A BILL
To amend, for the purpose of adopting a new section1
number as indicated in parentheses, section 122.982
(122.971) and to enact new section 122.98 and3
section 122.981 of the Revised Code to create the4
Ohio Aerospace and Defense Advisory Council.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 122.98 (122.971) be amended for the6
purpose of adopting a new section number as indicated in7
parentheses, and new section 122.98 and section 122.981 of the8
Revised Code be enacted to read as follows:9

       Sec. 122.98.        Sec. 122.971.  (A) The Ohio steel industry advisory10
council shall do all of the following:11

       (1) Conduct an examination of existing federal and Ohio laws12
which currently affect the production and consumption of Ohio13
steel, problems which the Ohio steel industry currently faces,14
including foreign competition and the economic climate for the15
Ohio steel industry, and other matters relevant to the future of16
the steel industry in this state;17

       (2) Submit an annual report, no later than the first day of18
October of each year, to the speaker and minority leader of the19
house of representatives, the president and minority leader of the20
senate, and the chairpersons of the standing committees of the21
house of representatives and senate to which matters concerning22
commerce and labor are normally referred. The report shall23
propose methods to expand the use of Ohio steel within the state,24
the United States, and the world; identify problems facing the25
Ohio steel industry discovered during the council's activities;26
and make recommendations to modify state statutes or rules.27

       (3) Upon request, advise state and local government28
officials on questions and matters affecting the steel industry;29

       (4) Work closely with the Ohio steel futures program.30

       (B) The director of development shall transmit copies of all31
requests for information and assistance from the steel futures32
program and copies of program evaluations conducted by that33
program to the council. The council may make recommendations to34
the steel futures program regarding research and development and35
funding of programs to be undertaken by the steel futures program.36

       Sec. 122.98. (A)(1) There is hereby created the Ohio37
aerospace and defense advisory council, which shall consist of38
eleven voting members and not more than six nonvoting members. 39

        (2) The governor shall appoint the eleven voting members40
of the council with the advice and consent of the senate, and41
shall designate one of these members to serve as the chairperson42
of the council. The voting members so appointed by the governor43
shall be individuals who are knowledgeable in at least one of the44
following fields: aerospace technology, national defense issues45
associated with aerospace technology, issues facing private46
enterprises that conduct business in the aerospace industry,47
technology commercialization, or other fields that are relevant to48
the mission of the council as determined by the governor.49

        The governor shall make the appointments of the voting50
members so that they represent, as determined by the governor,51
designated geographical regions of the state in the following52
manner: not less than two voting members shall represent the53
Cleveland metropolitan region; not less than two voting members54
shall represent the Miami valley region; and any remaining voting55
members shall represent all other regions of the state. All of56
the voting members so appointed by the governor shall be employees57
or former employees of private enterprises, except that not less58
than two of the voting members shall be faculty members of a59
public or private institution of higher education associated with60
aerospace technology matters.61

       Not more than six of the voting members so appointed by the62
governor shall be members of the same political party.63

       (3) The governor also may appoint two additional members of64
the council with the advice and consent of the senate if the65
governor considers additional members to be necessary. These66
additional members shall be nonvoting members. One of the67
additional members shall be an employee of the United States air68
force who is assigned to the Wright-Patterson air force base. The69
other additional member shall be an employee of the national70
aeronautics and space administration who is assigned to the John71
H. Glenn research center.72

       (4) The president of the senate shall appoint to the council73
two members of the senate, each of whom shall be a member of a74
different political party. The speaker of the house of75
representatives shall appoint to the council two members of the76
house of representatives, each of whom shall be a member of a77
different political party. These legislative members shall serve78
as nonvoting members of the council.79

        (B) The terms of office of the council's members appointed80
by the governor shall be three years from the date of appointment.81
The terms of office of the council's legislative members shall be82
for the biennial session of the general assembly in which they are83
appointed. Vacancies shall be filled in the same manner as84
provided for original appointments. Members may be reappointed.85

       (C) The council shall meet at least once each six months or86
more frequently upon the call of the chairperson or upon the87
request of seven or more members. Eight members of the council88
constitute a quorum, but the council shall take no official action89
without the affirmative vote of at least six members. The council90
may elect officers in addition to the chairperson as it considers91
necessary.92

       (D) Members of the council shall receive no compensation,93
but shall be reimbursed for their actual and necessary expenses94
incurred in the course of the performance of their duties as95
members of the council.96

        (E) The department of development, as requested by the97
council, shall provide the council with meeting space, staff98
services, and other technical assistance. The department shall99
assist the council with the costs of production and distribution100
of council reports from the general operating budget of the101
department.102

       Sec. 122.981. (A) The Ohio aerospace and defense advisory103
council may do any of the following:104

        (1) Conduct an examination of existing and proposed laws,105
rules, and policies of this state or the United States that affect106
or may affect the growth and viability of the aerospace and107
defense industries in this state and the status of federal108
installations in this state associated with those industries; an109
examination of problems that the aerospace and defense industries110
in this state face at any particular time, including problems111
arising from foreign competition or the economic climate in this112
state; and an examination of technology commercialization and113
other matters relevant to the future of the aerospace and defense114
industries in this state; 115

       (2) Advise federal, state, and local government officials on116
questions and matters affecting the aerospace and defense117
industries in this state.118

       (B) The council shall submit an annual report not later than119
the first day of October of each year to the speaker and minority120
leader of the house of representatives, the president and minority121
leader of the senate, and the chairpersons of the standing122
committees of the house of representatives and senate to which123
matters concerning economic development are normally referred. The124
council also shall submit the report to the director of125
development, who shall make copies of the report available to126
members of the public upon request. The department of development127
staff assigned to the council shall keep a record of all requests.128

       The report shall describe the council's activities during the129
previous year. The report may propose methods to expand the130
aerospace and defense industries in this state; identify problems131
facing the aerospace and defense industries in this state that132
were discovered during the council's activities; and make133
recommendations to modify state statutes, rules, or policies.134

       Following submission of the annual report as described in135
this division, a member of the council designated by the136
chairperson shall provide testimony concerning the report to the137
standing committees of the house of representatives and senate to138
which matters concerning economic development are normally139
referred or at a joint hearing or hearings of those committees set140
for that purpose.141

       Section 2. That existing section 122.98 of the Revised Code142
is hereby repealed.143

       Section 3. (A) The Governor shall make initial appointments144
of voting members to the Ohio Aerospace and Defense Advisory145
Council as required by section 122.98 of the Revised Code, as146
newly enacted by this act, not later than ninety days after the147
effective date of this act. The Governor shall appoint three of148
those initial voting members to serve a term of one year, four of149
them to serve a term of two years, and four of them to serve a150
term of three years. Thereafter, the voting members appointed by151
the Governor shall serve the term specified in division (B) of new152
section 122.98 of the Revised Code.153

       (B) The Ohio Aerospace and Defense Advisory Council created154
by section 122.98 of the Revised Code, as newly enacted by this155
act, shall expire on December 31, 2004, in accordance with156
division (A) of section 101.83 of the Revised Code, unless the157
Council is renewed in accordance with division (D) of that158
section.159
