To amend section 2947.23 of the Revised Code to | 1 |
authorize courts to impose periods of community | 2 |
service upon offenders who fail to pay judgments | 3 |
for court costs relating to the criminal action. | 4 |
Section 1. That section 2947.23 of the Revised Code be | 5 |
amended to read as follows: | 6 |
Sec. 2947.23. (A) In all criminal cases, including | 7 |
violations of ordinances, the judge or magistrate shall include in | 8 |
the sentence the costs of prosecution and render a judgment | 9 |
against the defendant for such costs. If a jury has been sworn at | 10 |
the trial of a case, the fees of the jurors shall be included in | 11 |
the costs, which shall be paid to the public treasury from which | 12 |
the jurors were paid. | 13 |
(B) If an offender fails to pay the judgment described in | 14 |
division (A) of this section or fails to timely make payments | 15 |
towards that judgment under a payment schedule approved by the | 16 |
court, the court may order the offender to perform community | 17 |
service in an amount of not more than forty hours per month until | 18 |
the judgment is paid or until the court is satisfied that the | 19 |
offender is in compliance with the approved payment schedule. | 20 |
Ordering an offender to perform community service under this | 21 |
division does not lessen the amount of the judgment and does not | 22 |
preclude the state from taking any other action to execute the | 23 |
judgment. | 24 |
Section 2. That existing section 2947.23 of the Revised | 25 |
Code is hereby repealed. | 26 |
