A BILL
To permit payment in fiscal year 2002 to school1
districts that exceed the number of permitted2
"calamity" days in fiscal year 2001 as a result of3
closing schools to prevent the spread of4
meningococcal disease, and to declare an emergency.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. Notwithstanding section 3317.01 of the Revised6
Code, no school district shall be denied payments under Chapter7
3317. of the Revised Code for fiscal year 2002 if any school in8
the district was open for instruction during fiscal year 2001 for9
fewer days than required by sections 3313.48, 3313.481, and10
3317.01 of the Revised Code, provided that the reason any such11
school was not open for the required number of days was to prevent12
the spread of meningococcal disease.13

       Section 2. This act is hereby declared to be an emergency14
measure necessary for the immediate preservation of the public15
peace, health, and safety. The reason for the necessity is that16
immediate action is necessary to avoid delays in fiscal year 200217
payments to school districts that exceeded the number of permitted18
calamity days in fiscal year 2001 because of an unforeseen need to19
close schools to prevent the spread of meningococcal disease.20
Therefore, this act shall go into immediate effect.21
