To amend section 124.04 and to enact section 124.139

of the Revised Code to grant full-time state

employees 30 days paid leave per year to serve as a

3

liver or kidney donor and seven days paid leave per

4

year to serve as a bone marrow donor.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section 1. That section 124.04 be amended and section 124.139	6
of the Revised Code be enacted to read as follows:	7

Sec. 124.04.  In addition to those powers enumerated in	8
Chapters 123. and 125. of the Revised Code and as provided	9
elsewhere by law, the powers, duties, and functions of the	10
department of administrative services not specifically vested in	11
and assigned to, or to be performed by, the state personnel board	12
of review are hereby vested in and assigned to, and shall be	13
performed by, the director of administrative services. These	14
powers, duties, and functions shall include, but shall not be	15
limited to, the following powers, duties, and functions:	16

(A) To prepare, conduct, and grade all competitive	17
examinations for positions in the classified state service;	18

(B) To prepare, conduct, and grade all noncompetitive	19
examinations for positions in the classified state service;	20

(C) To prepare eligible lists containing the names of	21
persons qualified for appointment to positions in the classified	22
state service;	23

(D) To prepare or amend, in accordance with section 124.14	24
of the Revised Code, specifications descriptive of duties,	25
responsibilities, requirements, and desirable qualifications of	26
the various classifications of positions in the state service;	27

(E) To allocate and reallocate, upon the motion of the	28
director or upon request of an appointing authority and in	29
accordance with section 124.14 of the Revised Code, any position,	30
office, or employment in the state service to the appropriate	31
classification on the basis of the duties, responsibilities,	32
requirements, and qualifications of suchthat position, office, or	33
employment;	34

(F) To develop and conduct personnel recruitment services	35
for positions in the state service;	36

(G) To conduct research on specifications, classifications,	37
and salaries of positions in the state service;	38

(H) To develop and conduct personnel training programs in	39
cooperation with appointing authorities;	40

(I) To include periodically in communications sent to state	41
employees informationboth of the following:	42

(1) Information developed under section 2108.15 of the	43
Revised Code promoting the donation of anatomical gifts under	44
Chapter 2108. of the Revised Code;	45

(2) Information about the liver or kidney donor and bone	46
marrow donor leave granted under section 124.139 of the Revised	47
Code.	48

(J) To enter into agreements with universities and colleges	49
for in-service training of personnel in the civil service;	50

(K) To appoint such examiners, inspectors, clerks, and other	51
assistants as are necessary in the exercise of the powers and	52
performance of the duties and functions which the director is by	53
law authorized and required to exercise and perform, and to	54
prescribe the duties of all suchof those employees;	55

(L) To maintain a journal, which shall be open to public	56
inspection, in which the director shall keep a record of the	57
director's final decision pertaining to the classification or	58
reclassification of positions in the state classified service and	59
assignment or reassignment of employees in the state classified	60
service to specific position classifications;	61

(M) To delegate any of the powers, functions, or duties	62
granted or assigned to the director under this chapter to any	63
other state agency of this state as the director considers	64
necessary;	65

(N) To delegate any of the powers, functions, or duties	66
granted or assigned to the director under this chapter to any	67
political subdivision with the concurrence of the legislative	68
authority of the political subdivision.	69

Sec. 124.139. (A) A full-time state employee shall receive	70
up to two hundred forty hours of leave with pay during each	71
calendar year to use during those hours when the employee is	72
absent from work because of the employee's donation of any portion	73
of an adult liver or because of the employee's donation of an	74
adult kidney.	75

(B) A full-time state employee shall receive up to fifty-six	76
hours of leave with pay during each calendar year to use during	77
those hours when the employee is absent from work because of the	78
employee's donation of adult bone marrow.	79

(C) An appointing authority shall compensate a full-time	80
state employee who uses leave granted under division (A) or (B) of	81
this section at the employee's regular rate of pay for those	82
regular work hours during which the employee is absent from work.	83

(D)(1) The director of administrative services, under	84
section 124.04 of the Revised Code, shall provide information	85
about this section to full-time employees who are paid directly by	86
warrant of the auditor of state.	87

(2) The appointing authority of full-time employees who are	88
not paid directly by warrant of the auditor of state shall	89
periodically provide information about this section to those	90
employees.	91

Section 2. That existing section 124.04 of the Revised Code	92
is hereby repealed.	93

Section 3. The General Assembly hereby encourages political	94
subdivisions and private employers in this state to grant to their	95
full-time employees paid leave similar to the paid leave granted	96
to full-time state employees under section 124.139 of the Revised	97
Code, as enacted by this act.	98
