A B I L L
To amend sections 1901.02, 1901.08, 1901.09, 11
1901.183, and 1907.131 of the Revised Code to 12
clarify the jurisdiction of the environmental 13
division of a municipal court in foreclosure 14
actions, to provide that the presiding judge and 15
administrative judge in multi-judge municipal
courts and county courts are to be determined as 16
provided in the Rules of Superintendence for the 17
Courts of Ohio, to rename the Lancaster Municipal
Court as the Fairfield County Municipal Court, 18
effective January 2, 2000, and to declare an
emergency. 19
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 21
Section 1. That sections 1901.02, 1901.08, 1901.09, 23
1901.183, and 1907.131 of the Revised Code be amended to read as 24
follows:
Sec. 1901.02. (A) The municipal courts established by 33
section 1901.01 of the Revised Code have jurisdiction within the 34
corporate limits of their respective municipal corporations, or, 35
for the Clermont county municipal court, within the municipal 36
corporation or unincorporated territory in which it is 37
established, and are courts of record. Each of the courts shall 38
be styled ".................................. municipal court," 39
inserting the name of the municipal corporation, except the 40
following courts, which shall be styled as set forth below: 41
(1) The municipal court established in Chesapeake that 43

shall be styled and known as the "Lawrence county municipal 44
court"; 45
(2) The municipal court established in Cincinnati that 47
shall be styled and known as the "Hamilton county municipal 48
court"; 49
(3) The municipal court established in Ravenna that shall 51
be styled and known as the "Portage county municipal court"; 52
(4) The municipal court established in Athens that shall 54
be styled and known as the "Athens county municipal court"; 55
(5) The municipal court established in Columbus that shall 57
be styled and known as the "Franklin county municipal court"; 58
(6) The municipal court established in London that shall 60
be styled and known as the "Madison county municipal court"; 61
(7) The municipal court established in Newark that shall 63
be styled and known as the "Licking county municipal court"; 64
(8) The municipal court established in Wooster that shall 66
be styled and known as the "Wayne county municipal court"; 67
(9) The municipal court established in Wapakoneta that 69
shall be styled and known as the "Auglaize county municipal 70

(10) The municipal court established in Troy that shall be 73
styled and known as the "Miami county municipal court"; 74
(11) The municipal court established in Bucyrus that shall 76
be styled and known as the "Crawford county municipal court"; 77

(13) The municipal court established in Urbana that shall 82

and known as the "Clermont county municipal court";
(18) The municipal court established in Wilmington that, 100
beginning July 1, 1992, shall be styled and known as the "Clinton 101
county municipal court"; 102
(19) The municipal court established in Port Clinton that 104
shall be styled and known as "the Ottawa county municipal court"; 105
(20) THE MUNICIPAL COURT ESTABLISHED IN LANCASTER THAT, 107
BEGINNING JANUARY 2, 2000, SHALL BE STYLED AND KNOWN AS THE 109
"FAIRFIELD COUNTY MUNICIPAL COURT."
(B) In addition to the jurisdiction set forth in division 111
(A) of this section, the municipal courts established by section 112
1901.01 of the Revised Code have jurisdiction as follows: 113
The Akron municipal court has jurisdiction within Bath, 115
Northampton, Richfield, and Springfield townships, and within the 116
municipal corporations of Fairlawn, Lakemore, and Mogadore, in 117
Summit county. 118
The Alliance municipal court has jurisdiction within 120
Lexington, Marlboro, Paris, and Washington townships in Stark 121
county. 122
The Ashland municipal court has jurisdiction within Ashland 124
county. 125
The Ashtabula municipal court has jurisdiction within 127
Ashtabula, Plymouth, and Saybrook townships in Ashtabula county. 128
The Athens county municipal court has jurisdiction within 130

The Bedford municipal court has jurisdiction within the 145

Solon, Bentleyville, Chagrin Falls, Moreland Hills, Orange, 147
Warrensville Heights, North Randall, and Woodmere, and within 148
Warrensville and Chagrin Falls townships, in Cuyahoga county. 149
The Bellefontaine municipal court has jurisdiction within 151

