A BILL
To amend section 4507.52 of the Revised Code to change1
a scheduled deputy registrar fee increase relative2
to duplicate or replacement identification cards3
from $3.75 to $2.75, and to declare an emergency.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4507.52 of the Revised Code be5
amended to read as follows:6

       Sec. 4507.52.  Each identification card issued by the7
registrar of motor vehicles or a deputy registrar shall display a8
distinguishing number assigned to the cardholder, and shall9
display the following inscription:10

"STATE OF OHIO IDENTIFICATION CARD
11

       This card is not valid for the purpose of operating a motor12
vehicle. It is provided solely for the purpose of establishing13
the identity of the bearer described on the card, who currently is14
not licensed to operate a motor vehicle in the state of Ohio."15

       The identification card shall display substantially the same16
information as contained in the application and as described in17
division (A)(1) of section 4507.51 of the Revised Code, including18
the cardholder's social security number unless the cardholder19
specifically requests that the cardholder's social security number20
not be displayed on the card. If federal law requires the21
cardholder's social security number to be displayed on the22
identification card, the social security number shall be displayed23
on the card notwithstanding a request to not display the number24
pursuant to this section. The identification card also shall25
display the color photograph of the cardholder. If the cardholder26
has executed a durable power of attorney for health care or a27
declaration governing the use or continuation, or the withholding28
or withdrawal, of life-sustaining treatment and has specified that29
the cardholder wishes the identification card to indicate that the30
cardholder has executed either type of instrument, the card also31
shall display any symbol chosen by the registrar to indicate that32
the cardholder has executed either type of instrument. The card33
shall be sealed in transparent plastic or similar material and34
shall be so designed as to prevent its reproduction or alteration35
without ready detection.36

       The identification card for persons under twenty-one years of37
age shall have characteristics prescribed by the registrar38
distinguishing it from that issued to a person who is twenty-one39
years of age or older, except that an identification card issued40
to a person who applies no more than thirty days before the41
applicant's twenty-first birthday shall have the characteristics42
of an identification card issued to a person who is twenty-one43
years of age or older.44

       Every identification card issued to a resident of this state45
shall expire, unless canceled or surrendered earlier, on the46
birthday of the cardholder in the fourth year after the date on47
which it is issued. Every identification card issued to a48
temporary resident shall expire in accordance with rules adopted49
by the registrar and is nonrenewable, but may be replaced with a50
new identification card upon the applicant's compliance with all51
applicable requirements. A cardholder may renew the cardholder's52
identification card within ninety days prior to the day on which53
it expires by filing an application and paying the prescribed fee54
in accordance with section 4507.50 of the Revised Code.55

       If a cardholder applies for a driver's or commercial driver's56
license in this state or another licensing jurisdiction, the57
cardholder shall surrender the cardholder's identification card to58
the registrar or any deputy registrar before the license is59
issued.60

       If a card is lost, destroyed, or mutilated, the person to61
whom the card was issued may obtain a duplicate by doing both of62
the following:63

       (A) Furnishing suitable proof of the loss, destruction, or64
mutilation to the registrar or a deputy registrar;65

       (B) Filing an application and presenting documentary66
evidence under section 4507.51 of the Revised Code.67

       Any person who loses a card and, after obtaining a duplicate,68
finds the original, immediately shall surrender the original to69
the registrar or a deputy registrar.70

       A cardholder may obtain a replacement identification card71
that reflects any change of the cardholder's name by furnishing72
suitable proof of the change to the registrar or a deputy73
registrar and surrendering the cardholder's existing card.74

       When a cardholder applies for a duplicate or obtains a75
replacement identification card, the cardholder shall pay a fee of76
two dollars and fifty cents. A deputy registrar shall be allowed77
an additional fee of threetwo dollars and seventy-five cents78
commencing on July 1, 2001, three dollars and twenty-five cents79
commencing on January 1, 2003, and three dollars and fifty cents80
commencing on January 1, 2004, for issuing a duplicate or81
replacement identification card. A disabled veteran who is a82
cardholder and has a service-connected disability rated at one83
hundred per cent by the veterans' administration may apply to the84
registrar or a deputy registrar for the issuance of a duplicate or85
replacement identification card without payment of any fee86
prescribed in this section, and without payment of any lamination87
fee if the disabled veteran would not be required to pay a88
lamination fee in connection with the issuance of an89
identification card or temporary identification card as provided90
in division (B) of section 4507.50 of the Revised Code.91

       A duplicate or replacement identification card shall expire92
on the same date as the card it replaces.93

       The registrar shall cancel any card upon determining that the94
card was obtained unlawfully, issued in error, or was altered. The95
registrar also shall cancel any card that is surrendered to the96
registrar or to a deputy registrar after the holder has obtained a97
duplicate, replacement, or driver's or commercial driver's98
license.99

       No agent of the state or its political subdivisions shall100
condition the granting of any benefit, service, right, or101
privilege upon the possession by any person of an identification102
card. Nothing in this section shall preclude any publicly103
operated or franchised transit system from using an identification104
card for the purpose of granting benefits or services of the105
system.106

       No person shall be required to apply for, carry, or possess107
an identification card.108

       (C) Except in regard to an identification card issued to a109
person who applies no more than thirty days before the applicant's110
twenty-first birthday, neither the registrar nor any deputy111
registrar shall issue an identification card to a person under112
twenty-one years of age that does not have the characteristics113
prescribed by the registrar distinguishing it from the114
identification card issued to persons who are twenty-one years of115
age or older.116

       Section 2. That existing section 4507.52 of the Revised Code117
is hereby repealed.118

       Section 3. This act is hereby declared to be an emergency119
measure necessary for the immediate preservation of the public120
peace, health, and safety. The reasons for the emergency are: (1)121
that Am. Sub. H.B. 94 of the 124th General Assembly contains an122
inadvertent error in the amount of the fee that a deputy registrar123
must charge on and after July 1, 2001, for a duplicate or124
replacement Ohio identification card, and (2) that, unless that125
inadvertent error is corrected prior to that date, cardholders126
will be required to pay one dollar more than was intended by the127
General Assembly for each duplicate or replacement card they128
request until January 1, 2003. Therefore, this act shall go into129
immediate effect.130
