines, or both, between the well location and the Apple Creek Developmental Center. 1,315 (O) The conveyance described in division (A) of this 1,317 section is subject to the condition that The Ohio State 1,318 University not convey any or all of the real estate conveyed to 1,319 it pursuant to this act to any nonstate entity for a period of 1,320 ten years from the effective date of this act. If The Ohio State 1,321 University conveys the real estate contrary to the provisions of 1,322 this section, all right, title, and interest in the transferred 1,323 real estate shall immediately revert to the state and the 1,324 jurisdiction of the Department of Mental Retardation and 1,325 Developmental Disabilities without the need for further action by 1,326 the grantor. (P) If any of the four existing water wells serving the 1,328 36 Apple Creek Developmental Center ceases to produce potable water, 1,329 the Department of Mental Retardation and Developmental 1,330 Disabilities shall explore replacement of any such well that 1,331 ceases to produce sufficient potable water and shall seek a well 1,332 site that is within the real property remaining under the 1,333 jurisdiction of the Department. If the replacement water well is 1,335 unable to be located within the real property remaining under the 1,336 jurisdiction of the Department at the Apple Creek Developmental 1,338 Center, the Department may seek, drill, and maintain a water well 1,340 source on the real estate described in division (A) of this 1,341 section at a site mutually agreed upon by the Director of Mental 1,342 Retardation and Developmental Disabilities and the Vice-President 1,343 of the College of Food, Agriculture, and Environmental Sciences 1,344 of The Ohio State University. Any replacement water wells must 1,345 produce, in concert with the remaining well sources, potable 1,346 water to the Apple Creek Developmental Center in an amount 1,347 sufficient to adequately supply the needs of the Apple Creek Developmental Center as determined by the Director. 1,348 (Q) Upon the conveyance of the real estate described in 1,350 division (A) of this section, the Inter-Agency Lease between the 1,351 Department of Mental Retardation and Developmental Disabilities, 1,352 through the Department of Administrative Services, and The Ohio 1,353 State University for approximately 1272.92 acres of the real 1,355 estate described in division (A) of this section for a period of 1,356 forty years to expire on January 31, 2025, and bearing file No. 1,357 3759-A (the "Lease"), shall automatically terminate and have no 1,358 further force or effect. The 1,575 payment shall be in cash and/or payment schedule and cash 1,576 equivalent obligation of the City of Massillon to provide 1,577 designated services to the Heartland Behavioral Healthcare 1,578 Organization/Massillon Campus as agreed to by both parties. The 1,579 City of Massillon shall provide all agreed upon remuneration 1,580 43 within two years of the transfer. 1,581 (E) After control of parcel 3 of the property described in 1,583 division (A) of this section is transferred, the Heartland 1,584 Behavioral Healthcare Organization/Massillon Campus shall 1,585 continue to have use of the boiler plant identified as building 1,586 8.004 located thereon, and necessary access thereto, until it no 1,587 longer has a need for this boiler plant. 1,588 (F) The City of Massillon agrees that it will not use or 1,590 develop the property described in division (A) of this section 1,591 for other than a municipal park, for an educational or 1,592 recreational purpose, or otherwise with the concurrence of the 1,593 Ohio Department of Mental Health, and that it will not sell the 1,594 Property for any use or development beyond these purposes. The 1,595 "quiet enjoyment" of the adjacent property by the Heartland 1,596 Behavioral Healthcare Organization/Massillon Campus, the Ohio 1,597 Department of Mental Health, and the residents of the Heartland 1,598 Behavioral Healthcare Organization/Massillon Campus are critical 1,599 factors in this transaction. 1,600 (G) Upon payment of the first installment of the 1,602 consideration, as described in division (B) of this section, the 1,603 Auditor of State, with the assistance of the Attorney General, 1,604 shall prepare a deed to the real estate described in division (A) 1,605 of this section.