The Bellevue municipal court has jurisdiction within Lyme 154

municipal corporations of Strongsville, Middleburgh Heights, 159

The Oregon municipal court has jurisdiction within the 417

Erie to the boundary line between Ohio and Michigan between the 420

The Warren municipal court has jurisdiction within Warren 509
and Champion townships, and within all of Howland township except 510
within the municipal corporation of Niles, in Trumbull county. 511
The Washington Court House municipal court has jurisdiction 513
within Fayette county. 514
The Wayne county municipal court has jurisdiction within 516
Wayne county. 517
The Willoughby municipal court has jurisdiction within the 519
municipal corporations of Eastlake, Wickliffe, Willowick, 520
Willoughby Hills, Kirtland, Kirtland Hills, Waite Hill, 521
Timberlake, and Lakeline, and within Kirtland township, in Lake 522
county. 523
Through June 30, 1992, the Wilmington municipal court has 525
jurisdiction within Clinton county. 526
The Xenia municipal court has jurisdiction within 528
Caesarcreek, Cedarville, Jefferson, Miami, New Jasper, Ross, 529
Silvercreek, Spring Valley, Sugarcreek, and Xenia townships in 530
Greene county. 531
(C) As used in this section: 533
(1) "Within a township" includes all land, including, but 535
not limited to, any part of any municipal corporation, that is 536
physically located within the territorial boundaries of that 537
township, whether or not that land or municipal corporation is 538
governmentally a part of the township. 539
(2) "Within a municipal corporation" includes all land 541
within the territorial boundaries of the municipal corporation 542
and any townships that are coextensive with the municipal 543
corporation. 544
Sec. 1901.08. The number of, and the time for election of, 553
judges of the following municipal courts and the beginning of 554
their terms shall be as follows: 555
In the Akron municipal court, two full-time judges shall be 557

elected in 1951, two full-time judges shall be elected in 1953, 558
one full-time judge shall be elected in 1967, and one full-time 559
judge shall be elected in 1975. 560
In the Alliance municipal court, one full-time judge shall 562
be elected in 1953. 563
In the Ashland municipal court, one full-time judge shall 565
be elected in 1951. 566
In the Ashtabula municipal court, one full-time judge shall 568
be elected in 1953. 569
In the Athens county municipal court, one full-time judge 571
shall be elected in 1967. 572
In the Auglaize county municipal court, one full-time judge 574
shall be elected in 1975. 575
In the Avon Lake municipal court, one part-time judge shall 577
be elected in 1957. 578
In the Barberton municipal court, one full-time judge shall 580
be elected in 1969, and one full-time judge shall be elected in 581
1971. 582
In the Bedford municipal court, one full-time judge shall 584
be elected in 1975, and one full-time judge shall be elected in 585
1979. 586
In the Bellefontaine municipal court, one full-time judge 588
shall be elected in 1993. 589
In the Bellevue municipal court, one part-time judge shall 591
be elected in 1951. 592
In the Berea municipal court, one part-time judge shall be 594
elected in 1957, term to commence on the first day of January 595
next after election, and one part-time judge shall be elected in 597
1981, term to commence on the second day of January next after 598
election. The part-time judge elected in 1987 whose term 599
commenced on January 1, 1988, shall serve until December 31,
1993, and the office of that judge is abolished, effective on the 600
earlier of December 31, 1993, or the date on which that judge 601
resigns, retires, or otherwise vacates judicial office. 602

In the Bowling Green municipal court, one full-time judge 604
shall be elected in 1983. 605
In the Bryan municipal court, one full-time judge shall be 607
elected in 1965. 608
In the Cambridge municipal court, one full-time judge shall 610
be elected in 1951. 611
In the Campbell municipal court, one part-time judge shall 613
be elected in 1963. 614
In the Canton municipal court, one full-time judge shall be 616
elected in 1951, one full-time judge shall be elected in 1969, 617
and two full-time judges shall be elected in 1977. 618
In the Celina municipal court, one full-time judge shall be 620
elected in 1957. 621
In the Champaign county municipal court, one part-time 623
judge shall be elected in 1983. 624
In the Chardon municipal court, one part-time judge shall 626
be elected in 1963. 627
In the Chillicothe municipal court, one full-time judge 629
shall be elected in 1951, and one full-time judge shall be 630
elected in 1977. 631
In the Circleville municipal court, one full-time judge 633
shall be elected in 1953. 634
In the Clark county municipal court, one full-time judge 636
shall be elected in 1989, and two full-time judges shall be 637
elected in 1991. The full-time judges of the Springfield 638
municipal court who were elected in 1983 and 1985 shall serve as 639
the judges of the Clark county municipal court from January 1, 640
1988, until the end of their respective terms. 641
In the Clermont county municipal court, two full-time 643
judges shall be elected in 1991, and one full-time judge shall be 644
elected in 1999. 645
In the Cleveland municipal court, six full-time judges 647
shall be elected in 1975, three full-time judges shall be elected 648
in 1953, and four full-time judges shall be elected in 1955. 649

