A B I L L
To amend sections 159.03, 159.04, 1901.02, 1901.08, 12
1901.09, 1901.183, and 1907.131 of the Revised 14
Code to clarify the jurisdiction of the 15
environmental division of a municipal court in
foreclosure actions, to provide that the 16
presiding judge and administrative judge in 17
multi-judge municipal courts and county courts 18
are to be determined as provided in the Rules of
Superintendence for the Courts of Ohio, to rename 19
the Lancaster Municipal Court as the F0irfield 20
County Municipal Court, effective January 2,
2000, to revise the consent Ohio gives to the 21
United States for acquisition of property for
sites for public buildings and other purposes of 22
government and the jurisdiction of Ohio and the 23
United States over those sites, and to declare an
emergency. 24
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO: 26
Section 1. That sections 159.03, 159.04, 1901.02, 1901.08, 28
1901.09, 1901.183, and 1907.131 of the Revised Code be amended to 30
read as follows:
Sec. 159.03. The consent of the state is given, in 40
accordance with clause 17, Section 8, Article I, United States 41
Constitution, to the acquisition, between AFTER May 6, 1902, and 43
the effective date of this amendment, by the United States, by 44

purchase, condemnation, LEASE, or otherwise, of any land in this 45
state required for sites for custom houses, courthouses, 47
CORRECTIONAL INSTITUTIONS, post-offices, arsenals, or other 49
public buildings whatever, or for any other purposes of the 50
government. On and after the effective date of this amendment, 51
the consent of the state is given, in accordance with clause 17, 52
Section 8, Article I, United States Constitution, to the 53
acquisition by the United States by purchase, condemnation, or 54
otherwise, of any land in this state required for sites for 55
national parks, national monuments, or national recreational 56
areas provided acquisition of such land commenced prior to the 57
effective date of this amendment. 58
Sec. 159.04. (A) Exclusive OR CONCURRENT jurisdiction in 67
and over any land acquired by the United States under section 68
159.03 of the Revised Code is hereby ceded to the United States, 69
for all purposes except the service upon such sites of all civil 70
and criminal process of the courts of this state. The 71
jurisdiction so ceded shall continue no longer than the said 72
United States owns OR HOLDS LEGAL INTEREST IN such lands. 73
(B) The governor may accept, on behalf of the state, 75
retrocession of full or partial jurisdiction over any roads, 76
highways, or other lands in federal enclaves where the 77
appropriate federal authority offers the retrocession. The 78
governor shall deliver the documents executed by the federal 79
authority and the governor concurring in the retrocession, for 80
recording, to the office of the recorder of the county in which 81
the lands are located. 82
(C) THE GRANTING OF EXCLUSIVE OR CONCURRENT JURISDICTION 84
TO THE UNITED STATES PURSUANT TO DIVISION (A) OF THIS SECTION 86
SHALL TAKE EFFECT ONLY UPON THE GRANTING OF EITHER FORM OF 87
JURISDICTION BY THE GOVERNOR TO THE UNITED STATES AND THE 88
ACCEPTANCE OF EITHER FORM OF JURISDICTION BY THE UNITED STATES. 90
(D) NOTHING IN THIS SECTION IS INTENDED TO MODIFY, REVOKE, 92
OR IN ANY WAY AFFECT ANY PRIOR GRANT OF JURISDICTION BY THE STATE 93

TO THE UNITED STATES THAT WAS MADE PRIOR TO THE EFFECTIVE DATE OF 94
THIS AMENDMENT. 95
Sec. 1901.02. (A) The municipal courts established by 104
section 1901.01 of the Revised Code have jurisdiction within the 105
corporate limits of their respective municipal corporations, or, 106
for the Clermont county municipal court, within the municipal 107
corporation or unincorporated territory in which it is 108
established, and are courts of record. Each of the courts shall 109
be styled ".................................. municipal court," 110
inserting the name of the municipal corporation, except the 111
following courts, which shall be styled as set forth below: 112
(1) The municipal court established in Chesapeake that 114
shall be styled and known as the "Lawrence county municipal 115
court"; 116
(2) The municipal court established in Cincinnati that 118
shall be styled and known as the "Hamilton county municipal 119
court"; 120
(3) The municipal court established in Ravenna that shall 122
be styled and known as the "Portage county municipal court"; 123
(4) The municipal court established in Athens that shall 125
be styled and known as the "Athens county municipal court"; 126
(5) The municipal court established in Columbus that shall 128
be styled and known as the "Franklin county municipal court"; 129
(6) The municipal court established in London that shall 131
be styled and known as the "Madison county municipal court"; 132
(7) The municipal court established in Newark that shall 134
be styled and known as the "Licking county municipal court"; 135
(8) The municipal court established in Wooster that shall 137
be styled and known as the "Wayne county municipal court"; 138
(9) The municipal court established in Wapakoneta that 140
shall be styled and known as the "Auglaize county municipal 141
court"; 142
(10) The municipal court established in Troy that shall be 144
styled and known as the "Miami county municipal court"; 145

