A BILL
To amend, for the purpose of adopting a new section1
number as indicated in parentheses, section 122.982
(122.971) and to enact new section 122.98 and3
section 122.981 of the Revised Code to create the4
Ohio Aerospace and Defense Advisory Council.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 122.98 (122.971) be amended for the6
purpose of adopting a new section number as indicated in7
parentheses, and new section 122.98 and section 122.981 of the8
Revised Code be enacted to read as follows:9

       Sec. 122.98.        Sec. 122.971.  (A) The Ohio steel industry advisory10
council shall do all of the following:11

       (1) Conduct an examination of existing federal and Ohio laws12
which currently affect the production and consumption of Ohio13
steel, problems which the Ohio steel industry currently faces,14
including foreign competition and the economic climate for the15
Ohio steel industry, and other matters relevant to the future of16
the steel industry in this state;17

       (2) Submit an annual report, no later than the first day of18
October of each year, to the speaker and minority leader of the19
house of representatives, the president and minority leader of the20
senate, and the chairpersons of the standing committees of the21
house of representatives and senate to which matters concerning22
commerce and labor are normally referred. The report shall23
propose methods to expand the use of Ohio steel within the state,24
the United States, and the world; identify problems facing the25
Ohio steel industry discovered during the council's activities;26
and make recommendations to modify state statutes or rules.27

       (3) Upon request, advise state and local government28
officials on questions and matters affecting the steel industry;29

       (4) Work closely with the Ohio steel futures program.30

       (B) The director of development shall transmit copies of all31
requests for information and assistance from the steel futures32
program and copies of program evaluations conducted by that33
program to the council. The council may make recommendations to34
the steel futures program regarding research and development and35
funding of programs to be undertaken by the steel futures program.36

       Sec. 122.98. (A)(1) There is hereby created the Ohio37
aerospace and defense advisory council, which shall consist of38
eleven voting members and not more than four nonvoting members. 39

        (2) The governor shall appoint eleven voting members of40
the council with the advice and consent of the senate, and shall41
designate one of these members to serve as the chairperson of the42
council. The voting members so appointed by the governor shall be43
individuals who are knowledgeable in at least one of the following44
fields: aerospace technology, national defense issues associated45
with aerospace technology, issues facing private enterprises that46
conduct business in the aerospace industry, or other fields that47
are relevant to the mission of the council as determined by the48
governor.49

        The governor shall make the appointments of the voting50
members so that they represent, as determined by the governor,51
designated geographical regions of the state in the following52
manner: three members shall represent the Cleveland metropolitan53
region; three members shall represent the Miami valley region; two54
members shall represent the Columbus metropolitan region; and55
three members shall represent all other regions of the state. All56
of the voting members so appointed by the governor shall be57
employees or former employees of private enterprises, except that58
one of the voting members from the Cleveland metropolitan region59
and one of the voting members from the Miami valley region shall60
be faculty members of a public or private institution of higher61
education.62

       Not more than six of the voting members so appointed by the63
governor shall be members of the same political party.64

       (3) The governor also may appoint two additional members of65
the council with the advice and consent of the senate if the66
governor considers additional members to be necessary. These67
additional members shall be nonvoting members. One of the68
additional members shall be an employee of the United States air69
force who is assigned to the Wright-Patterson air force base. The70
other additional member shall be an employee of the national71
aeronautics and space administration who is assigned to the John72
H. Glenn research center.73

       (4) The president of the senate and the speaker of the house74
of representatives each shall appoint one member from their75
respective houses to serve as nonvoting members of the council.76
These legislative members of the council shall not be members of77
the same political party.78

        (B) The terms of office of the council's members appointed79
by the governor shall be three years from the date of appointment.80
The terms of office of the council's legislative members shall be81
for the biennial session of the general assembly in which they are82
appointed. Vacancies shall be filled in the same manner as83
provided for original appointments. Members may be reappointed.84

       (C) The council shall meet at least once each six months or85
more frequently upon the call of the chairperson or upon the86
request of six or more members. Seven members of the council87
constitute a quorum, but the council shall take no official action88
without the affirmative vote of at least six members. The council89
may elect officers in addition to the chairperson as it considers90
necessary.91

       (D) Members of the council shall receive no compensation,92
but shall be reimbursed for their actual and necessary expenses93
incurred in the course of the performance of their duties as94
members of the council.95

        (E) The department of development, as requested by the96
council, shall provide the council with meeting space, staff97
services, and other technical assistance. The department shall98
assist the council with the costs of production and distribution99
of council reports from the general operating budget of the100
department.101

       Sec. 122.981. (A) The Ohio aerospace and defense advisory102
council may do any of the following:103

        (1) Conduct an examination of existing and proposed laws,104
rules, and policies of this state or the United States that affect105
or may affect the growth and viability of the aerospace and106
defense industries in this state and the status of federal107
installations in this state associated with those industries; an108
examination of problems that the aerospace and defense industries109
in this state face at any particular time, including problems110
arising from foreign competition or the economic climate in this111
state; and an examination of other matters relevant to the future112
of the aerospace and defense industries in this state; 113

       (2) Advise federal, state, and local government officials on114
questions and matters affecting the aerospace and defense115
industries in this state.116

       (B) The council shall submit an annual report not later than117
the first day of October of each year to the speaker and minority118
leader of the house of representatives, the president and minority119
leader of the senate, and the chairpersons of the standing120
committees of the house of representatives and senate to which121
matters concerning economic development are normally referred. The122
council also shall submit the report to the director of123
development, who shall make copies of the report available to124
members of the public upon request. The department of development125
staff assigned to the council shall keep a record of all requests.126

       The report shall describe the council's activities during the127
previous year. The report may propose methods to expand the128
aerospace and defense industries in this state; identify problems129
facing the aerospace and defense industries in this state that130
were discovered during the council's activities; and make131
recommendations to modify state statutes, rules, or policies.132

       Section 2. That existing section 122.98 of the Revised Code133
is hereby repealed.134

       Section 3. (A) The Governor shall make initial appointments135
of voting members to the Ohio Aerospace and Defense Advisory136
Council as required by section 122.98 of the Revised Code, as137
newly enacted by this act, not later than ninety days after the138
effective date of this act. The Governor shall appoint three of139
those initial voting members to serve a term of one year, four of140
them to serve a term of two years, and four of them to serve a141
term of three years. Thereafter, the voting members appointed by142
the Governor shall serve the term specified in division (B) of new143
section 122.98 of the Revised Code.144

       (B) The Ohio Aerospace and Defense Advisory Council created145
by section 122.98 of the Revised Code, as newly enacted by this146
act, shall expire on December 31, 2004, in accordance with147
division (A) of section 101.83 of the Revised Code, unless the148
Council is renewed in accordance with division (D) of that149
section.150