In the Cleveland Heights municipal court, one full-time 651
judge shall be elected in 1957. 652
In the Clinton county municipal court, one full-time judge 654
shall be elected in 1997. The full-time judge of the Wilmington 655
municipal court who was elected in 1991 shall serve as the judge 656
of the Clinton county municipal court from July 1, 1992, until 657
the end of that judge's term on December 31, 1997. 658
In the Conneaut municipal court, one full-time judge shall 660
be elected in 1953. 661
In the Coshocton municipal court, one full-time judge shall 663
be elected in 1951. 664
In the Crawford county municipal court, one full-time judge 666
shall be elected in 1977. 667
In the Cuyahoga Falls municipal court, one full-time judge 669
shall be elected in 1953, and one full-time judge shall be 670
elected in 1967. 671
In the Dayton municipal court, three full-time judges shall 673
be elected in 1987, their terms to commence on successive days 674
beginning on the first day of January next after their election, 675
and two full-time judges shall be elected in 1955, their terms to 676
commence on successive days beginning on the second day of 677
January next after their election. 678
In the Defiance municipal court, one full-time judge shall 680
be elected in 1957. 681
In the Delaware municipal court, one full-time judge shall 683
be elected in 1953. 684
In the East Cleveland municipal court, one full-time judge 686
shall be elected in 1957. 687
In the East Liverpool municipal court, one full-time judge 689
shall be elected in 1953. 690
In the Eaton municipal court, one full-time judge shall be 692
elected in 1973. 693

Sec. 1901.09. (A) In a municipal court having only one 1,009
judge, that judge shall be designated as both the presiding judge 1,010
and the administrative judge.
(B) In a municipal court having two OR MORE judges, the 1,012
judge whose term next expires shall be designated as the 1,013
presiding AND ADMINISTRATIVE judge. 1,014
(C) In a municipal court having three or more judges, the 1,016
judges of the court shall select the presiding judge on the 1,018
second Monday in January of the even-numbered years SHALL BE 1,019
ELECTED OR DESIGNATED AS PROVIDED IN THE RULES OF SUPERINTENDENCE 1,020
FOR THE COURTS OF OHIO. 1,021
Sec. 1901.183. In addition to jurisdiction otherwise 1,031
granted in this chapter, the environmental division of a 1,032
municipal court shall have jurisdiction within its territory in 1,033
all of the following actions or proceedings and to perform all of 1,034

the following functions:
(A) Notwithstanding any monetary limitations in section 1,037
1901.17 of the Revised Code, in all actions and proceedings for 1,039
the sale of real or personal property under lien of a judgment of 1,040
the environmental division of the municipal court, or a lien for 1,041
machinery, material, fuel furnished, or labor performed, 1,042
irrespective of amount, and, in those cases, the environmental 1,043
division may proceed to foreclose and marshal all liens and all 1,044
vested or contingent rights, to appoint a receiver, and to render 1,045
personal judgment irrespective of amount in favor of any party; 1,046
(B) In WHEN IN AID OF EXECUTION OF A JUDGMENT OF THE 1,048
ENVIRONMENTAL DIVISION OF THE MUNICIPAL COURT, IN all actions for 1,049
the foreclosure of a mortgage on real property given to secure 1,051
the payment of money, or the enforcement of a specific lien for 1,052
money or other encumbrance or charge on real property, when the 1,053
real property is situated within the territory, and, in those
cases, the environmental division of the municipal court may 1,054
proceed to foreclose all liens and all vested and contingent 1,055
rights and proceed to render judgments, and make findings and 1,056
orders, between the parties, in the same manner and to the same 1,057
extent as in similar cases in the court of common pleas; 1,058
(C) In WHEN IN AID OF EXECUTION OF A JUDGMENT OF THE 1,060
ENVIRONMENTAL DIVISION OF THE MUNICIPAL COURT, IN all actions for 1,062
the recovery of real property situated within the territory to 1,063
the same extent as courts of common pleas have jurisdiction; 1,064
(D) In all actions for injunction to prevent or terminate 1,067
violations of the ordinances and regulations of any municipal 1,068
corporation within its territory enacted or promulgated under the 1,069
police power of that municipal corporation pursuant to Section 3 1,070
of Article XVIII, Ohio Constitution, over which the court of 1,072
common pleas has or may have jurisdiction, and, in those cases, 1,073
the environmental division of the municipal court may proceed to 1,074
render judgments, and make findings and orders, in the same 1,075
manner and to the same extent as in similar cases in the court of 1,076