(11) The municipal court established in Bucyrus that shall 147
be styled and known as the "Crawford county municipal court"; 148
(12) The municipal court established in Logan that shall 150
be styled and known as the "Hocking county municipal court"; 151
(13) The municipal court established in Urbana that shall 153
be styled and known as the "Champaign county municipal court"; 154
(14) The municipal court established in Jackson that shall 156

beginning July 1, 1992, shall be styled and known as the "Clinton 172
county municipal court"; 173
(19) The municipal court established in Port Clinton that 175
shall be styled and known as "the Ottawa county municipal court"; 176
(20) THE MUNICIPAL COURT ESTABLISHED IN LANCASTER THAT, 178
BEGINNING JANUARY 2, 2000, SHALL BE STYLED AND KNOWN AS THE 180
"FAIRFIELD COUNTY MUNICIPAL COURT."
(B) In addition to the jurisdiction set forth in division 182
(A) of this section, the municipal courts established by section 183
1901.01 of the Revised Code have jurisdiction as follows: 184
The Akron municipal court has jurisdiction within Bath, 186
Northampton, Richfield, and Springfield townships, and within the 187
municipal corporations of Fairlawn, Lakemore, and Mogadore, in 188
Summit county. 189
The Alliance municipal court has jurisdiction within 191
Lexington, Marlboro, Paris, and Washington townships in Stark 192

The Ashland municipal court has jurisdiction within Ashland 195

The Bellefontaine municipal court has jurisdiction within 222

Erie to the boundary line between Ohio and Michigan between the 491
easterly boundary of the court and the easterly boundary of the 492

The Upper Sandusky municipal court has jurisdiction within 559

The Vandalia municipal court has jurisdiction within the 562
municipal corporations of Clayton, Englewood, and Union, and 563
within Butler, Harrison, and Randolph townships, in Montgomery 564

The Van Wert municipal court has jurisdiction within Van 567

The Vermilion municipal court has jurisdiction within the 570
townships of Vermilion and Florence in Erie county and within all 571
of Brownhelm township except within the municipal corporation of 572

The Wadsworth municipal court has jurisdiction within the 575
municipal corporations of Gloria Glens Park, Lodi, Seville, and 576
Westfield Center, and within Guilford, Harrisville, Homer, 577
Sharon, Wadsworth, and Westfield townships in Medina county. 578
The Warren municipal court has jurisdiction within Warren 580
and Champion townships, and within all of Howland township except 581
within the municipal corporation of Niles, in Trumbull county. 582
The Washington Court House municipal court has jurisdiction 584
within Fayette county. 585
The Wayne county municipal court has jurisdiction within 587
Wayne county. 588
The Willoughby municipal court has jurisdiction within the 590
municipal corporations of Eastlake, Wickliffe, Willowick, 591
Willoughby Hills, Kirtland, Kirtland Hills, Waite Hill, 592
Timberlake, and Lakeline, and within Kirtland township, in Lake 593
county. 594
Through June 30, 1992, the Wilmington municipal court has 596
jurisdiction within Clinton county. 597
The Xenia municipal court has jurisdiction within 599
Caesarcreek, Cedarville, Jefferson, Miami, New Jasper, Ross, 600
Silvercreek, Spring Valley, Sugarcreek, and Xenia townships in 601
Greene county. 602
(C) As used in this section: 604
(1) "Within a township" includes all land, including, but 606

