A BILL
To amend section 2947.23 of the Revised Code to1
authorize courts to impose periods of community2
service upon offenders who fail to pay judgments3
for court costs relating to the criminal action.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 2947.23 of the Revised Code be5
amended to read as follows:6

       Sec. 2947.23.  (A) In all criminal cases, including7
violations of ordinances, the judge or magistrate shall include in8
the sentence the costs of prosecution and render a judgment9
against the defendant for such costs. If a jury has been sworn at10
the trial of a case, the fees of the jurors shall be included in11
the costs, which shall be paid to the public treasury from which12
the jurors were paid.13

       (B) If an offender fails to pay the judgment described in14
division (A) of this section or fails to timely make payments15
towards that judgment under a payment schedule approved by the16
court, the court may order the offender to perform community17
service in an amount of not more than forty hours per month until18
the judgment is paid or until the court is satisfied that the19
offender is in compliance with the approved payment schedule.20
Ordering an offender to perform community service under this21
division does not lessen the amount of the judgment and does not22
preclude the state from taking any other action to execute the23
judgment.24

       Section 2.  That existing section 2947.23 of the Revised25
Code is hereby repealed.26