common pleas;
(E) In all actions for injunction to prevent or terminate 1,078
violations of the resolutions and regulations of any political 1,079
subdivision within its territory enacted or promulgated under the 1,080
power of that political subdivision pursuant to Article X of the 1,081
Ohio Constitution, over which the court of common pleas has or 1,082
may have jurisdiction, and, in those cases, the environmental 1,083
division of the municipal court may proceed to render judgments, 1,084
and make findings and orders, in the same manner and to the same 1,085
extent as in similar cases in the court of common pleas; 1,086
(F) In any civil action to enforce any provision of 1,089
Chapter 3704., 3714., 3734., 3737., 3767., or 6111. of the 1,090
Revised Code over which the court of common pleas has or may have 1,093
jurisdiction, and, in those actions, the environmental division 1,094
of the municipal court may proceed to render judgments, and make 1,095
findings and orders, in the same manner and to the same extent as 1,096
in similar actions in the court of common pleas; 1,097
(G) In all actions and proceedings in the nature of 1,100
creditors' bills, and in aid of execution to subject the 1,101
interests of a judgment debtor in real or personal property to 1,102
the payment of a judgment of the division, and, in those actions 1,103
and proceedings, the environmental division may proceed to 1,104
marshal and foreclose all liens on the property irrespective of 1,105
the amount of the lien, and all vested or contingent rights in 1,106
the property;
(H) Concurrent jurisdiction WITH THE COURT OF COMMON PLEAS 1,109
of all criminal actions or proceedings related to the pollution 1,111
of the air, ground, or water within the territory of the 1,112
environmental division of the municipal court, for which a 1,113
sentence of death cannot be imposed under Chapter 2903. of the
Revised Code; 1,114
(I) In any review or appeal of any final order of any 1,116
administrative officer, agency, board, department, tribunal, 1,117
commission, or other instrumentality that relates to a local 1,118

building, housing, air pollution, sanitation, health, fire, 1,119
zoning, or safety code, ordinance, or regulation, in the same 1,120
manner and to the same extent as in similar appeals in the court 1,121
of common pleas.
Sec. 1907.131. (A) In a county court district having only 1,131
one judge, that judge shall be the presiding and administrative 1,132
judge for that district.
(B) In a county court district having two OR MORE judges, 1,135
the judge having the longest tenure as a judge of that county 1,137
court district shall be designated as the presiding and
administrative judge for that district unless otherwise agreed by 1,138
the judges. 1,139
(C) In a county court district having three or more 1,142
judges, the judges of the court shall select the presiding and
administrative judge on the second Monday in January of the 1,145
odd-numbered years SHALL BE ELECTED OR DESIGNATED AS PROVIDED IN 1,146
THE RULES OF SUPERINTENDENCE FOR THE COURTS OF OHIO. 1,147
Section 2. That existing sections 1901.02, 1901.08, 1,149
1901.09, 1901.183, and 1907.131 of the Revised Code are hereby 1,151
repealed.
Section 3. The Lancaster Municipal Court shall continue in 1,154
operation until January 2, 2000, at which time the Lancaster 1,155
Municipal Court shall cease operations, and its existence shall 1,156
terminate. The Fairfield County Municipal Court shall begin 1,157
operations on January 2, 2000. 1,158
Section 4. All employees of the Lancaster Municipal Court 1,160
shall be transferred to and shall become employees of the 1,161
Fairfield County Municipal Court on January 2, 2000. 1,162
Section 5. All causes, executions, and other proceedings 1,164
pending in the Lancaster Municipal Court on January 1, 2000, 1,165
shall be transferred to and proceed in the Fairfield County 1,167
Municipal Court on January 2, 2000, as if originally instituted 1,168
in the Fairfield County Municipal Court. 1,169
Section 6. On January 2, 2000, the clerk of the Lancaster 1,171

Municipal Court shall be known as the clerk of the Fairfield 1,172
County Municipal Court, and all employees of the clerk of the 1,173
Lancaster Municipal Court shall be transferred to and become 1,174
employees of the clerk of the Fairfield County Municipal Court.
Section 7. This act is hereby declared to be an emergency 1,176
measure necessary for the immediate preservation of the public 1,177
peace, health, and safety. The reason for such necessity is that 1,178
the change is urgently needed to properly define the jurisdiction 1,179
of the environmental court to facilitate the administration of 1,180
justice. Therefore, this act shall go into immediate effect. 1,181