not limited to, any part of any municipal corporation, that is 607
physically located within the territorial boundaries of that 608
township, whether or not that land or municipal corporation is 609
governmentally a part of the township. 610
(2) "Within a municipal corporation" includes all land 612
within the territorial boundaries of the municipal corporation 613
and any townships that are coextensive with the municipal 614
corporation. 615
Sec. 1901.08. The number of, and the time for election of, 624
judges of the following municipal courts and the beginning of 625
their terms shall be as follows: 626
In the Akron municipal court, two full-time judges shall be 628
elected in 1951, two full-time judges shall be elected in 1953, 629
one full-time judge shall be elected in 1967, and one full-time 630
judge shall be elected in 1975. 631
In the Alliance municipal court, one full-time judge shall 633
be elected in 1953. 634
In the Ashland municipal court, one full-time judge shall 636
be elected in 1951. 637
In the Ashtabula municipal court, one full-time judge shall 639
be elected in 1953. 640
In the Athens county municipal court, one full-time judge 642
shall be elected in 1967. 643
In the Auglaize county municipal court, one full-time judge 645
shall be elected in 1975. 646
In the Avon Lake municipal court, one part-time judge shall 648
be elected in 1957. 649
In the Barberton municipal court, one full-time judge shall 651
be elected in 1969, and one full-time judge shall be elected in 652
1971. 653
In the Bedford municipal court, one full-time judge shall 655
be elected in 1975, and one full-time judge shall be elected in 656
1979. 657
In the Bellefontaine municipal court, one full-time judge 659

shall be elected in 1993. 660
In the Bellevue municipal court, one part-time judge shall 662
be elected in 1951. 663
In the Berea municipal court, one part-time judge shall be 665
elected in 1957, term to commence on the first day of January 666
next after election, and one part-time judge shall be elected in 668
1981, term to commence on the second day of January next after 669
election. The part-time judge elected in 1987 whose term 670
commenced on January 1, 1988, shall serve until December 31,
1993, and the office of that judge is abolished, effective on the 671
earlier of December 31, 1993, or the date on which that judge 672
resigns, retires, or otherwise vacates judicial office. 673
In the Bowling Green municipal court, one full-time judge 675
shall be elected in 1983. 676
In the Bryan municipal court, one full-time judge shall be 678
elected in 1965. 679
In the Cambridge municipal court, one full-time judge shall 681
be elected in 1951. 682

Sec. 1901.183. In addition to jurisdiction otherwise 1,102
granted in this chapter, the environmental division of a 1,103
municipal court shall have jurisdiction within its territory in 1,104
all of the following actions or proceedings and to perform all of 1,105
the following functions:
(A) Notwithstanding any monetary limitations in section 1,108
1901.17 of the Revised Code, in all actions and proceedings for 1,110
the sale of real or personal property under lien of a judgment of 1,111
the environmental division of the municipal court, or a lien for 1,112
machinery, material, fuel furnished, or labor performed, 1,113
irrespective of amount, and, in those cases, the environmental 1,114
division may proceed to foreclose and marshal all liens and all 1,115
vested or contingent rights, to appoint a receiver, and to render 1,116
personal judgment irrespective of amount in favor of any party; 1,117
(B) In WHEN IN AID OF EXECUTION OF A JUDGMENT OF THE 1,119
ENVIRONMENTAL DIVISION OF THE MUNICIPAL COURT, IN all actions for 1,120
the foreclosure of a mortgage on real property given to secure 1,122
the payment of money, or the enforcement of a specific lien for 1,123
money or other encumbrance or charge on real property, when the 1,124
real property is situated within the territory, and, in those
cases, the environmental division of the municipal court may 1,125
proceed to foreclose all liens and all vested and contingent 1,126
rights and proceed to render judgments, and make findings and 1,127
orders, between the parties, in the same manner and to the same 1,128
extent as in similar cases in the court of common pleas; 1,129
(C) In WHEN IN AID OF EXECUTION OF A JUDGMENT OF THE 1,131

