A BILL
To amend section 124.04 and to enact section 124.1391
of the Revised Code to grant full-time state2
employees 30 days paid leave per year to serve as a3
liver or kidney donor and seven days paid leave per4
year to serve as a bone marrow donor.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 124.04 be amended and section 124.1396
of the Revised Code be enacted to read as follows:7

       Sec. 124.04.  In addition to those powers enumerated in8
Chapters 123. and 125. of the Revised Code and as provided9
elsewhere by law, the powers, duties, and functions of the10
department of administrative services not specifically vested in11
and assigned to, or to be performed by, the state personnel board12
of review are hereby vested in and assigned to, and shall be13
performed by, the director of administrative services. These14
powers, duties, and functions shall include, but shall not be15
limited to, the following powers, duties, and functions:16

       (A) To prepare, conduct, and grade all competitive17
examinations for positions in the classified state service;18

       (B) To prepare, conduct, and grade all noncompetitive19
examinations for positions in the classified state service;20

       (C) To prepare eligible lists containing the names of21
persons qualified for appointment to positions in the classified22
state service;23

       (D) To prepare or amend, in accordance with section 124.1424
of the Revised Code, specifications descriptive of duties,25
responsibilities, requirements, and desirable qualifications of26
the various classifications of positions in the state service;27

       (E) To allocate and reallocate, upon the motion of the28
director or upon request of an appointing authority and in29
accordance with section 124.14 of the Revised Code, any position,30
office, or employment in the state service to the appropriate31
classification on the basis of the duties, responsibilities,32
requirements, and qualifications of suchthat position, office, or33
employment;34

       (F) To develop and conduct personnel recruitment services35
for positions in the state service;36

       (G) To conduct research on specifications, classifications,37
and salaries of positions in the state service;38

       (H) To develop and conduct personnel training programs in39
cooperation with appointing authorities;40

       (I) To include periodically in communications sent to state41
employees informationboth of the following:42

       (1) Information developed under section 2108.15 of the43
Revised Code promoting the donation of anatomical gifts under44
Chapter 2108. of the Revised Code;45

       (2) Information about the liver or kidney donor and bone46
marrow donor leave granted under section 124.139 of the Revised47
Code.48

       (J) To enter into agreements with universities and colleges49
for in-service training of personnel in the civil service;50

       (K) To appoint such examiners, inspectors, clerks, and other51
assistants as are necessary in the exercise of the powers and52
performance of the duties and functions which the director is by53
law authorized and required to exercise and perform, and to54
prescribe the duties of all suchof those employees;55

       (L) To maintain a journal, which shall be open to public56
inspection, in which the director shall keep a record of the57
director's final decision pertaining to the classification or58
reclassification of positions in the state classified service and59
assignment or reassignment of employees in the state classified60
service to specific position classifications;61

       (M) To delegate any of the powers, functions, or duties62
granted or assigned to the director under this chapter to any63
other state agency of this state as the director considers64
necessary;65

       (N) To delegate any of the powers, functions, or duties66
granted or assigned to the director under this chapter to any67
political subdivision with the concurrence of the legislative68
authority of the political subdivision.69

       Sec. 124.139. (A) A full-time state employee shall receive70
up to two hundred forty hours of leave with pay during each71
calendar year to use during those hours when the employee is72
absent from work because of the employee's donation of any portion73
of an adult liver or because of the employee's donation of an74
adult kidney.75

       (B) A full-time state employee shall receive up to fifty-six76
hours of leave with pay during each calendar year to use during77
those hours when the employee is absent from work because of the78
employee's donation of adult bone marrow.79

       (C) An appointing authority shall compensate a full-time80
state employee who uses leave granted under division (A) or (B) of81
this section at the employee's regular rate of pay for those82
regular work hours during which the employee is absent from work.83

       (D)(1) The director of administrative services, under84
section 124.04 of the Revised Code, shall provide information85
about this section to full-time employees who are paid directly by86
warrant of the auditor of state.87

       (2) The appointing authority of full-time employees who are88
not paid directly by warrant of the auditor of state shall89
periodically provide information about this section to those90
employees.91

       Section 2. That existing section 124.04 of the Revised Code92
is hereby repealed.93

       Section 3. The General Assembly hereby encourages political94
subdivisions and private employers in this state to grant to their95
full-time employees paid leave similar to the paid leave granted96
to full-time state employees under section 124.139 of the Revised97
Code, as enacted by this act.98