ENVIRONMENTAL DIVISION OF THE MUNICIPAL COURT, IN all actions for 1,133
the recovery of real property situated within the territory to 1,134
the same extent as courts of common pleas have jurisdiction; 1,135
(D) In all actions for injunction to prevent or terminate 1,138
violations of the ordinances and regulations of any municipal 1,139
corporation within its territory enacted or promulgated under the 1,140
police power of that municipal corporation pursuant to Section 3 1,141
of Article XVIII, Ohio Constitution, over which the court of 1,143
common pleas has or may have jurisdiction, and, in those cases, 1,144
the environmental division of the municipal court may proceed to 1,145
render judgments, and make findings and orders, in the same 1,146
manner and to the same extent as in similar cases in the court of 1,147
common pleas;
(E) In all actions for injunction to prevent or terminate 1,149
violations of the resolutions and regulations of any political 1,150
subdivision within its territory enacted or promulgated under the 1,151
power of that political subdivision pursuant to Article X of the 1,152
Ohio Constitution, over which the court of common pleas has or 1,153
may have jurisdiction, and, in those cases, the environmental 1,154
division of the municipal court may proceed to render judgments, 1,155
and make findings and orders, in the same manner and to the same 1,156
extent as in similar cases in the court of common pleas; 1,157
(F) In any civil action to enforce any provision of 1,160
Chapter 3704., 3714., 3734., 3737., 3767., or 6111. of the 1,161
Revised Code over which the court of common pleas has or may have 1,164
jurisdiction, and, in those actions, the environmental division 1,165
of the municipal court may proceed to render judgments, and make 1,166
findings and orders, in the same manner and to the same extent as 1,167
in similar actions in the court of common pleas; 1,168
(G) In all actions and proceedings in the nature of 1,171
creditors' bills, and in aid of execution to subject the 1,172
interests of a judgment debtor in real or personal property to 1,173
the payment of a judgment of the division, and, in those actions 1,174
and proceedings, the environmental division may proceed to 1,175

marshal and foreclose all liens on the property irrespective of 1,176
the amount of the lien, and all vested or contingent rights in 1,177
the property;
(H) Concurrent jurisdiction WITH THE COURT OF COMMON PLEAS 1,180
of all criminal actions or proceedings related to the pollution 1,182
of the air, ground, or water within the territory of the 1,183
environmental division of the municipal court, for which a 1,184
sentence of death cannot be imposed under Chapter 2903. of the
Revised Code; 1,185
(I) In any review or appeal of any final order of any 1,187
administrative officer, agency, board, department, tribunal, 1,188
commission, or other instrumentality that relates to a local 1,189
building, housing, air pollution, sanitation, health, fire, 1,190
zoning, or safety code, ordinance, or regulation, in the same 1,191
manner and to the same extent as in similar appeals in the court 1,192
of common pleas.
Sec. 1907.131. (A) In a county court district having only 1,202
one judge, that judge shall be the presiding and administrative 1,203
judge for that district.
(B) In a county court district having two OR MORE judges, 1,206
the judge having the longest tenure as a judge of that county 1,208
court district shall be designated as the presiding and
administrative judge for that district unless otherwise agreed by 1,209
the judges. 1,210
(C) In a county court district having three or more 1,213
judges, the judges of the court shall select the presiding and
administrative judge on the second Monday in January of the 1,216
odd-numbered years SHALL BE ELECTED OR DESIGNATED AS PROVIDED IN 1,217
THE RULES OF SUPERINTENDENCE FOR THE COURTS OF OHIO. 1,218
Section 2. That existing sections 159.03, 159.04, 1901.02, 1,220
1901.08, 1901.09, 1901.183, and 1907.131 of the Revised Code are 1,223
hereby repealed.
Section 3. The Lancaster Municipal Court shall continue in 1,226
operation until January 2, 2000, at which time the Lancaster 1,227

Municipal Court shall cease operations, and its existence shall 1,228
terminate. The Fairfield County Municipal Court shall begin 1,229
operations on January 2, 2000. 1,230
Section 4. All employees of the Lancaster Municipal Court 1,232
shall be transferred to and shall become employees of the 1,233
Fairfield County Municipal Court on January 2, 2000. 1,234
Section 5. All causes, executions, and other proceedings 1,236
pending in the Lancaster Municipal Court on January 1, 2000, 1,237
shall be transferred to and proceed in the Fairfield County 1,239
Municipal Court on January 2, 2000, as if originally instituted 1,240
in the Fairfield County Municipal Court. 1,241
Section 6. On January 2, 2000, the clerk of the Lancaster 1,243
Municipal Court shall be known as the clerk of the Fairfield 1,244
County Municipal Court, and all employees of the clerk of the 1,245
Lancaster Municipal Court shall be transferred to and become 1,246
employees of the clerk of the Fairfield County Municipal Court.
Section 7. This act is hereby declared to be an emergency 1,248
measure necessary for the immediate preservation of the public 1,249
peace, health, and safety. The reason for such necessity is that 1,250
the change is urgently needed to properly define the jurisdiction 1,251
of the environmental court to facilitate the administration of 1,252
justice. Therefore, this act shall go into immediate effect. 1,253
